EAGLE PLANNING AND ZONING MEETING
MINUTES
August 4,1997
The Planning and Zoning Commission met in regular session on August 4, 1997. Chairman
Bradley presiding.

CALL TO ORDER:

Moved by Brinton to postpone approval of the minutes until the next scheduled meeting
and Seconded by Maile. ALL AYE...MOTION CARRIES...

5. PUBLIC HEARINGS:
Chairman Bradley announced it is the time and the place for the Public Hearing.
A. CPA-I-97 - Comprehensive Plan Amendment: Mark Guho is requesting a Comprehensive
Plan Amendment from medium density residential (4 or fewer units per acre) to commercial.
The site is located on the northeast comer of Cobblestone Lane and State Street approximately VI
mile west of Eagle Road. The address ofthe site is 450 W. State Street. The applicant intends to
request that this item be continued until the August 18, 1997 meeting.
Bradley introduces the item.
Mark Guho 362 Rooster Drive. asks for a continuance to August 18, 1997 meeting, per a request
from Mark Butler.
Butler gives his reasoning for this requested continuance.
Maile moves to continue items CPA-I-97, RZ-2-97, CPA-2-97, RZ-4-97 to the August 18,
1997 meeting. Seconded by Brinton. ALL AYE.. .MOTION CARRIES.
B. RZ-2-97 - Rezone from R-5 to C-2 and L-O - Mark Guho: Mark Guho is requesting a
rezone from R-5 (residential) to C-2 (general business district) and L-O (limited office district).
The property is approximately 430-feet deep. The front 260-feet ofthe site that fronts State St. is
proposed to be rezoned to C-2 with the remainder of the property to be rezoned to L-O. The site
is located on the northeast comer of Cobblestone Lane and State Street approximately VI mile
west of Eagle Road. The address of the site is 450 W. State Street. The applicant intends to
request that this item be continued until the August 18, 1997 meeting.

C. CPA-2-97 - Comprehensive Plan Amendment - Ea!!le River Development (Grossman
Property): Bill Clark is requesting a Comprehensive Plan Amendment from Public/Semi-Public
and Medium Density Residential (4 or fewer units per acre) to Commercial and High Density
ResidentiallLimited Professional Office/Limited Commercial (up to 25 units per acre). The 83-
acre site is located on the southeast corner of Eagle Road and the Alternate Route. The applicant
has requested that this item be continued until the August 18, 1997 meeting.
Continued to August 18, 1997 see above motion.
D. RZ-4-97 - Rezone - Ea!!le River Development (Grossman Property): Bill Clark is
requesting a rezone from Agricultural (A) and Light Manufacturing District-Planned Unit
Development (M-IA) to High Density Residential (R-20, maximum 20 units per acre), Highway
Business District (C-3), and Agricultural (A). The 83-acre site is located on the southeast corner
of Eagle Road and the Alternate Route. The applicant has requested that this item be continued
until the August 18, 1997 meeting.

E. CP A-5-97 - City initiated Comprehensive Plan amendments: Amendments could
include, but are not limited to, adding light industriaVindustrial park land uses, changing
commercial along State Street to discourage strip commercial and to encourage commercial
clusters, bringing the Comprehensive Plan land use map designations into confonnance with
existing new development and zoning, modifying the mixed use/high density category on the
current Plan, providing for a central business district designation on the Plan, and providing for a
scenic corridor boundary on the plan. See proposed land use maps and comprehensive plan text
at City Hall.
Bradley introduces the issue.
Butler gives a detailed overview ofthe issue. Explanations of Central Business District, Mixed
Use, Public/Semi-Public, and Industrial designations as shown on the proposed Comprehensive
Plan map. Butler reviews the proposed changes to the text. General discussion between
Commission and Butler.
Nancy Taylor relays infonnation gathered during the public workshops. The overwhelming
concern expressed by the public was regarding the annexation. It has been decided that the
Commission shall address this issue at another time. In regards to other issues, there was
concern expressed regarding the usage between old highway 55 and new highway 55. She
directs the Commissions attention towards the memo they received in their packets, which
contains a list of her recommendations regarding each of the item. General discussion between
Commission and Ms. Taylor.
Bill Selvage, 1992 Spring brook Lane, Boise, ID. Notes that he attended the workshops and
commends the City and Staff on their efforts. Would like to encourage the entryway and the
visual transition in and out of downtown buffer into the downtown by providing a greenway or
buffer zone on the north side of the northeast portion of the new bypass between Eagle and the
bypass, if that could be extended also on the south side and also on the west side so as you get
closer to the downtown there is a visual statement. Makes comment regarding the definition of
open space. He urges the Commission to reconsider that definition.

Steve Deckers, 2249 Dickie Circle Eagle, ID. States that he is in general agreement with the
proposed changes. Also expresses pleasure with the effort ofthe city to involve the citizens in
this process.
Commissioner Trent arrives at 8:30 p.m.
Tom Dater, 827 E. Riverside Eagle. Comments on the floodway transfers, and on commercial
development south of the by-pass.
General discussion between Commission, Butler and Attorney.
Tom Dater provides more comment regarding pathways in the floodway areas, and that it is
possible that they remain under water for a good deal of time in the Spring and Summer months.
General discussion between Commission and Butler.
Brinton moves to continue the CP A-5-97 City Initiated Comprehensive Plan amendments
to the August 1Sth meeting. Seconded by Maile. ALL AYE...MOTION CARRIES...
F. ZOA-5-97 - Citv initiated zonine: ordinance amendments: To amend ordinances
related to zoning interpretation and definitions to clarify interpretations, provide additional
definitions for uses not shown, and to clarify definitions of uses currently defined; to amend
ordinances related to zoning districts and zoning map to clarify definitions of existing
established districts and to establish new districts, to make zoning designation changes to the
official zoning map incorporation by reference, to add, delete and modify uses within the
schedule of district use regulations, and to modify the schedule of building height and lot area
regulations; to amend ordinances related to performance standards to modify and provide
additional supplemental general provisions and supplemental yard and height regulations. See
proposed zoning maps and zoning text at City Hall.
Bradley introduces the issue.
Butler reviews the proposed zoning ordinance amendments. Notes that it is a lengthy document
and the reason for this, is to make the code more user friendly and eliminate the need for
interpretation, everything should be addressed in the code. Urges the Commission to review the
document and he will answer any questions they may have. Butler notes that the proposed
ordinance amendments accurately reflects the suggested changes in the proposed comprehensive
plan amendments.
Discussion between Commission, Butler, and Attorney.
Bill Selvage 1992 Springbrook Lane Boise, ID. Commends staff on the proposed zoning
ordinance. Also likes the Mixed use and the Central Business District designation. Would like
to see a few changes to the Mixed use i.e. hotel/motel, clinic spaces, etc. Mr. Selvage addresses
a question regarding notification to affected property owners to the City Attorney. Notes that the
Comprehensive plan is usually something that cities strive towards. Suggests approval of the
zoning ordinance text.

Attorney comments on the Idaho State Code requirements regarding notification.
General discussion between Commission, Butler, Mr. Selvage, and Attorney
Angela Deckers 2249 Dickie Circle representing Evans Circle (#2 & #3). Discusses the impact
on her subdivision by the gravel pit (Prime Earth), and she strongly supports what Mark Butler
has suggested. The gravel operation has impacted their quality of life. Also supports the
changing of the state owned gravel pit zoning classification, to PS as suggested by Butler.
Discussion between Commission and Attorney.
General discussion between Commissioners, Butler and Attorney.
Brinton moves to continue ZOA-5-97 to the August 18th meeting. Seconded by Maile. ALL
AYE...MOTION CARRIES.
