Minutes - 1997 - Planning & Zoning - 07/14/1997 - Regular EAGLE PLANNING AND ZONING MEETING MINUTES July 14, 1997 ORIGINAL The Eagle Planning and Zoning Commission met in regular session on Julyl4, 1997. Chairman Bradley presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present: BERT BRADLEY, DONALD BRINTON, RUSSEL MA YER, PRESENT. COLLEEN MAILE, F ARRIN FARNWORTH ABSENT: A quorum is present. 3. REQUEST FOR APPROVAL: A. Minutes of June 16, 1997 B. Minutes of June 30, 1997. Moved by Brinton and Seconded by Mayer to approve the minutes of the June 16, 1997 and June 30, 1997 meetings as presented. ALL AYE: MOTION CARRIES... 4. OLD BUSINESS: NONE 5. PUBLIC HEARING: Chairman Bradley announced it is the time and the place for the Public Hearing. A. CU-4-97- Conditional Use - Reid Merrill: Reid Merrill is requesting a conditional use permit to construct a 47,800 sq. ft. indoor recreational center. The proposed 8-acre site is located on the back portion of the parcel at 1125 E. State Street, approximately Y2-mile east of Eagle Road and approximately 800-feet south of State Street. The applicant has requested that this item be continued to the July 28, 1997 meeting. B. RZ-5-97-Rezone from A to L-O - Reid Merrill: Reid Merrill is requesting a rezone nom A (agricultural) to L-O (limited office) to construct a 47,800 sq. ft. indoor recreational center. The proposed 8-acre site is located on the back portion of the parcel at 1125 E. State Street, approximately Y2-mile east of Eagle Road and approximately 800-feet south of State Street. The applicant has requested that this item be continued to the July 28, 1997 meeting. Brinton moves to continue CU-4-97 and RZ-5-97 to the July 28, 1997 meeting. Seconded by Mayer. RZ-6-97 - Rezone from A to A-R -Charles Lobdell: Charles Lobdell, represented by Scott Fahey, is requesting a rezone from A (agricultural) to A-R (agricultural-residential). The Zoning Administrator gives his staff report. Recommends approval of the rezone. Brinton moves to approve RZ-6-97 rezone from A to A-R as presented. Seconded by Mayer. ALL AYE... MOTION CARRIES... D. PP-1-97 - Preliminarv Plat for Gleneal!les Commercial Subdivision: Edge Development, represented by Briggs Engineering, is requesting preliminary plat approval for a 5.14-acre, 5-lot (3-buildable) commercial subdivision located on the east side of Eagle Road approximately 600- feet south of State Street at 174 South Eagle Road (temp. address). Bradley introduces the issue. Van Elg, 1111 S. Orchard, Boise, ID with Briggs Engineering, represents Edge Development. Gives an overview of the project. Question and answer between Commission and Mr. Elg. Zoning Administrator gives his staff report. Recommends approval with the staff conditions. General discussion between Butler and Commissions. Bill Webster, Edge Development, responds to the Commissions question regarding trees which were destroyed when the houses were moved. Brinton questions whether or not these trees will be replaced. Butler responds to the question. Arron Nemec, 815 W. Washington St. Boise, Idaho representing Eagle Manor, expresses the following concerns of his clients: Would like adequate visual and sound buffers on Second St.; time limits for loading and unloading activities on Second St.; prohibit trash receptacles or mandate adequate screening of such receptacles; has concerns regarding the design of the proposed building; would like the speed limit on Plaza St. to be 20 to 25 mph; would like bulb outs on Plaza & Second St.; would like Plaza St. to meander rather than run straight; also expresses concern regarding the increase in traffic flow. Mr. Nemec expresses his clients general approval of the project as long as these issues are considered and addressed. Mike Baldner, 250 Park Center, Boise, ID representing Albertson's gives a statement regarding the project, and expresses his support of the project. General discussion between Commission. Brinton moves to approve PP-1-97 Preliminary Plat for Gleneagles Commercial Subdivision with site specific and standard conditions of approval as presented in the staff report. Seconded by Mayer. ALL AYE...MOTION CARRIES... E. ZOA-2-97 - Zoninl! Ordinance Amendment- Citv ofEal!le: To consider an ordinance amendment (ZOA-2-97) providing for landscape and buffer area requirements for developments requiring a Design Review, including but not limited to all subdivisions. Bradley introduces the item. Zoning Administrator gives an overview of the issue. General discussion between Commission and Staff. Seconded by Mayer. ALL AYE...MOTION CARRIES... 6. NEW BUSINESS: A. DR-17-95 MOD - Proposed I-acre expansion to Albertson's site for parkine lot modifications and construction of a fuel island and canopv - Cord Christensen: Albertson's Corp., represented by Cord Christensen, is requesting approval for a modification to their original design review application to allow parking lot modifications and construction of a fuel island and canopy. The site is located at 434 S. Eagle Rd., near the northeast comer of Eagle Rd. and the Eagle Alternate Route. Bradley introduces the issue. Cord Christensen, 101 Firwood Eagle, representing Albertson's, gives an overview of the project. Legal Council provides clarification as to the appropriateness of addressing this item. Mike Baldner, provides additional clarification regarding the issue. Zoning Administrator gives staff report. Recommends approval with standard and site specific, and design review conditions. General discussion between Cord Christensen and Commission. Brinton moves to approve with the site specific and standard conditions, also recommends that the final landscape design be brought back before the Design Review and the Planning and Zoning Commission. Seconded by Mayer. ALL AYE... MOTION CARRIES. B. 97-22-PDR - Winder Estates - David H. Cle" David Clegg is requesting preliminary plat and private road approval for Winder Estates Subdivision. The site contains approximately 6.27 acres, consists of 3 residential lots, and is located on the east side of Ballantine Road approximately Y4-mile north of Floating Feather Road. This subdivision is located in the Eagle Area of Impact Bradley introduces the issue. The Zoning Administrator gives an overview of the project. General discussion between Staff and Commission. Mayer moves to approve 97-22-PDR Winder Estates with site specific and standards conditions, with the additional condition that the road meet grade standards ingress and egress for private roads. Findine:s of Fact for Preliminarv Plat for Gleneae:les Commercial Subdivision-PP-I-97: The Zoning Administrator is requesting Commission approval of the Findings of Fact for the preliminary plat for Gleneagles Commercial Subdivision Edge The 5. 14-acre, 5-10t (3-buildable) commercial subdivision, is located on the east side of Eagle Road approximately 600-feet south of State Street at 174 South Eagle Road (temp. address) Bradley introduces the issue. ALL AYE...MOTION CARRIES... 7. ZONING ADMINISTRATOR'S REPORT: The Zoning Administrator invites the Commissioners to attend the Comprehensive Plan Workshops. Legal Council advises the Commissioners refrain from participating in any of the discussions at the workshops, so that the record will not be tainted. 8. ADJOURNMENT: Moved by MOTION CARRIES.......
