Minutes - 1997 - Planning & Zoning - 06/16/1997 - Regular ORIGINAL EAGLE PLANNING AND ZONING MEETING MINUTES June 16, 1997 The Eagle Planning and Zoning Commission met in regular session on June 16, 1997. Vice-Chairman Brinton presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present: BRINTON, MAYER, FARNWORTH. Absent: BRADLEY AND MAILE 3. REQUEST FOR APPROVAL: A. Minutes of June 2, 1997 Moved by Farnworth to approve the minutes, ofthe June 2, 1997 meeting as corrected. and Seconded by Mayer. ALL AYE: MOTION CARRIED. Mayer moved that item 6A be moved so that it follows agenda item 5C. Seconded by Farnworth. ALL AYE: MOTION CARRIED. 4. OLD BUSINESS: NONE 5. PUBLIC HEARING: Vice-Chairman Brinton announced it is the time and the place for the Public Hearing. A. CP A-2-97 - Comprehensive Plan Amendment - Ea21e River Development (Grossman Property): Bill Clark is requesting a Comprehensive Plan Amendment from Public/Semi-Public and Medium Density Residential (4 or fewer units per acre) to Commercial and High Density ResidentiaIlLimited Professional OfficelLimited Commercial (up to 25 units per acre). The 83-acre site is located on the southeast comer of Eagle Road and the Alternate Route. The Applicant is requesting this item be continued to the August 4, 1997 Commission meeting. t B. RZ-4-97 - Rezone - Ea21e River Development (Grossman Property): Bill Clark is requesting a rezone from Agricultural (A) and Light Manufacturing District-Planned Unit Development (M-IA) to High Density Residential (R-20, maximum 20 units per acre), Highway Business District (C-3), and Agricultural (A). The 83-acre site is located on the southeast comer of Eagle Road and the Alternate Route. The Applicant is requesting this item be continued to the August 4, 1997 Commission meeting. Mayer moves to continue CP A-2-97, Comprehensive Plan Amendment - Eagle River Development and RZ-4-97, Rezone - Eagle River Development (Grossman Property), to the August 4,1997 Commission meeting. Seconded by Farnworth. ALL AYE... MOTION CARRIES. c. CP A-3-97 Comprehensive Plan Amendment - Pete Cintorino: Pete Cintorino is requesting a Comprehensive Plan amendment from medium density residential (4 or fewer units per acre) to commercial. The 2~-acre (approx.) site is located on the south side of State Street approximately 800.feet west of existing State Highway 55 at 3031 East State Street. Brinton introduces the item. Pete Cintorino provides an overview of the item. Butler provides overview of his Staff Report. General discussion between the Commissioners and Zoning Administrator. Butler suggests that the Public Hearing portion be left open, and the item be continued to the August 4, 1997 Commission meeting. Bill Hines 276 Woodlander, inquires as to whether the decision regarding this item would be made at the August 4, 1997 meeting. Discussion between Commissioners, Zoning Administrator, and Mr. Hines to clarify the issue. Mr. Cintorino expresses his concern regarding the lengthy time frame its taking to get this item moved on. Brinton suggests he makes his feelings known to the City Council, as it is the Council who decides the time frame. Farnworth moves to continue CPA-3-97, Comprehensive Plan Amendment, leaving the public hearing portion open, to the August 4, 1997 Commission meeting. Seconded by Mayer. ALL AYE: MOTION CARRIES 6. NEW BUSINESS: A 97-16-PDR GD Lands Combined Preliminarv /Final Plat: Julie Gorrell, with GO Lands LLC, is requesting combined preliminary and final plat approval for GD Lands Subdivision. The site is approximately 22.47 acres, consists of four residential lots, and is located on the east side of Linder Road approximately 350 feet south of Beacon Light Road. This subdivision is located in the Eagle Area of Impact. Betsy Dudly and Byron Gorrell give a general overview of the item. Butler provides an overview of his Staff Report. Recommends standard conditions, and a letter from the Drainage District No.2 to be reviewed by the City Engineer, along with a few minor site specific conditions. General discussion among Commissioners. Mayer moves to approve 97-16-PDR, GD Lands Combined Preliminary /Final Plat, with site specific conditions and standard conditions. Seconded by Farnworth. ALL AYE...MOTION CARRIES. D. Ea Ie Ci Initiated Com rehensive Plan Amendments Annexation of Land Zonin Ma Amendments. and Zonin!! District Amendments: The City of Eagle is requesting public comment for providing a focus regarding the above mentioned items. Vice-Chainnan Brinton announced it is the time and the place for the Public Hearing. Zoning Administrator gives a detailed overview of the project and the proposed timeline. Linda Boyle, 3300 W. State, would like some clarification on who will receive mailings regarding the Comprehensive Plan Amendments. Butler specifies that it will be current Eagle residents, and residents in the current and proposed impact area. Also asks for clarification regarding the size of lots which may be annexed. Legal Council provides input regarding Idaho State Code and how it applies. Ms. Boyle inquires about Temporary Living Quarters (TLQ), or the Grannie Housing and how the annexation may affect this item. Steve Deckers, 2249 Dickie Circle, concerns regarding lID gravel pit. General discussion between Commissioners and Zoning Administrator. Mr. Deckers suggests an increase in bike paths and pedestrian paths in the new Comprehensive. Plan. Katherine Mc Pete, 4520 N. Linder Rd., expresses her concern regarding 5 acre lots forever and ever, seems rather unreasonable. She does not want to be annexed into the City. Discussion between Ms. McPete and Commissioners. Bret Gregoran, 5300 Homer Rd., believes there needs to be an urgent need before annexation is done. Mr. Gregoran feels that if you are going to look at expanding (the city limits), focus on the problem areas where you may be solving problems by annexing, rather than simply encompassing annexation. Commissioner Farnworth suggests the people attending speak with their neighbors and have them come down and provide public input regarding the Comprehensive Plan Amendments. Farnworth moves that we continue item 5D, Eagle City Initiated Comprehensive Plan Amendments, Annexation of Land, Zoning Map Amendments, and Zoning District Amendment until August 4,1997, and keep the public hearing portion open. Seconded by Mayer. ALL AYE.. .MOTION CARRIES. 7. ZONING ADMINISTRATOR'S REPORT: Butler notes that the June 10, 1997 City Council meeting was continued due to a lack of quorum, all items have been continued to the June 24, 1997 meeting. At that time the Council will appoint a facilitator for the Comprehensive Plan Amendments. The Zoning Administrator would like a motion from the Commission so that he may move forward with the proposed amendments to the Eagle City Code, Title 9 Chapter 3: Design Standards Section 2: Streets and Alleys. Discussion with the Commissioners for clarification for this item. Mayer move to direct the Zoning Administrator move forward with proposed amendments to Eagle City Code Title 9: Land Subdivisions Chapter 3: Design Standards Section 2: Streets and Alleys.
