Minutes - 1997 - Planning & Zoning - 05/19/1997 - Regular EAGLE PLANNING AND ZONING MEETING MINUTES May 19, 1997 The Eagle Planning and Zoning Commission met in regular session on May 19, 1997. Vice-Chairman Brinton presiding. 1. CALL TO ORDER: f 2. ROLL CALL: The following members were present: DONALD BRINT6N, RUSSEL MAYER, FARRIN FARNWORTH. ABSENT: BERT BRADLEY 'AND COLLEEN MAILE. 3. REQUEST FOR APPROVAL: A. Minutes of May 5, 1997 Moved by Mayer and Seconded by Farnworth to approve the minutes of the May 5, 1997, meeting as presented. ALL AYE: MOTION CARRIED. Farnworth moves that the Agenda be changed. Move 5B to 4A and move 4A to 6B. Seconded by Mayer. ALL AYE: MOTION CARRIES......... PUBLIC HEARING 5B: CU-3-97 Gravel Extraction Operation - Ed Hendershot: Ed Hendershot is requesting conditional use approval for a gravel extraction operation to remove gravel from a shallow pond and use the material as fill to raise two building pads out of the 100 year floodplain. The 26.82 acre site is located approximately 3/8- mile east of Eagle Rd., abutting Island Woods Subdivision on the west of the North Channel of the Boise River on the north. Vice-Chairman Brinton introduces the issue. Ed Hendershot, Applicant, displays an aerial view of the project and explains the same to the Commissioners. General discussion. Butler provides an overview of the Staff Report. Discussion in regards to the material being removed from the property and the traffic that would generate. Staff recommends approval on the information that is in the report. Distributes a letter from Hendershot and a letter from a resident in the area concerned about wildlife. General discussion. Vice-Chairman Brinton Opens the Public Hearing. No one signed up to speak and no one in the audience wishing to speak. Mayer moves that we approve CU-3-97 Gravel Extraction Operation-Ed Hendershot with Site Specific Conditions of Approval, eliminating #6, and further conditions that the second pond meets the requirements for the City on mesquito control and recommends using the South roadway if possible. Seconded by Farnworth. ALL AYE: MOTION CARRIES............ 5. PUBLIC HEARING: A. CU-11-96/MOD Modification of Conditional Use Permit for Gravel Crushing and Hot Plant Operation: Idaho Transportation Department, represented by Doug Chase, is requesting a modification to the existing (CU-11-96) conditional use permit for gravel crushing and hot plant operation for the construction of the new SH-55 alignment. The site is located on both sides of Hill Rd. in the newly acquired right of way, approximately 1/4 mile west of Horseshoe Bend Rd. This item will be continued until the June 2, 1997, meeting due to inadequate notice for the public hearing. Vice-Chairman Brinton introduces the issues. Butler explains the reasons for the item being continued. Mayer moves that CU-11-96/MOD Modification of Conditional Use Permit for Gravel Crushing and Hot Plant Operation be moved to the June 2, 1997, meeting. Seconded by Farnworth. ALL AYE: MOTION CARRIES.......... 6. NEW BUSINESS: A. Findings of Fact for RZ-3-97 for a rezone from R-5 (residential) to C-2 (general business district): The Zoning Administrator is requesting Commission approval of the Findings of Fact for the rezone application submitted by Stetson Homes Inc. The site is located approximately 720-feet south of State Street at 209 S. Eagle Rd. Vice-Chairman Brinton introduces the issue. General discussion between Butler, the Commissioners and Legal Counsel. Discussion on the Development Agreement. Farnworth moves that we approve the Findings of Fact for RZ-3-97 as recommended by Staff. Seconded by Mayer. ALL AYE: MOTION CARRIES........... PzO51997 2 4. OLD BUSINESS: A. Timeline for Comprehensive Plan Amendments: The Zoning Administrator has submitted a list of potential Comprehensive Plan amendments so the Commission may determine a timeline for action. This item was continued from the May 5, 1997 Planning and Zoning Meeting. Vice-Chairman Brinton introduces the issue. Butler discusses potential amendments to the Comprehensive Plan and the timeline that the Council is recommending. General discussion on public hearings, facilitators and work that the Staff will be doing on the amendments. Discussions between Commissioners, Butler and Legal Counsel on annexation. 7. ZONING ADMINISTRATOR'S REPORT: Butler reports on the last City Council meeting. Discussion on Buckwheat Acres between Butler, Legal Counsel and the Commissioners.
