EAGLE PLANNING AND ZONING MEETING MINUTES
FEBRUARY 24, 1997
The Eagle Planning and Zoning Commission met in a special meeting on February 24,
1997. Chairman Bradley presiding.
The following members were present: BERT BRADLEY, DONALD BRINTON, RUSSEL
MAYER, COLLEEN MAILE, FARRIN FARNWORTH.
Brinton: I would like to amend the Agenda for this evening. Following Item 5 I would
like to go into Executive Session on personal matters. Unanimously agreed to by the
Commissioners.
OLD BUSINESS: NONE
PUBLIC HEARINGS:
Chairman Bradley announced it is the time and the place for the Public Hearings.
Brinton: I would like to ask the Commissioners if they would like to hear both items
together and vote on them as separate items. Agreed by the Commissioners.
A. RZ-1-97 R-5 to C-2/ Billy Ray Strite: Edge Development, represented by BRS
Architects, is requesting a rezone from R-5 (residential 5 units per acre maximum) to C-
2 (general business district). The 4.4-acre site is located on the east side of Eagle
Road approximately 600-feet south of State St. at 174 S. Eagle Road (temp. address).
B. CU-2-97 & CU-1-97 Commercial Complex & Drive- Thru Restaurantl Billy
Ray Strite: Edge Development, represented by BRS Architects, is requesting two
conditional use approvals, one for a commercial complex, and another for a restaurant
with drive-thru within the commercial complex. The staff report addresses both
applications. The 4.4-acre site is located on the east side of Eagle Road approximately
600-feet south of State St. at 174 S. Eagle Road (temp. address).
Billy Ray Strite, 1087 River Street, Boise - I am here with the Applicant, Mr. Webster
and also the Burger King representatives. Strite displays site plans; explains and
provides information on this application.

General discussion. Bradley has concerns about the letter from the Eagle Sewer
District wherein they say "first come, first serve". Strite responds that their engineer,
Briggs and Associates, have spoken to the Sewer District and they have extended
sewer to Albertson's and have extended a welcome to Mr. Briggs. This is something
that has to be dealt with. We will ask Mr. Briggs to move forward on that. Farnworth
asks for drainage and drain ditch to be addressed. Strite discusses the drainage of the
project. General discussion. Farnworth has questions about the trees being saved.
General discussion on the trees.
Butler: Overview of Staff Report. Staff recommends approval and does not recommend
a Development Agreement. General discussion. Brinton has questions on the Site
Specific Conditions. Farnworth has a question about the flood way. Brinton has a
question about the Drain District. Comments from Strite on Drain District and general
discussion.
Paddy Row, 2nd Street, Eagle - Concerned about the road that is going to be put in
around 2nd Street. We need to have good business to draw customers into Eagle.
General discussion among applicants and Commissioners.
Chairman Bradley closes the Public Hearing.
General discussion among the Commissioners. Commissioners are impressed with the
project and agree that the project will add to downtown. Discussion about a
Development Agreement. Bill Webster, Edge Development, discusses the time frame
that the Development Agreement would impose. General discussion.
Brinton: I move that we approve Rezone RZ-1-97 as presented tonight rezoning
from R-5 to C-2, Seconded by Maile. ALL AYE; MOTION CARRIES...
Brinton: I move to approve CU-1-97 and CU-2-97 for Edge Development with Staff
recommendations and Standard Conditions of approvals with Site Specific
Conditions being modified: #7 to show approximately 19 trees and 45 shade
trees, etc., to be determined at Design Review; #12 to show the new EastlWest
road; and #13 to show Eagle Road on the Site Specific Conditions. This is based
upon approval of the Sewer District being able to provide sewer; final approval
from ACHD; approval from the Drain District and that the parking areas adjacent
to the areas entering this development from the new EastlWest road be
designated as employee parking, Seconded by Maile. ALL AYE: MOTION

NEW BUSINESS:
A. 97-2-Z0A- Accessory Dwelling- Ada County Transmittal: Ada County is
proposing an ordinance to permit accessory dwellings in the RP, RR, RT, RSW, R-1, R-
3, R-4, and R-8 zoning designations within Ada County.
Butler: Overview of the Ada County Transmittal. Staff is in favor. General discussion.
Maile: Should we move to recommend it with those contingencies that they met
set backs and maximum lot coverage? So Moved by Maile, Seconded by Brinton.
ALL AYE: MOTION CARRIES...
ZONING ADMINISTRATOR'S REPORT: No report.
Bradley gives a report on the City Council Workshop Meeting with EM2.
Maile: I move that we go into Executive Session, Seconded by Brinton. ALL AYE:

Maile: I move that we come out of Executive Session and go back on the record,
Seconded by Brinton. ALL AYE: MOTION CARRIES.........
Bradley: We have reached a decision as to our status and Colleen will read the
decision to us.
Maile: We the Members of the Eagle Planning and Zoning Commission unanimously
agree that the high turnover in staff and the Mayor's deteriorating credibility with outside
entities and the lack of effective and efficient leadership has made it difficult to carry out
our responsibilities. However, the Planning and Zoning Commission is an independent,
bipartisan body charged with making recommendations. We do not feel comfortable
with taking a hard stand position and would like to remain and function as an
independent group. The Planning and Zoning Commission is responsible for land use
planning issues not issues of administration.
