Minutes - 1997 - Planning & Zoning - 02/18/1997 - Regular EAGLE PLANNING AND ZONING MEETING MINUTES February 18, 1997 The Eagle Planning and Zoning Commission met in regular session on February 18, 1997, Chairman Bradley presiding. The following members were present: BERT BRADLEY, DONALD BRINTON, COLLEEN MAILE, FARRIN FARNWORTH, RUSSEL MAYER. REQUEST FOR APPROVAL: A. Minutes of January 3, 1997. Moved by Brinton and Seconded by Maile to approve the minutes of the January 3, 1997 as presented. ALL AYE: MOTION CARRIED. OLD BUSINESS: A. FY 1997 Eagle Transportation Improvement Plan (TIP) recommendation: The Mayor is asking the Planning and Zoning Commission to review the 1996 TIP and develop recommendations to the City Council for the FY 1997 TIP to be submitted to the Ada Planning Association. Maile presents an overview of the items agreed upon at the last Planning and Zoning meeting. Zoning Administrator provides Commissioners with a copy of a letter from the public and Brinton reads the letter aloud. General discussion including comments on Beacon Light Road. Brinton would like to see the corner of Floating Feather and Linder Road a four way stop. Discussion of the safety concerns on the Alternate Route. General discussion. Commissioners agree that planning for the future is necessary and the majority agree that Beacon Light needs to be an arterial. General Discussion among the Commissioners as to their recommendations for TIP. Number 1: change Stierman to Edgewood. Number 2 To be deleted. Number 3: This is already funded. Number 4: Remains. Number 5: Needs to be included to keep in the program. Number 6: To be deleted. Number 7: To be deleted. Number 8: Needs to be included to keep in the program. Number 9: Needs to be included. Number 10: Add curb, gutters and sidewalks on the North side of State Street, from Dawn to Edgewood. Number 11: Add Four way stop at Linder Road and Floating Feather. Number 12: Add redesign the intersection of Ballantyne and State Street. Number 13: Add improve intersection signage on Floating Feather, Beacon Light and the Bypass. Opposes widening of Eagle Rd in front of the elementary school and opposes Floating Feather and Beacon Light Road as an arterial. Mary Gray, 4238 N. Triple Ridge PI., Eagle, Idaho - Opposes widening Eagle Road and Beacon Light Road as an arterial. General Discussion Mayer: I make a motion that we put it on (Number 9) and seconded by Farnworth. Brinton: I move that the latest list that has been prepared be put together in a memorandum to be forwarded to City Council from Planning and Zoning and seconded by Mayer. RZ-1-97 - R-5 to C-2 - Billy Ray Strite: Edge Development, represented by BRS Architects, is requesting a rezone from R-5 (residential 5 units per acre maximum) to C- 2 (general business district). The 4.4 acre site is located approximately 600 feet south of State St. at 174 S. Eagle Rd. Zoning Administrator. A, Band C needs to be continued to the February 24, 1997, meeting. Brinton: I move that we continue RZ-1-97, CU-2-97 and CU-1-97 to the February 24, 1997, meeting and seconded by Maile. All Aye - Motion Carries.... B. CU-2-97 Shopping center/commercial complex-Billy Ray Strite: Edge Development, represented by BRS Architects, is requesting conditional use approval for a shopping center/commercial complex. The 4.4 acre site is located approximately 600 feet south of State St. at 174 S. Eagle Rd. Continued to February 24, 1997, meeting. C. CU-1-97 Drive-Thru Restaurant-Billy Ray Strite: Edge Development, represented by BRS Architects, is requesting conditional use approval for a drive-thru restaurant. RZ-5-96-A to C-2 Loy Taylor: McDonald's is requesting a rezone from A (agricultural) to C-2 (general business district). The applicant is proposing to construct a McDonald's fast food restaurant with a drive-thru. The site is located at 434 S. Eagle Rd., near the northeast corner of Eagle Rd. And the Eagle Alternate Route. Bradley: I would like to combine the Public Hearings on the Rezone, Conditional Use and Design Review. Zoning Administrator introduces the issue. George Kiler, McDonald's Corporation, Portland, Ore - Speaks as to all three items. McDonald's has received approval from Design Review. The trees located on the site could not be preserved. Displays revised Landscape Plan and Site Plan. Applicant submits copies of the revised plans to the Commissioners which incorporates the recommendations from Design Review. Provides information and clarification of the Landscape Plan and Site Plan. Loy Taylor, McDonald's Corp., 5000 S.W. Meadows Rd., Lake Oswego, Ore - Correction: I did not hire Jerry Stallsmith, the City of Eagle did. Provides information about the two scotch pines, the Landscape Plan and the Site Plan. Zoning Administrator provides information and displays a revised plan that he designed. This design would be suitable and would meet the requirements for a variance. Staff recommends denial and applicant should come back with a new design. General questions and discussion between Commissioners and Zoning Administrator. Jerry Stallsmith, 5131 Camas Lane, Boise - Answers questions from the Commissioners as to preserving the trees. Zoning Administrator answers questions from the Commissioners concern trees on the site. Legal opinion as to applicant asking questions of Mr. Stallsmith. Stallsmith answers questions from Loy Taylor. Loy Taylor - Appreciates Mark's design. This type of design was discussed with the Design Review. Discusses the Plaza Area of the Site Plan. Very difficult project to design with all the different guidelines. Points out to the Commissioners the problems with the Zoning Administrator's design. George Kiler points out some of the functional problems with the Zoning Administrator's design. Don Knickrehm, 1403 Mase Road, Eagle, Idaho - Bothered by the Zoning Administrator's presentation. The Zoning Administrator's report did not address anything from Design Review. There are two parcels to be considered. Answers questions from the Commissioners. Mike Baldner, 1722 Amber, Boise, Id - Answers questions from the Commissioners as to a Development Agreement concerning the parking lot being sold to McDonald's and the number of parking spaces between the McDonald's property and the Albertson's H, \P&Z\MEETINGS\PLAN _ZON\MINUTES\1997 \PZO21 B 97. MIN 3 property. Zoning Administrator provides the Commissioners clarification and information from his Staff Report. Legal Counsel - It would be my recommendation that you consider the variance at the same time that you consider this application. If a Development Agreement becomes part of your recommendation to City Council you have to retain jurisdiction of this matter until you have reviewed the Development Agreement. Joan Lyons, 351 W. Knob Hill Ct., Eagle - I like Mark's plan because it is open. I want to see McDonald's here but I like open space. Bradley: The Public Hearing is now closed. General discussion among the Commissioners. Question for Legal Counsel on the variance. Commissioners are split on continuing the matter to be heard at the same time as the variance issue or making a decision on what is before them tonight. Two want to continue and three want a decision tonight. Brinton: I move that we have a Development Agreement for this property indicating what the uses of the property will be and seconded by Maile. General Discussion. ALL AYE: MOTION CARRIES.... Maile: I move that we continue the hearings on the three until March 3, 1997, and Seconded by Brinton. ALL AYE: MOTION CARRIES.... E. CU-12-96 Drive- Thru Restaurant - Loy Taylor: McDonald's is requesting conditional use approval for a drive-thru restaurant. DR-21-96Drive-Thru Restaurant - Loy Taylor: McDonald's is requesting design review approval for a fast food restaurant with a drive-thru. The site is located at 434 S. Eagle Rd., near the northeast corner of Eagle Rd. and the Eagle Alternate Route. Continued to March 3, 1997, meeting. B. 97 -03-CU-Cellular Pole - David Wiltsee: Western PCS and Idaho State Department of Parks and Recreation are requesting conditional use approval for the construction of a 180 foot cellular monopole to be located at 2691 Mace Rd., H, \P&Z\MEETINGS\PLAN - ZON\MINUTES\ 1997\PZO21897 .HIN 4 approximately 1f2 mile south of State Street and 1 1/4 mile east of Linder Road. Mike Fluety, Western PCS - The previous site has been withdrawn from Ada County. This site is proposed on Eagle Island State Park. He provides information on the application and answers questions from the Commissioners. Zoning Administrator provides information and clarification of his Staff Report. Staff requests approval with two conditions. Answers questions from the Commissioners. Ron Taylor, 3585 W. State, Eagle, Idaho - He was told that the application was pulled because of pressure from the Idaho State Department of Parks and Recreation and the Attorney General. He had a signed, contractual agreement with this company. He explains how the site would be on his property and on the State Park property. Explains the easement through his property. He objects to competing with the State. Mike Fleuty answers questions from Commissioners as to why they have changed sites and about the easement. Ron Taylor provides further information as to the easement. Mike Fleuty discusses the easement and answers questions from the Commissioners. Question to Legal Counsel on what recommendations the Commissioners make to Ada County. Comments from the Zoning Administrator and General Discussion. Brinton: I move that we approve Ada County Transmittal, City File 97-03-CU-Cellular Pole-David Wiltsee as approved with Staff Recommendations and the height be 150' maximum. Bradley: Hearing no second, the motion dies. Maile: I move that we deny this recommendation and seconded by Farnworth. General Discussion and further comments from Ron Taylor and Mike Fluety. Zoning Administrator: Ada County has asked that we have a basis for the recommendation and I have one I would like to read. Be based on the Comp Plan which states the proposal is not in harmony with the natural environment and scenic significance of the Boise River Flood Plan. Maile: I would modify my Motion to incorporate this language, second agrees. Discussion. AYES: TWO - NAYS: TWO: THE MOTION FAILS..... Mayer: I Move that we approve the Cellular pole under the site conditions and it be limited to 150' in height, Seconded by Brinton. Discussion. AYES: THREE, NAYS: TWO - MOTION CARRIES...... I Would like to get three ring binders for the packets and those items that are continued will remain in the binder for the next meeting. Commissioners agree to this.
