Minutes - 1996 - Planning & Zoning - 10/07/1996 - Regular EAGLE PLANNING AND ZONING MEETING MINUTES OCTOBER 7, 1996 The Eagle Planning and Zoning Commission met in regular session on October 7, 1996. Chairman BRADLEY presiding. The following members were present: BERT BRADLEY, DONALD BRINTON, RUSSEL MAYER, COLLEEN MAILE, FARRIN FARNWORTH. Moved by BRINTON and Seconded by MAILE to approve the minutes of the August 12, September 9, and September 16, 1996, meeting as corrected. Correct the spelling of Farnworth and Brinton. ALL AYE: MOTION CARRIED. PUBLIC HEARINGS: A. Annexation with Rezone and Development Agreement (A-1-96/RZ-2-96)-Ed Hendershot is requesting approval of an annexation with a rezone (with a Development Agreement) from Ada County's RT (Rural Transitional) zone to Eagle City's AR (Agricultural-Residential) zone. The 26.82 acre site is located on the south side of the north channel of the Boise River approximately 1/3 mile east of Eagle Road (State Highway 44). The site abuts the east property line of the Island Woods Subdivision. The Public Hearing is closed, we will review the Development Agreement. COMMENTS: MARK: There are a few clerical errors: Page 1-2nd P.-Item# referred to as R2-2-96 is actually RZ-2-96 Page 1-P .6- The last paragraph-Need a "with" between "it" and "two" on the second sentence Page 3-P.5-Section(b)-CC&R'S not CC&S. Preliminary Plat and Rezone for Lakeland Estates Subdivision (PP-2-96/RZ-3-96)- Ron Bath representing SDR Development, LLC., is requesting City approval of a 49 lot residential subdivision (Lakeland Estates) on 23.1 acres, with a rezone from A (Agricultural) to R-4 (Residential-four dwelling units per acre maximum). South of State Street, adjacent to the east boundary of the Monroc property, west of existing Highway 55 extended. Staff Report: Mark overview of Staff Report. Clerical errors on Staff Report: RZ3 not RZ2 Recommended Conditions of Approval on Preliminary Plat Report: Page 7 of 12-ltem #10-Top line needs to be removed and last sentence needs to be removed. Should read "Provide a total of 20-feet in width for landscaping at the west and south boundary of the subdivision to screen the adjacent industrial uses from the proposed residential properties. Discussion Continued Public hearing portion is still open on this item. No one is signed up to speak in regards to this matter. Ron Bath SDR Development, LLC. There will be a complete sidewalk on east side and no sidewalk on the west side. Revised plan and have provided a culdesac. Revised and eliminated L-portion of lake and created two more lots and an access to the extension of the Horseshoe Bend Road. Will provide a pedestrian pathway along the eastern border. ALL AYE WITH THE EXCEPTION OF MAILE NAY MOTION CARRIES Chairman Bradley excuses himself and turns the meeting over to Vice-Chairman Brinton. C. Revised Preliminary Plat for Echo Creek Subdivision #5, 6 & 7 (PP-3-96)-William Guhrke with Treasure Valley Village, LTD., is requesting City approval of a 154 lot residential subdivision (Echo Creek) on 50.40 acres in a R-5 Zone (Residential-five dwelling units per acre maximum). The site is located at the Northwest corner of Floating Feather Road and the new alignment of Highway 55. Staff report from Mark: Staff is recommending that this item be continued until the regular Planning & Zoning on October 21, 1996. Applicant is in attendance Discussion Moved by MAILE to continue the Revised Preliminary Plat for Echo Creek Subdivision #5, 6 & 7 PP-3-96 until the next scheduled Planning and Zoning meeting on Oct. 21, 1996, and Seconded by Farnworth. Hidden Springs is a planned 915-unit rural community development with a small town center (a general store, a school, a fire and sheriff facility and recreation facilities). The 1 ,724-acre site is located in the Dry Creek Valley approximately two miles east of State Highway 55 near the intersection of Dry Creek Road and Seamans Gulch Road. A detailed project summary is on file at Eagle City Hall. SINESS: Staff report from Mark: Overview of Staff Report. Bill Clark 479 Main Street Boise, Idaho Project first proposed two years ago. Ada County has now passed an Ordinance on Planned Communities. Intent is to maintain character of Dry Creek. Will have small commercial component, playing fields and fire station. Dedicating a school site. Project includes a trail system and greenbelt on Dry Creek. Like to work with the City of Eagle on the Dry Creek greenbelt. Bike and pedestrian path is part of the project design. Further discussion on the project. Comments and discussion between the Commissioners and Bill <tlark. BRINTON: What is the procedure now. MARK BUTLER: I have written a staff report with recommendations. Commission can forward these recommendations to the City Councilor you can add to my recommendations or delete my recommendations. What we are trying to do here is not to place requirements on the subdivision, I don't believe we have that authority but to provide Ada County with some recommendations. Whatever you take on this item, I will write a memo on the Commission's recommendations to present to the City Council. Discussion between Commissioners and Mark. Jeffrey L. Patlovich Ada County Development Services Director We have been working for a year redrafting our subdivisl ndiizoning ordinance. MARK BUTLER: Requests deletion of #4 & #5 of his recommendations in light of the fact that he has new information from Ada County. He believes those recommendations are inappropriate at this time. Further discussion on the project between Commissioners and Bill Clark. BRINTON: It might be well to revise #1 to make it a multiple use path. Along Dry Creek from Highway 55. MARK BUTLER: Modify condition #1 to state "construction a bike and pedestrian path and an equestrian pathway separated from the roadway for the portion of Dry Creek within this project site". Further discussion between the Commissioners and Bill Clark on the pathways and trails. Discussion between Commissioners BRINTON: Recommendation that they work with the Eagle Pathway Committee. Moved by MAYER to send a positive recommendation to City Council and to put in the Staff Recommendations which includes #1, #2 and #3 and include Eagle Pathway Committee's intent so that the trails can continue on into the foothills and Seconded by FARNWORTH.
