EAGLE PLANNING AND ZONING MEETING MINUTES

1996. Chairman BRADLEY presiding.
SEPTEMBER 9,1996
The following members were present, BERT BRADLEY, DONALD BRINTON, COLLEEN
MAILE, FARRIN FARNWORTH. MAYER IS ABSENT.
REQUEST FOR APPROVAL:
A. Minutes of July 22, 1996. Maile - Corrections: Check the spelling of Ditz
and Ron Marshall's name has 2 L's. Ron Marshall's testimony - to should be too. Check
Joe Schreiber's address.
Farnworth - Corrections: Last page, Joe Schreiber's testimony - should say "to move
on it".
B. Minutes of August 5, 1996. Maile - Corrections: P. 5 Guho does not need
to be caps.
Moved by FARNWORTH and Seconded by MAILE to approve the minutes of the JULY
22 & AUGUST 5, 1996, meetings as corrected. ALL AYE: MOTION CARRIED.
PUBLIC HEARINGS:
Chairman BRADLEY inquired if there was to be a Public Hearing on Hendershot.
MARK: Hendershot misunderstood the posting requirements on the property and he did
not get the sign up in time. He needs to have the sign up 10 days prior to the public
hearing. He has the sign up now. Recommends that the Public Hearing is postponed until
the meeting on the 16th.
LEGAL COUNSEL recommends that the hearing be continued. Would not have to be
republished in the newspaper.
QUESTION: FARNWORTH - If we continue it do we discuss this tonight.
Legal Counsel recommends to not discuss tonight since applicant is not present.
QUESTION: MAILE - Mark, that gentlemen that came in was he here to testify on
Hendershot?
MARK: Yes he was, I told him that we had not gotten to it and that I was going to
recommend that it be continued to September 16, the n ihg. He was fine with this.

rather than canceling this that would affect us in the future down the road?
LEGAL COUNSEL - Yes I think you. I think you are setting up a policy that would allow
you to then to require that the notice be posted on the property at the same time not
require the applicant to go thru process of newspaper publication or vice a versa, if they
missed either way by going thru the process twice. Discussed this policy with Mark and
decided that this was not a bad policy. Will not cause problems down the road as long as
there is the opportunity to give testimony.
BRINTON: The other thing that concerns me in this particular case is the precedence that
we might be setting in that the application is not complete. Technically we should not be
receiving anything that is not complete. According to staff there is some holes in the
application.
LEGAL COUNSEL: Zoning administrators call as to whether application is complete.
MARK: City Code allows on posting in newspaper, that if you have made an attempt of the
posting requirement that you can move forward. People need to be notified but applicant
made an attempt.
MARK: Reviewing application, a couple of things appeared to be missing. Applicant said
he submitted items. Mark explained that with turn over in staff he gave the applicant the
benefit of the doubt.
DISCUSSION ON THE MOTION AS MADE. MOTION NOT AMENDED.
FARNWORTH: Did applicant know he was to post on the property?
MARK: Yes he did. Information was with the application on posting requirements.
He got confused and thought the seven days applied and he put up the sign for the seven
days. City sent notice to the newspaper and they misplaced the notice and it did not get
published.
Motion to continue until week of September 16, Moved and Seconded, called for question.

Council has asked that once you sign them they are given to the Council for their
signatures.

A. FUTURE USE OF A "CONSENT AGENDA" BY THE PLANNING & ZONING
COMMISSION.
Items that do not take additional comments can be approved all at once with one motion.
Would commission like items on a Consent Agenda? Mark is hoping to give reports that
are more complete. Some items are so minor that they could be placed on a Consent
Agenda. If the Commission sees something on the Consent Agenda that they want
removed they can do so. What are the Commissions thoughts on this.
FARNWORTH: Are you doing this for the Council? Mark, yes. If there were questions we
could pull that item out and place them on the agenda to be discussed?
MARK: Yes. This would save time and still serve the public.
BRADLEY are there any objections? No objections as long as items can be removed from
the agenda.
B. BRIEFING ON CITY COUNCIL ACTION WITH REGARD TO THE "DESIGN
REVIEW ORDINANCE".
Monument signs for single business boost from 6' to 8',
Struck the word co-op.
Prohibited product advertising signs.
Lengthy discussion on the meaning of product advertising signs and sign illumination.
Legal Counsel feels that this issue will need to be address at a future time.
Discussion on State Street parking.
Discussion on forming a committee to review the Design Review Ordinance.
MAILE: What is the status of the Evan's sign?

OCESSING "DEVELOPMENT APPLICATIONS" WHICH
E DESIGN REVIEW MORATORIUM.
MARK: 15 items on a list of people who are ready to move forward.
Recommending to Council that a consultant be put on to draft new staff reports and
formats. Mark would like to provide more information, staff findings and recommendations.
Need consultant as Mark does not have time with everything else.
Consultant is highly recommended by Garden City and Boise. Her name is Carla Olsen.
She will specifically working on the staff reports and the Design Review Applications with
Mark's review. Will be submitted by Mark.
Provided Commission with documents for time lines on application processing.
Positive comments from Commissioners.
Working on standardized application forms. Design Review Application is ready.
BRINTON: Anything else from City Council meeting that they need to be briefed on.

Fuerte de la Aguila Subdivision. Mark and the Engineer recommended that
the preliminary plat be approved. Preliminary plat was approved..
2.
Budget considerations that affect planning and zoning.
Money budgeted for a transcribed to take and transcribe minutes of
meetings.
3.
Strategic Annual Goals: Some of these items will affect planning and zoning.
Discussion on these Goals.
FARNWORTH: Are we getting a further report on Hendershot. Will we be getting a copy
of the application like we have in the past?
MARK: Yes.
MARK: May not be able to get packets in the mail. It will probably be Friday before packets
are ready and he will call and/or the packets will be delivered.
BRADLEY: Whenever there is a month that has 5 Mo
there would be a joint session meeting on that Monday.

TOM,; u C like to begin the process of establishing a committee
to take a closer look at the signs. Particularly the illumination.
DISCUSSION: Bradley's personal feelings is yes.
Maile: Let it sit and see how it works for awhile.

BRINTON: Discuss committee issues with City Council at next meeting and if they are in
agreement that we have a look at this with professionals then at our meeting on Monday,
if that is desired, then we can come back and say that we are going to establish this and
we could look for individuals to serve on the committee.
Mark can bring up in Zoning Administrators report. Will report back at meeting on the 16th.
MARK: Has had several complaints about traffic along floating feather in front of the
school. Traffic is fast. Mark wrote a letter ACHD. Mile per hour signs vary along this
area.
FARNWORTH: Annexation and picking up extra impact area. This needs to be discussed.
Ask Legal Counsel for advice on this. Expand city area and impact area.
MAILE: This would be good for the joint meeting on the 5th Monday of month.
