Minutes - 1996 - Planning & Zoning - 08/05/1996 - Regular EAGLE PLANNING AND ZONING MEETING MINUTES August 5,1996 The Eagle Planning and Zoning Commission met in regular session on August 5, 1996. Chairman BRINTON presiding. The following members were present:, DONALD BRINTON, RUSSEL MAYER, COLLEEN MAILE, FARRIN FARNWORTH. ABSENT: Bert Bradley Moved by FARNWORTH and Seconded by MAILE to approve the minutes of the July 15, 1996, meeting as corrected. ALL AYE: MOTION CARRIED. Moved by Mayer and Seconded by Maile to move the Ada County Transmittals to before the Public Hearing. ALL AYE: MOTION CARRIED UNFINISHED BUSINESS: Findings of Fact and Conclusions of Law: Fuerte de la Aguila Moved by MAILE and Seconded by MAYER to accept the Findings and Facts and Conclusions of Law in the matter of the Fuerte de la Aguila. ALL AYE: MOTION CARRIED Unfinished Business A. Ada County Transmittal:96-15-PR, Application for Private Road. Staff recommended approval of this transmittal. No one was present to speak on this transmittal. MAILE questioned the Ada County requirements of a 45' radius culdesac at the end of a private road and if this applicant will have to meet this condition. Staff advised that this item has been taken care of and will be required. Moved by FARNWORTH and Seconded by MAILE to approve Ada County Transmittal 96-15-PR, Application for Private Road, Kathy A. Ellensohn, extending a private road and additional 100 ft. at 4648 Old Valley Road, Eagle, Idaho, and will allow access to a 7.08 acre single dwelling lot. ALL AYE: MOTION CARRIED B. Ada County Transmittal: 96-61-CU Eagle Sewer District Staff: This item is not with in the City of Eagle or the City of Eagle Impact Area and is out the official purview for official comments and requirements if there is any, however since this effects the sewer service for the City of Eagle, staff felt it important to give a recommendation of approval to Ada County unofficially. Ada County did send the transmittal to the City of Eagle for the review and recommendations. Brinton would like it noted that at the end of five years they will have to vacate these basins and their existing H:\WP\MINUTES\PZO80596.MIN 1 basins. With no plan at this time for another area. Moved by MAILE and Seconded by MAYER to approve Ada County Transmittal 96-61- CU Eagle Sewer.District , Conditional Use Application for two High Rate Land Application ponds for treating disinfected effluent water. Property contains 30 acres located west and adjacent to Palmer Lane, Eagle Idaho. ALL AYE: MOTION CARRIED PUBLIC HEARING: Chairman BRINTON announced it is the time and the place for the continuation of a Public Hearing regarding the application by the City of Eagle for Amendments to Title 6-Parks Committee, Title 7 -Sign Regulations, and Title 8-2-A Design Review Codes, and the Design Review Guideline Manual. ApplicantCity of Eagle Proposal: Amendments to Title 6-Parks Committee, Title 7-Sign Regulations, and Title 8A Design Review Codes. Design Review Guideline Booklet. Location: City of Eagle Staff Report: Mark Butler. Overview of the staff report (included in the record). Staff recommends that pages 22 through 23 including the graphics in the Design Review Guideline Booklet should be adopted with the amendments to Title 8-2-A. But the Design Review Guideline Booklet should not be approved at this time. The Staff recommended to not adopt the Downtown Development Plan but to accept it as a report available to the City as an informational document. Testimony: Larry Sale Ada County Highway District General comments. Significant concerns regarding certain aspects of Downtown Plan. Modification of street sections on Eagle Road and Eagle Road State Street intersections. After construction of alternate route State Street will still carry significant volumes of traffic, About the same as right now. Types of traffic will be different. Eagle Road is the only road in the County that extenteds from the North to South part of the County. Important to the County that Eagle Road carries some significant amount of cross county traffic. Requests that the City makes sure of its intent for Eagle Road and State Street. County raises serious objection to pedestrian roads at the corner of this intersection. Where possible the District will take the City's Design Review guidelines into consideration but they do have to protect public safety before they do that. Specific comments begin on Page 2 of the July 22nd Draft of the Ordinance. District has marked suggested changes. Changes and suggestions on Pages 6, 13, 15, 16, 20, and H:\WP\MlNUTES\PZO80596.MIN 2 21. Explained drainage system in Eagle. Three lane road to Floating Feather with Restricted parking from Floating Feather to State Street. Further comments on parking, sidewalks and roadways. State will reconstruct Eagle Road with five lanes from Fairview to the alternate route. Bill Ditz 673 W. Fordham Eagle, Idaho Dealing with July 22nd Draft of Ordinance. Page 7, Section B, No.2. The materials used in signs should not be limited to wood material and should include products that are now on the market that have a longer life. Does Albertson's sign conform to new sign standards? Mark Butler responds: Approved prior to Moratorium, previous ordinance would apply. Page 9, Section H, Master Sign Plan. The City should not be able to make a tenant remove the sign until there was a change in the business, not in ownership. Page 20 of Draft. Lot Coverage by the Structure. There needs to be a definition of one or two story buildings. The City needs to understand the required lot coverage in the proposed ordinance and the impact on parking. It should be closer to 20 to 25% instead of 40%. The City should give serious consideration to changing to 20 or 25% in all the proposed areas. Ron Marshall 380 E. State Eagle, Idaho There should be a line drawn between the Downtown Development Plan and Design Review. There are a lot of differences between the two plans. Ron is basically in favor or the Design Review Ordinance but also feels that the sign issue at this time is totally out of hand. The intent of the old Design Review Committee was only to review the downtown area, not the whole City of Eagle, and that it should just be in the downtown area. Sean Nord 5890 E. State Eagle, Idaho Ordinance of July 22, Page 7-8, No.4, Signage. The City should change the word "facade" to "face" of the building, in the past the facade was the gable. The percentage of 15% should be looked at differently if the face of the building is the whole area of the building. Mary Gray 4238 N. She also was concerned on how they would be combined. Don Belts Landscape Architect Jensen-Belts The Committee would like the Planning & Zoning Commission to accept and implement their report, with the changes recommended by the public. Larry Sale has a meeting with ACHD staff, on the proposal of the cross sections and if they are the same as ACHD's proposed cross sections. The only thing they feel in conflict is the intersection at Eagle Road. Referred to Bill Dietz's drawing of a lot with a building in the middle of the lot. The building should be at the front of the lot with parking behind the building even if there is a change in percentages of the building coverage of a lot. There is no access to the parking areas on Eagle Road or State Street but it is perfectly alright for example to have access of First Street, Second Street or Idaho Street to allow for parking and shared parking. FARRIN'S concerns are for the middle building, how would it be accessed without using the access from the outer business. Pauline Hinman 404 Ranch Drive Eagle Idaho Pauline asked the Committee to please pay attention to the reports and study them. The Chamber is already having problems. Please do not make the business in Eagle change their signs. The City is making it difficult to bring business into Eagle because of the Design Review Ordinance. Business are suffering from the construction on Eagle Road. She has had to repair her car window three times since the start of construction. Joe Schreiber 726 N. Nicklaus Lane Eagle, Idaho He would hate to see the Downtown Development Plan go into a black hole. Unless this report is reviewed and passed onto the City Council the Committee will feel betrayed. Eagle Road Eagle Idaho She is concerned about putting to many restrictions on business. Not many business that can fit into the style of the downtown. May see a deterioration of the existing business. Nicer business will locate outside of the downtown core area where there are not as many restrictions. Nancy Merrill 1275 E. State Eagle Idaho The Commission needs to be aware of the concerns of the public and the two plans (Downtown Development Plan and the Design Review Ordinance). Mom and Pop business are already giving away to the larger franchises. 1996 business in Eagle at this time are conforming to non -interior illumination. 13 business have interior lit signage. 5 of those have come in the last 5 years. Ted Nelson 11810 Lake Hazel Mainly like to speak on signage. Been involved in the Guho fiasco, his office is in the back of the Guho development. Because of confusion he does not have a sign yet. Refer to Section D, Item 2 on Page 7-8. Signs should be made of wood material. What does this mean? Ordinance is not specific. Sign hanging underneath building is important to him together with a large sign out in front. Give the business a break. Chairman Brinton will not close the hearing and will allow for public comments. Will be going through Ordinance page by page. Will be using the new version, copies are available for the public. Five minute break. Chairman Brinton reconvened meeting. Go through new copy of Ordinance, page by page. General comments and discussion on new copy of Ordinance. Clarification of entryways and common areas of subdivisions should be spelled out. Look at proposed wording. Zoning Administrator needs to track items that need to be changed in other parts of Code. Make a list so as they are tracked they can be corrected. Definitions - Lacking definitions in code for mall and strip mall, these need to be corrected. Page 4 of 35 - Comment regarding Site Design. Make sure there is pedestrian access from residential housing into commercial areas. Existing Code calls for a barrier or wall. Make a note. Page 8 of 35, Paragraph b. Note: Uses must meet the requirements as outlined in Section 8-2-3 of the Eagle City Code. Page 8 of 35, Paragraph g. Misspelled words. "Shall" and "Vertical". Page 8 of 35, Paragraph h. Add "facing a street" after Building entries. Page 10 of 35, Paragraph b. Public Gathering Place. Misspelled words "a" should be "as" and "State Street". Take out the mandatory language.
