The Eagle Planning and Zoning Commission met in regular session on July 15, 1996
The following members were present: BERT BRADLEY, DONALD BRINTON, RUSSEL
MAYER, COLLEEN MAILE, FARRIN FARNWORTH
Moved by BRINTON, seconded by MAILE to approve the minutes of the July 1, 1996, meeting
as presented. ALL AYE: MOTION CARRIED
UNFINISHED BUSINESS:
Findings of Fact and Conclusion of Law Eagle Hills and Eagle Elementary CUP:
Moved by BRINTON seconded by MAILE to approve the findings as presented. ALL AYE:
MOTION CARRIED...
Findings of Fact and Conclusion of Law YMCA CUP:
Moved by Brinton seconded by Maile to approve the findings as presented. ALL AYE:
MOTION CARRIED
PUD Ordinance update by committee:
Farnworth and Brinton recommend making changes to the comp plan, the ordinance does cover
both zones allowed in a PUD. John Mcfadden stated that the ordinance covers all the zones but
that the PUD can limit the allowed uses, example It would allow for 10% commercial
development in a residential zone under the proposed ordinance.
Moved by FARNWORTH seconded by BRINTON to approve Ordinance 269 as presented.
AYE: BRINTON, FARNWORTH,MAYER....ABSTAIN: MAILE. MOTION CARRIED...
NEW BUSINESS:
PUBLIC HEARING: Fuerte de la Aguila Subdivision
Chairman BRADLEY announced it is the time and the place for a Public Hearing regarding the
application for a 3 lot subdivision Fuerte de la Aguila (Fort of the Eagle)
Applicant: Larue Bevington
Proposal: Preliminary and Final Plat of a 3 lot subdivision
Location: Corner of Palmetto and Eagle Road
Larue Bevington spoke to the Commissioners regarding the project. He stated that at this time
two of the proposed lots are connected to Sewer. The lot next to State Street does not have
Sewer. The existing home is on a private well, and the existing Vet Clinic is on City Water. Fire
Hydrants exist at the edge of the parking lot. The applicant is proposing to dedicate 18 ft. of right
of way along the existing east right-of-wav 1ine ofP<11metto Street to the Highway District.
Testimony: No public testimony
The Public Hearing Closed at 8:10 p.m.
Moved by FARNWORTH seconded by MAILE to approve the application subject to standard
conditions and that the City will be indeminified from any liability for sewer service. ALL AYE..
MOTION CARRIED...
Ada County Transmittals
A. ACT 96-28-PDR/96-24-ZC Ripcord Ranch/Stan Ray a 3 lot planned residnetial
development and a zone change from RT (Rural Transition) to Rl (Estate Residential). The
property contains 7.6 acres and is located just south of the southwest corner ofN. Park Lane and
W. Beacon Light Road.
Moved by MAILE seconded by BRINTON to recommend approval of ACT96-28-PDR/96-24-
ZC Ripcord Ranch/Stan Ray with the clarification that the zoning designation which exists in Ada
County is not compatible with the Eagle Comprehensive Plan, but the subdivision is compatible.
ALL AYE: Motion Carried.
B. Ada County Transmittal 96-28-08 Planned Community District Articles
The Commission questioned if the city could or could not annex this development. Moved by
F ARNWOR TH seconded by MAYER to approve Ada County Transmittal 96-28-08 Proposed
Ada County Zoning Ordinance Amendment with clarification of the last paragraph which is
cunfusing and unclear ALL AYE ... MOTION CARRIED
C. Ada County Transmittal 96-44-CU Construction of a 1350 square foot accessory
building(barn). Located on Rooster Drive.
Colleen Maile concerned about the use of barn. Moved by FARNSWORTH seconded by
MAYER. AYE: MAYER, FARNWORTH, BRINTON NAY: MAILE MOTION
CARRIED
D. Aday County Transmittal 96-44-PDR/96-23-ZC Lamm Estates Subdivision
A two lot subdivision, Zone change from RT to Rl and a Private Road. Located on North Park
Lane. Moved by BRINTON seconded by FARNWORTH ALL AYE.... MOTION CARRIED.
E. Ada County Transmittal 96-41-CU Construction of a 1500 square foot accessory building
(barn). Located on North Meridian Road. Moved by MAYER seconded by BRINTON to
approve the barn if it not used for a commercial venture. AYE: MAYER, BRINTON,
FARNWORTH: NAY: MAILE MOTION CARRIED..
