EAGLE PLANNING AND ZONING MEETING MINUTES
June 17, 1996
The Eagle Planning and Zoning Commission met in regular session on June 17, 1996
Chairman BRADLEY presiding.
The following members were present: BERT BRADLEY, DONALD BRINTON, RUSSEL
MAYER, FARRIN FARNWORTH. Absent: COLLEEN MAILE
Moved by FARNWORTH and seconded by BRINTON to approve the minutes of the
June 3, 1996, meeting with the following correction: page 2, the last paragraph should
read "they hope to exchange land north of the bypass". ALL AYE: MOTION CARRIED.
Moved by BRINTON and seconded FARNWORTH to amend the agenda to move the
presentation from the representative of the Eagle Island State Park to be heard at this
time. ALL AYE: MOTION CARRIED.
Pete Ostwinkle, the representative spoke about the general development plan. When it
is finalized they will have public hearings on the final plan. They are checking compost
areas and outdoor facilities rather than central sewer. In order to service the area with
sewer they would have to cross the Boise River which would be very expensive. There is
a proposal to extend the park, but it would require crossing the river. They would need
more funds to do that. The proposal includes a road off of State St. back through the park.
PUBLIC HEARING/amendment to Ordinance 275-Eagle Impact Area
Chairman BRADLEY announced it is the time and the place for a public hearing regarding
the joint application from the County and the City regarding the Eagle Impact Area and an
amendment to the code prohibiting annexation in the amended area.
Testimony: none
The public hearing closed at 8: 1 0 p.m.
Moved by BRINTON and seconded by MAYER to accept ord 275, an Ordinance amending
the Eagle Impact Area and prohibiting said area to be annexed into the City of Eagle, as
presented. Noting the ordinance number is #275. ALL AYE: MOTION CARRIED.
PUBLIC HEARING/Amendment to Ordinance 269 - PUD
Chairman BRADLEY announced it is the time and the place for a public hearing regarding
the application on an amendment to the Planned Unit Development Code.

The public hearing remained open.
There was no public testimony
Moved by BRINTON and seconded by MAYER continue this hearing to committee to
study the commercial aspect. AYE: MOTION CARRIED.
BRINTON and FARNWORTH volunteered to be the Committee members.
PUBLIC HEARING/Lexington Hills Elementary School - CUP
Chairman BRADLEY announced it is the time and the place for a public hearing regarding
the application and will recuse himself from discussion. BRINTON will act as Chairman.
Applicant: Meridian School District #2
proposal: An elementary school within the Lexington Hills Subdivision
Location: Near the northwest corner of Floating Feather and Seven Oaks in Lexington
Hills, Lot 32, Block 7, Lexington Hills #5.
Wayne Thowless, project architect and representative of the school district for the design
for the project stated that the roof would be: asphalt shingle, the building would be clay
brick, brown in color. ACHD does not have a problem with the traffic circulations. The
entire perimeter of the site will be fenced with a 6 ft. Cedar fence.
Jim Carberry spoke told the Commissioners that there would be 26 classrooms, about 30
faculty members and with other employees approximately 55-60 employees at the school..
This school will open in the Fall of 1997.

Keith Fleming: too close to residents on the east side.
The public hearing closed at 9:20 p.m.
Moved by MAYER and seconded by FARNWORTH to approve the CUP for a elementary
school in Lexington Hills Subdivision subject to the conditions that they meet the
conditions of the Lexington CC&R's on fencing around the school and require adequate
sewer permits from the sewer district. AYE: BRINTON, MAYER, FARNWORTH.
ABSTAIN: BRADLEY.
NEW BUSINESS:
Ada County Transmittal - BUCKWHEAT ACRES- 96-22-PDR/96-07 -PR: An 8 acre
subdivision with a private road.

Chuck Palmer, developer, spoke regarding the project.
Moved by BRINTON and seconded by MAYER to recommend approval with the condition
that a common irrigation system be supplied to each lot, the staff recommendations, they
meet the requirements of private streets, and they have a homeowners association to
maintain the irrigation. ALL AYE: MOTION CARRIED.
Ada County transmittal-Royal Von Puckett-96-21-ZC. 4.99 acres in an RT zone. This is
a rezone to R1 in order to permit a family member establish a residence on the property.
Caroline Von Puckett spoke regarding the project.
Angie Stiles would live in the house thats listed in the application. She spoke about the
property and why it should be split for the benefit of family.
Moved by BRINTON and seconded by MAYER to deny the application based on fact it
does not meet the Comprehensive Plan but note that the Commission is sympathetic to the
applicant and ask Ada County to consider other methods of approval. ALL AYE: MOTION
CARRIED.
