Minutes - 1996 - Planning & Zoning - 02/26/1996 - Regular EAGLE PLANNING AND ZONING MEETING MINUTES February 26, 1996 The Eagle Planning and Zoning Commission met in regular session on February 26, 1996. Chairman BRADLEY presiding. The following members were present: BERT BRADLEY, RUSSEL MAYER, COLLEEN MAILE, FARRIN FARNWORTH. DONALD BRINTON, Moved by BRINTON and seconded by MAYER to approve the minutes of the February 5, 1996 meeting with the following corrections: to strike "left turn lane and would not accelerate traffic" on page 3,line 5, as the intent is not clear, and on page 5, Ada County Transmittal McKee: should read Bradley as Nay, and on the public hearing on the Meridian School District should read Nay for Farnworth. ALL AYE: MOTION CARRIED. UNFINISHED BUSINESS: Findings of Fact and Conclusions of Law/Meridian School Academy CUP: Moved by BRINTON and seconded by MAILE to approve the findings as presented. AYE: BRINTON, MAILE, BRADLEY, MAYER. NAY: FARNWORTH. MOTION CARRIED. Findings of Fact and Conclusions of Law/Eagle Fire Station #2 CUP: Moved by BRINTON and seconded by MAYER to approve the findings as presented. ALL AYE: MOTION CARRIED. NEW BUSINESS: APA - 2015 PLAN: Presentation of the plan was given by Ali Bonaktar of the Ada Planning Association. PUBLIC HEARING/OXFORD COURT SUBDIVISION/REZONE: Chairman BRADLEY announced that he has a conflict of interest and will not be participating in this public hearing. Vice Chairman BRINTON will conduct the hearing. Vice Chairman BRINTON announced it is the time and the place for a public hearing regarding the application for the Oxford Court Subdivision Preliminary plat and Rezone. Applicant: Max Boesiger, Inc. Proposal: Rezone from A to R4 for 22.89 acres with 52 single family lots for a gross density of 2.27 lots per acre. Location: Near the corner of Floating Feather Road and Edgewood Road, Eagle, Idaho. North of Floating Feather Road, north of Farmers Union Canal, on the west boundary of Lexington Hills Subdivision Phase 1 & 4. 1 Richard Boesiger, developer of the project, asked for a deferral of the hearing until March 18 in order to have time to annex the property into the Sewer District. After discussion, the Commission decided to take public testimony and continue the testimony until the next P&Z hearing date. Richard Boesiger outlined the proposal and indicated that chain link fencing would be established along the canal, with a 25 ft. wide pathway. The roads link from the Lexington Hills Subdivision. There is no entrance from Floating Feather Rd. A letter received from the Eagle Sewer District indicates this parcel is not annexed into the district, and is tabled at this time. Concerns of the public: Traffic through Lexington, construction trucks on residential streets, not harmonious, questions regarding the pond location within 500' of a well site in Lexington, dogs in Lexington as a result of construction workers, covenants that are 2 different than Lexington's, property values, not compatible with existing developments, lack of usable open space I needs a traffic analysis. Moved by MAILE and seconded by MAYER to hold the testimony given here tonight and have it submitted at the appropriately noticed meeting to be noticed at a future date. ALL AYE: MOTION CARRIED. Drainage Discussion: Chairman BRADLEY suggested that perhaps it would be beneficial to require the developer to post a 2 year bond for drainage within a subdivision. The City Attorney discussed the ramifications of the upcoming legislation giving the drainage issue jurisdiction to ACHD.
