EAGLE PLANNING AND ZONING MEETING MINUTES
January 22, 1996
The Eagle Planning and Zoning Commission met in regular session on January 22, 1996.
Chairman BRADLEY presiding.
The following members were present: BERT BRADLEY, DONALD BRINTON, RUSSEL
MAYER, FARRIN FARNWORTH. Absent: COLLEEN MAILE
Moved by MAYER and seconded by FARNWORTH to change the order of the public
hearings as follows:

Moved by BRI NTON and seconded by FARNWORTH to approve the minutes of the
December 18, 1995, meeting as presented. ALL AYE: MOTION CARRIED.
PUBLIC HEARINGjMeridian School Academy - CUP:
Chairman BRADLEY announced it is the time and the place for a public hearing regarding
the application for a CUP for a school academy.
Applicant: Meridian School District
Location: E. State St. (Now known as the Bass property)
Existing C I, 8.9 acres. The back portion is proposed for an Alternative School for up to
150 high school age students utilizing portable classrooms. The traffic generated would be
approximately 250 trips per day. The project is accessed by a private driveway.

Representative: Jim Carberry outlined the project. There will be no bus parking on site as
the first application called for. The driveway has been moved from the east side of the
property to the west.
Marilyn Reynolds, principal of the Meridian Academy, testified that the premises in Meridian
is kept very clean and has no problems with vandalism or clutter. The environment is
much more strict than a normal schoo\.

Jim Carberry: Rebuttal - Currently I (3 of the students are from Eagle. These are portables
but eventually they wil be replaced with permanent structures. Right now there is no
money for them. There is no emergency access in this location.
Marilyn Reynolds said the school has 4 portables not in use at this time, that is why they are
affordable.
Darryl Leatham: Architect for the project addressed the portable structures. The buildings
will be on piers not foundations, and are not as big as a permanent structure. He
addressed landscaping and indicated there would be no landscaping on the north side,
approximately I acre.
Note: There are no day care facilities in this application. This application must go through
design review and landscaping. The driveway is a private road. If any part of this property
is to be sold it will need to go through the subdivision process. It has received the one
time split allowed.

The concerns of the public were: The traffic, not a C I neighborhood use, sewer and water
issues, not appropriate for what may be the downtown core area, should be reserved for
business and retail, not harmonious and changes the character of the existing
neighborhood, not in compliance with the comprehensive plan, needs a traffic analysis,
ditch concerns.
Moved by BRINTON and seconded by MAYER to leave the public hearing open to enable
the Commission to receive a traffic analysis and receive input from the building inspector
regarding the Uniform Building Code (UBC). ALL AYE: MOTION CARRIED.
PUBLIC HEARING/Ordinance #273 - Private Streets:
Chairman BRADLEY announced it is the time and the place for a public hearing regarding
the application for an ordinance amendment to consider private streets in the City of Eagle
Applicant: Dennis Baker
Steve Bradbury, attorney, addressed the ordinance for the commission. This ordinance
enables private streets under circumstances the city deems appropriate. This ordinance
leaves it to the city's discretion on its needs.
The ordinance needs a definition of a private street, reference to Idaho Code for design
of highways, roads, streets and highways, a mechanism for building to specific standards.
It needs an explanation as to who is designing and building it and a maintenance schedule.
The ordinance should call for an independent inspection by an independent firm paid for
by the developer for certification of street design as it is built. The City Attorney noted that
Eagle Code, Sections 9-3-2 and 9-4-1 and subsections are not intended to be applicable
to private streets.

open until the next regularly scheduled meeting when Mr. Bradbury can submit the final

PUBLIC HEARING/ORDINANCE 269 - Amending Title 8 - Planned Unit Developments
(continued) :
Chairman BRADLEY announced it is the time and the place for a public hearing regarding
the application by the City for an amendment to Title 8 regarding Planned Unit
Developments.
As a referral from the City Council, can a PUD be developed in phases in order to make
it and the subdivision code consistent? The PUD code, as it is now, leaves out the ability
to phase. The code mandates that the project commence and be completed in a year.
If there is going to be a phase, each unit or combination of the approved portion needs
to meet the requirements of the zone.
The City Attorney addressed the sequence of time, first for plan approval, the second
sequence from preliminary to final approval.
If it is to be a phased project each unit of the project, or prior approved portion, meet the
density requirements of the underlying zone.
The City Attorney, Mona Mack suggested the following: B5 would be a good subsection
to expand to address the concern for design, to read "be accepting from design
requirements as warranted by the design of other amentities incorporated in a final
development plan". That had the language," which is the subject of the application and such
other final development plans of the PUD which have been earlier approved" . This is an
amendment to 8-6-3.

The public hearing closed at 10:45.

meeting for final draft changes. MOTION WITHDRAWN.
Moved by MAYER and seconded by FARNWORTH to approve the Ordinance
amendment subject to the changes made by the City Attorney tonight. ALL AYE:

PUBLIC HEARING/Channel Center SubdivisionlFloodplain Development (continued):
Chairman BRADLEY announced it is the time and the place for a public hearing regarding
the application for a 9 lot commercial subdivision, and one residential lot.
Applicant: Dennis Baker
Location: North side of the North Channel Boise River along the west side of Eagle
Road, the former feed lot and packing plant.
Proposed land use and zoning: zoning to remain C I, proposed subdivision includes 10
lots, 9 intended for commercial uses and one for multi family residential use. It is
understood that each individual commercial lot, depending on what kind of commercial has
the potential to be required to go through additional approval processes, CUP, Design
Review and Landscaping, etc.
The pathway was addressed by Wayne Stollfus.

Moved by MAYER and seconded by BRI NTON to approve the Channel Center
Subdivision subject to the following:
I. standard requirements of the city
2. always be a maintained public access to access the river
3. the pathway committee approval requirement
4. landscaping committee approval requirement
5. approval of the future ordinance for private streets,and all future ordinances at the
time of approval for each individual lot.

6. approval is subject to the adoption of the private street ordinance. If said ordinance
is rejected by the City the subdivision must have public streets.
ALL AYE: MOTION CARRIED.
