EAGLE PLANNING AND ZONING MEETING MINUTES
November 6,
1995
The Eagle Planning and Zoning Commission met in regular session on
November 6, 1995. Chairman BRADLEY presiding.
The following members were present: BERT BRADLEY,
NANCY MERRILL, RUSSEL MAYER, COLLEEN MAILE.

Moved by MERRILL and seconded by MAYER to approve the minutes of
the October 16,1995, meeting as presented. ALL AYE: MOTION
CARRIED.
PUBLIC HEARING/Meridian School District #2:
Chairman BRADLEY announced this was the time and the place for a
public hearing regarding the application submitted by the Meridian
School District #2 for a Conditional Use Permit.
MERRILL abstains, her property is within 300 ft. of the applicant
property.
Applicant: Meridian School District #2
Proposal: C1. zone, a CUP for school bus parking lot 50 to 75 buses
and an academy for approx 150 high school age (alternative
learning) . Students Academy would consist of portable units
including classrooms, and an administrative facility centered in
the middle of the project, and a multipurpose classroom. There is
a lateral to the N end and may establish a park to the north.
There will be closed lunch for 9th and 10th grades and open campus
for juniors and seniors. Buses will serve the north end from Star
to Centennial as well as Eagle.
Location:_North side of State Street, between Edgewood and Palmetto, the Bass property
Jim Carberry: school representative outlined the project for the
P&Z members. Other representatives testifying were Daryl Latham,
Ron Marshall and Dean Langley.

Written Testimony - opposed: Dennis and Celia Callagher, Steven and
Becky Peterson, Otto H. Achenbach, Lori and Craig Crowley, Donald
and Nancy Barton. Along with a petition with 170 names.
The concerns of the public were: not an appropriate place, would
promote vandalism. Is this property going to be used for fuel
storage? Neighborhood businesses with less traffic and sale of
goods is more appropriate. There will be dust, air pollution,
noise, and destruction of road surface of State St. The hours of
operation adds more traffic into Eagle and traffic congestion.
There will be oil residue and spills. This sort of business should
be established in a rural area. This devalues property with
portable units and creates a hazard pulling out on State Street
with a 55 mph speed limit. This is questionable zoning which will
require more sheriff services. Not in keeping with the community
look.
Concerns of the commission: Why are the units portable? West and
north and back and part of east are chain link fencing, from State
St. back is not fenced. There appears to be no buffer between
uses. Not appropriate area for busses. Comp plan speaks to
compatible use and character of surrounding areas.
Note: Any day care must be separately applied for as a CUP.
The public hearing closed at 9:05 p.m.
Moved by BRINTON and seconded by MAILE to recommend denial of the
application for a CUP. Based on the fact that a C1 is a
neighborhood district, because of noise and aesthetics are not in
harmony, appearance and character with the district. ALL AYE:
MOTION CARRIED.
PUBLIC HEARING/Channel Center Subdivision/Floodplain
Chairman BRADLEY announced this was the time and the place for a
public hearing regarding the application submitted by Channel
Center Subdivision for a preliminary plat and floodplain permit
Moved by BRINTON and seconded by MAILE to continue the hearing
until the next meeting because of new information just received.
ALL AYE: MOTION CARRIED.
PUBLIC HEARING/Falling Waters Subdivision-PUD-CUP:
Chairman BRADLEY announced this was the time and the place for a
public hearing regarding the application submitted by Falling
Waters Subdivision for a preliminary plat.
Applicant: Eagle River LLC, James Grossman
Proposal: MIA - zone 206 units and provides 40% open space, using
the natural amenities. Will buffer the bypass and provide a
greenbelt to buffer. This is in a sensitive area in the comp plan.
Studies of this area have been completed. The properties include
5 ft side set backs.

Concerns of the public: too dense for the area and the sewer may
not be available. There is no plan for water. There will be
traffic congestion with only one street. There are drainage
problems, schools, law enforcement, and fire. There are no
amenities for children.
After discussion the P&Z considered the options to be able to
following options to continue this matter:
1. photos
2. 2 places to view
3. set a time and do it together without the developer or do it
alone
4. carry the public hearing on site
The public hearing was not closed.
Moved by MAILE and seconded by MERRILL that an independent visit by
P&Z members take place and independent reports return to P&Z in a
public hearing. ALL AYE: MOTION CARRIED.
Ada County Transmittal 95-81-CU-Accessory Bldg.
Ada County Transmittal 95-83-CU Band - Accessory Bldg.
Moved by MERRILL and seconded by MAILE to approve the transmittals
as presented.
Report: Barbara Montgomery reported that it may be advisable to
hold a town meeting on the amended Design Review Ordinance and
Guidelines. The P&Z members agreed and asked the Clerk to check
dates available at the senior center and return those dates to P&Z.
The Council report by Mary Berent was continued due to the lateness
of the hour.
There being no further business the meeting adjourned at 11:45
p.m.
