Minutes - 1995 - Planning & Zoning - 09/18/1995 - Regular EAGLE PLANNING AND ZONING MEETING MINUTES September 18, 1995 The Eagle Planning and Zoning Commission met in regular session on September 18, 1995. Chairman BRADLEY presiding. The following members were present: BERT BRADLEY, NANCY MERRILL, RUSSEL MAYER, COLLEEN MAILE. DONALD BRINTON, Moved by BRINTON and seconded by MAYER to approve the minutes of the September 11, 1995 meeting with name spelling corrections for Joe Cheney, spelled Chaney, and Don Knickhram, spelled Don Knickram. ALL AYE: MOTION CARRIED. PUBLIC HEARING/EAGLE UNITED METHODIST CHURCH - CUP Chairman BRADLEY announced that was the time and place set for a public hearing regarding the Eagle United Methodist Church for a Conditional Use Permit for a portable building. Applicant: Eagle United Methodist representative for the church. Location: N. Eagle Rd. Proposal: one temporary portable bUilding for Sunday School only. The temporary use is planned for 5 years. Church, Bill Wiler, Testimony: written: Robert DeShazo in favor No adverse testimony given. The public hearing closed at 7:50 p.m. Moved by BRINTON and seconded by MERRILL to approve the CUP with the following conditions: 1.The unit to be tied down (anchored) and inspected 2.The CUP is to be reviewed in 5 years and annually thereafter ALL AYE: MOTION CARRIED. PUBLIC HEARING/GREAT SKY ESTATES - CUP SWIMMING POOL AND CLUBHOUSE Chairman BRADLEY announced that was the time and place set for a public hearing regarding the Great Sky Estates Conditional Use Permit application for a swimming pool and clubhouse on a building site within the subdivsion. Applicant: John Evans, owner Great Sky Estates Location: E. State St. Proposal: to establish a club house complex and swimming pool on a building site in the subdivision. Lot 2 West property line is fenced, the lot line between 2 and 3 will be a wood fence. ALL AYE: MOTION CARRIED. UNFINISHED BUSINESS: FINDINGS OF FACT AND CONCLUSIONS OF LAW/MERRILL CUP: Moved by BRINTON and seconded by MAILE to approve the findings as presented subject to the correct spelling of Joe Cheney. MERRILL abstained. AYE: MOTION CARRIED. PUBLIC NOTICE SIGN REQUIREMENTS: (continued discussion) Page 2, Paragraph 1: should not include an affidavit but a certified statement. Staff should inspect the premises and verify that the sign is in place. Page 2, "signs must be removed within 14 days of the City Council Meeting" should read "after" the City Council meeting. Page 2, the viewing. (2 ) 14" x 17" should be built off the ground for The City Attorney reviewed the document and outlined some suggested changes to the ordinance. The attorney will put this in ordinance form using manditory compliance with sign placement but substantial requirements with other aspects concerning the sign. The City Clerk will pull the codes in title 8 and 9 dealing with public hearing notices and segregate them into one section. Mona will have the document draft to the Commissioners within 6 weeks. LANDSCAPING PROVISIONS (discussion): After discussion BRINTON will write a letter to the City Clerk to take to Council regarding curbs, gutters, and sidewalks on Floating Feather and State St. COMPREHENSIVE PLAN (discussion): MAILE submitted the School Component of the Comprehensive Plan and asked the Commissioners to review it and bring the comments back to P&Z. Moved by MERRILL and seconded by MAILE to bring this issue back on the second meeting in October. ALL AYE: MOTION CARRIED. NEW BUSINESS: ADA COUNTY TRANSMITTALS: -- ------------- -- 95-08-Z0A -Reduced setbacks in RT Zone-Reduce the setbacks in the transitional zone, inlcuding those that are in existence. Moved by MERRILL and seconded by MAYER with the recommendation that Ada County use Eagle standards 30 ft. rear setback and 15 ft. side setback. ALL AYE: MOTION CARRIED. 95-04-Z0A -Bed & Breakfast Facilites: Will only be acceptable with a CUP permi t . Moved by BRINTON and seconded by MERRILL to recommend approval as pesented. ALL AYE: MOTION CARRIED. 95-07-Z0A - Golf Driving Ranges in M-1 Zones: Moved by MAILE and seconded by MERRILL to recommend approval of this transmittal as presented. ALL AYE: MOTION CARRIED. OLD BUSINESS: IMPACT AREA - Boundaries and Jurisdiction: Moved by MERRILL and seconded by BRINTON to discuss the impact area boundaries and jurisdiction. Also, to discuss the signage proposal, and Design Review and downtown development plan as a joint meeting with the Council. The meeting time is October 30, 1995 at 6:00 p.m. with Pizza provided by the City. ALL AYE: MOTION CARRIED. The Council report of August 22 and September 12 was given by Mary Berent.
