Minutes - 1995 - Planning & Zoning - 08/21/1995 - Regular EAGLE PLANNING AND ZONING MEETING MINUTES August 21, 1995 The Eagle Planning and zoning Commission met in regular session on August 21, 1995. Chairman BRADLEY presiding. The following members were present: BERT BRADLEY, NANCY MERRILL, RUSSEL MAYER, COLLEEN MAILE. DONALD BRINTON, Moved by BRINTON and seconded by MAILE to approve the minutes of the August 7, 1995 meeting with the following change: Page 2, conditions of approval: Annexation - Spyglass. number 2 should read Authorization and signature from the Zinger Lateral Waterways. ALL AYE: MOTION CARRIED. UNFINISHED BUSINESS: Findings of Fact and Conclusions of Law/Spyglass Subdivision - Annexation, Rezone and Preliminary Plat. Moved by MERRILL and second by MAYER to approve the findings with the same inclusion in the conditions of approval as the minutes reflect. ALL AYE: MOTION CARRIED. Burgess Pump Rezone (continued): The lack of any time frame or specific design was discussed. Moved by BRINTON and seconded by MAYER to deny the application. ALL AYE: MOTION CARRIED. Miscellaneous discussion: Downtown Development Task Force BRINTON: Ali Bonakder from APA has been helpful in the process. The committee wants to define the downtown area. There is a proposal for 3 different areas, the central or historical-inner core (walk and shop), the outer core, and extended core. MERRILL reported on her findings from DEQ on the possible pollution of the Ron Lester property (SW corner Eagle Rd. and SH44). The EPA Level One has been done and the property was found to be clean of pollution. NEW BUSINESS: Policy Regarding Public Notice Sign Requirements: The issue was addressed by BRINTON. After considerable discussion a motion was made by BRINTON and seconded by MAYER to continue the matter until the September 18 meeting. ALL AYE: MOTION CARRIED. BRINTON will condense the suggestions given by the Commissioners tonight and submit it in writing for the meeting. Those issues discussed were the following: 1. 2. This needs to be in ordinance form To require a sign (4x8, 3x---) to be posted on the property for all public hearing applications Time frame.....14 days.....8 days? Whatever the requirement two things have to be addressed: A. If it is posted in less time than the required time frame, does that mean P&Z will not hear it? If P&Z will hear it with less time the ordinance must read "required but shall not be deemed jurisdictional" B. If P&Z will not hear it the ordinance must read "required and shall be jurisdictional" Proof of posting. Affidavit? The materials used in the sign, the colors of the sign, and size of the letters The sign heading should read "PUBLIC HEARING NOTICE" The sign should be directional (2 way) and should be posted on all streets adjacent or included in this application Limitation of time when the sign is removed from the property (or what?)
