Minutes - 1995 - Planning & Zoning - 06/19/1995 - Regular EAGLE PLANNING AND ZONING MEETING MINUTES June 19, 1995 The Eagle Planning and zoning Commission met in regular session on June 19, 1995. Chairman BRADLEY presiding. The following members were present: BERT BRADLEY, NANCY MERRILL, RUSSEL MAYER, COLLEEN MAILE DONALD BRINTON, Chairman BRADLEY requested an amendment to the Agenda under UNFINISHED BUSINESS miscellaneous items, Items A. Comprehensive Plan discussion and B. Downtown Development Task Force update. He asked that these agenda items be placed on each agenda until further notice. Moved by BRINTON and seconded by MERRILL to approve the minutes of the June 5, 1995 meeting as presented. ALL AYE: MOTION CARRIED. NEW BUSINESS: Establishment of Committee Chair responsibilities: regarding sectioning the Comprehensive Plan into resulted as follows: Discussion Committees 1. Hazard/Parks, Recreation and Open Spaces, Natural Resources: Brinton Schools & Transportation/Transportation: Housing/Public Utilities: Mayer Community Design/Special Areas and Sites, Development: Merrill, Brinton Land Use/Population: Merrill, Maile Special needs and 2. 3. 4. Maile and Bradley 5. Four areas of concern were identified as the following: takings, school/transportation and floodplain. housing, The committee resumes, asked for by the Commission, were discussed. Chairman BRADLEY suggested that if any Chair wanted to use these people they were welcome to do so, but not required to do so. The Committees will report to P&Z at regularly scheduled meetings. UNFINISHED BUSINESS: Design Review Ordinance: 1. Page 36: Alternative Methods of Compliance: the form referenced to in B., should be provided wi thin this guide. It needs to be part of this package as an exhibit. Note: Mona asked the Variance Code be checked as this is a variance and is more restrictive. 1. Page 41: City Code. The drainage section needs to read that it is part of 2. Turn of the Century should been defined, and indicate the years involved. Note: the years are defined in current code 3. Page 15, #10: Portable signs were questioned as far as real estate, open house or political signs. If you do not read page 18, this is not understandable. Temporary signs should be allowed under "industry standards", and not more restrictive i.e. construction signs, etc. Note: the attorney said that there needs to be more cross referencing throughout the document both internally and externally (with the code). 4. Page 37: speaks to specific varieties of plants. Requiring specific plants is not reasonable. This list can be suggested but not required. Also, landscaping is required by code, but landscaping is not defined. Also the same requirement should be made as far a building sites definition. 5. Public rights-of-ways are not owned by the city and requirements for landscaping is questionable, legally, from the standpoint of ITD, ACHD or any ditch company. Landscaping can only occur with their permission. 6. Page 17: construction sign should be no more than 6 sq. ft. should read 32 sq. ft. 7. Subdivision entrances & common areas should be included in the design review standards. 8. Paint colors are not addressed in the document. 9. The informational document should remain a guide and not become part of the code. Right now the guide reads like code, it includes more than the code. The City legal counsel will provide the Commission a written review of the document. From a constitutional standpoint that standard is that the ordinance is readily understood by those who have ordinary intelligence. The document must be readily understood and there are some sections that could be deemed "unreasonable". The City Attorney will address her concerns in writing and get the information to P&Z prior to the next meeting. Moved by MERRILL and seconded by MAYER to continue the matter until July 10 in order to receive the attorney's report. ALL AYE: MOTION CARRIED. Findings of Facts and Conclusions of Law/Hopkins Evergreen Service - CUP and Covey Glen Floodplain/Rezone and Preliminary Plat: Moved by BRINTON and seconded by MERRILL to approve the findings as presented. ALL AYE: MOTION CARRIED. The Council report was given by Mary Berent. The Downtown Development report was given by MERRILL.
