Minutes - 1995 - Planning & Zoning - 05/01/1995 - Regular EAGLE PLANNING AND ZONING MEETING MINUTES May 1, 1995 The Eagle Planning and Zoning Commission met in regular session on May 1, 1995. Chairman BRADLEY presiding. The following members were present: BERT BRADLEY, NANCY MERRILL, RUSSEL MAYER, COLLEEN MAILE. DONALD BRINTON, Moved by BRINTON and seconded by MERRILL to approve the minutes of the April 17, 1995 meeting. ALL AYE: MOTION CARRIED. Moved by MAYER and seconded by BRINTON to move #5 "New Business", #A and #B, (Ada County Transmittals) to the first item of business. ALL AYE: MOTION CARRIED. Ada County Transmittal 95-31-CU- Hill CUP: Mike Hill, the applicant presented his proposal of a barn on 3.29 acres with a required 50 ft setback. Moved by BRINTON and seconded by MAILE to recommend approval of the application as presented. ALL AYE: MOTION CARRIED. Ada County Transmittal 95-30-CU- Gipson/Boehm CUP (Fox Tail Golf Course): Moved by BRINTON and seconded by MERRILL to continue the matter until May 15 and ask the developer to at tend. ALL AYE: MOTION CARRIED. PUBLIC HEARING/1995 Eagle Comprehensive Plan Amendments: Chairman BRADLEY announced that this was the time and place set for a public hearing on an application for amendments to the 1993 Eagle Comprehensive Plan. Mona Mack, City Attorney, outlined the proposed changes in the comprehensive plan in detail. Jerry Reininger, Meridian School District representative, was asked to speak regarding the section on schools in the Comprehensive Plan. Mr. Reininger addressed the population in the schools within Eagle and projections for Eagle. Testimony: Kathy Lusk, Jerry Reniniger, Diane Sherman, Mary Gray, Chuck Bower Diane Smi t , Phil Whitner, Eleanor Chase, Monte Marcus, GI ida Bothwell, Sally Beauchane, Mark Hardy, Sherri Randall. There was a general feeling that it is too early to make a decision that more study needs to be done and information out to the public. There is a need to be able to develop property. Written testimony (received prior to May 1): Ralph B. and Carolyn Brenner, Frank W. Stoppello, Diane Anderson, Betty Roberts, Letha Roberts. Bruce and Brenda Weaver, James & Kathleen Schuck, Craig & Shelly Draper, Jane Fulkerson, Jim & Lori MUrray, Steve & Annie Furchak, Charles Strider (picture) Ann Shelley, Jane Fulkerson, Roger Warren, Marty Taylor, Ken and Carol Kamppi, Chuck Bower and unknown. Additional written testimony received for May 1 meeting: Chuck Bower, Diane Schouman, Anne E. Shelly, Laura McCarthy, Del Dickerson, David A. Kent, Susie Dickerson, Stasia Allen Buffenbarger. Concerns of the public: lack of information given, too high a density in applications for a map revision, taxes will be higher, ground water concerns, sewer capacity, greater use of pesticides on residential property and traffic (especially in the school areas). There were concerns about the amendment procedures for the hearing in regard to the comprehensive plan, and that the document should be an implementing document. There were additional concerns about the data provided on the schools and the population quotes. There were questions regarding the schools, the size, location and placement, which are defined in other comprehensive plans. There were other concerns about the no rise analysis in the Hazard Section and any building in the floodway. There were questions about businesses in a residential district. There were comments about land use north of Floating Feather Rd. and the effect on property owners in that area. Public hearing closed at 11:20 p.m. Moved by MERRILL and seconded by MAILE to deny amendments to the map by the two (2) applicants for density changes and prolong any decisions on amendments within the remainder of the Eagle Comprehensive Plan until workshops and studies are completed that are needed. This is with an exception to the amendment regarding the floodplain maps as addressed defined as "FEMA" maps. ALL AYE: MOTION CARRIED. Moved by MAYER and seconded by MAILE to have the staff to clarify the changes to the comprehensive plan and procedures to bring back to P&Z. ALL AYE: MOTION CARRIED. DOWNTOWN PLANNING NANCY MERRILL: Suggested a j oint meeting regarding the downtown development issue. The Land Group has been commissioned to develop a revision to the existing design review ordinance, a committee headed by Joe Schrieber, and Planning and zoning. Any activity having to do with the downtown will need to go through P&Z. FINDINGS OF FACTS AND CONCLUSIONS OF LAW/Hodges Rezone-Development Agreement: Moved by BRINTON and seconded by MERRILL to approve the findings with the corrections made by the City Attorney, and the following: "requested to be rezoned to C2", on page 1, to be included in the language. ALL AYE: MOTION CARRIED. The Council report was given by Mary Berent.
