Minutes - 1995 - Planning & Zoning - 04/17/1995 - Regular EAGLE PLANNING AND ZONING MEETING MINUTES April 17, 1995 The Eagle Planning and Zoning Commission met in regular session on April 17, 1995. Chairman BRADLEY presiding. The following members were present: BERT BRADLEY, DONALD BRINTON, RUSSEL MAYER, COLLEEN MAILE. Absent: NANCY MERRILL. Moved by BRINTON and seconded by MAYER to approve the minutes of the April 3, 1995, meeting as presented. ALL AYE: MOTION CARRIED. Ada County Transmittal (continued) : 95-06-PDR/95-05/PR Stetson Estates Stan Ray, representative for the project, addressed the Commission. The lots exceed the 5 acre requirement. The plat the Commissioners are reviewing has been changed. The changes have been reviewed by Ada County and have not been viewed as "material changes". The developer will submit a corrected plat to the City of Eagle. Moved by BRINTON and seconded by MAYER to recommend the following: 1. City of Eagle standard requirements. 2. recommend a waiver of street lights and acceptance of yard lights instead. 3. Access along the canal be granted. The north lot will use the existing easement, and east of lot 5 is to provide a 10 ft. separate easement for a pathway along the canal. ALL AYE: MOTION CARRIED. BILL HODGES REZONE - DEVELOPMENT AGREEMENT - Eagle Country Plaza: ( continued) Bill Hodges appeared before the Commission and addressed the proposed rezone and Development Agreement. Moved by BRINTON and seconded by MAYER to recommend a rezone from R1 to C2 subject to a Development Agreement, the Agreement to be modified to include that a fence be built all along the N side in the back and 2/3 on the E side, and, add a section to the Agreement addressing the maximum height of the building, to be determined on or before the City Council meeting. ALL AYE: MOTION CARRIED. FINDINGS OF FACTS AND CONCLUSIONS OF LAW/BANBURY MEADOWS - PUD/SUB, ANNEX, LOT SPLIT, ZONING: There have been some additions which were submitted tonight by the City Attorney to clarify the findi~gs proposed tonight. . .--.-- ---. ._-~- ._----.-._-~ ..- .- --.n Moved by MAILE and seconded by MAYER to approve the findings with the corrections made by the City Attorney. ALL AYE: MOTION CARRIED. DEFINITION OF COMMON/OPEN SPACE: BRINTON submitted an outline for open/ common space. After considerable discussion a motion was made by BRINTON and seconded by MAILE to recommend the following: " OPEN SPACE: A common area platted as a separate lot, or an area dedicated to and accepted by the City, substantially open to the sky, exclusive of streets, canals, drainage ditches (unless they provide a distinct amenity to the development), public golf courses, buildings and other Covered structures." ALL AYE: MOTION CARRIED. The Council report was given by Mary Berent.
