EAGLE PLANNING AND ZONING MEETING MINUTES
April 3, 1995
The Eagle Planning and zoning Commission met in regular session on
April 3, 1995. Chairman BRADLEY presiding.
The following members were present: BERT BRADLEY, DONALD BRINTON,
RUSSEL MAYER, COLLEEN MAILE. Absent: NANCY MERRILL.
Moved by BRINTON and seconded by MAILE to approve the minutes of
the March 20, 1995 meeting with a correction to the spelling of Jim
Wroten on page 2. ALL AYE: MOTION CARRIED.
NEW BUSINESS:
Ada County Transmittal 95-06-PDR/95-05-PR-Stetson Estates:
Moved by BRINTON and seconded by MAYER to continue the transmittal
to the next P&Z meeting in order to give Mary time to contact the
applicant and request their attendance to answer questions. ALL
AYE: MOTION CARRIED.
UNFINISHED BUSINESS:
BANBURY MEADOWS - Annexation, zoning, PUD/preliminary plat:
Dick Phillips continued the discussion regarding lining up the
streets on Eagle Rd. with Fall Creek. Fall Creek developers
volunteered to aid in lining this up.
Moved by BRINTON and seconded by MAYER to approve the application
for Banbury Meadows as presented with the following conditions:

Standard Conditions of Approval for Subdivisions
Dedicated well lots be identified as well lots used as a
central water system or a company ownership
Restrict wood burning devices to those approved by EPA, no wood
burning fireplaces
2 accesses to the NW portion of the property to be accessed for
a natural park to the river pathway

Moved by BRINTON and seconded by MAYER to amend the motion to
include that the consent to develop the golf course first because
of the unique nature of a golf course waiving ordinance
requirements for 50% of the residential to be done prior to
commercial.

COMPREHENSIVE PLAN AMENDMENTS:

AMENDMENTS include:

application for land use designation map change - Ricks/Hazen
amendments to the comprehensive plan in the following areas:
a. hazard areas
b. school and transportation
c. addition of a service planning area and map
d. housing-low cost conventional housing and manufactured
homes

Moved by MAILE and seconded by MAYER to reopen the public hearing
with public notice outlining the amendments to the comprehensive
plan. ALL AYE: MOTION CARRIED.
FINDINGS OF FACTS AND CONCLUSIONS OF LAW/Streamside Subdivision
Moved by BRINTON and seconded by MAILE to approve the findings with
the correction of Jim Wroten name. ALL AYE: MOTION CARRIED.
The Council report was given by Mary Berent.
Chairman BRADLEY asked for discussion regarding what should be the
definition of "common area, open space". Tonight a golf course was
introduced to the Commission, however, golf courses are commercial
use and not open to public use. Canals, golf courses etc. should
not be common area. After discussion the City Clerk recommended
that P&Z draft wording to be presented to Council for inclusion in
the code. BRINTON will draft a definition of common/open space for
the commission to review.
Moved by BRINTON and seconded by MAYER to recommend Council
prohibit wood burning stoves in Streamside Subdivision, just as the
P&Z recommendation on Banbury Meadows. ALL AYE: MOTION CARRIED.
There being no further business the meeting adjourned at 9:00
p.m.
