Minutes - 1995 - Planning & Zoning - 03/20/1995 - Regular EAGLE PLANNING AND ZONING MEETING MINUTES March 20, 1995 The Eagle Planning and Zoning Commission met in regular session on March 20, 1995. Chairman BRADLEY presiding. The following members were present: BERT BRADLEY, NANCY MERRILL, RUSSEL MAYER, COLLEEN MAILE. DONALD BRINTON, Moved by MERRILL and seconded by BRINTON to approve the minutes of the March 6, 1995 meeting as presented. ALL AYE: MOTION CARRIED. PUBLIC HEARING/Streamside Rezone/Floodplain/Preliminary Plat .J Chairman BRADLEY announced that this was the time and place set for a public hearing on an application for Streamside Subdivision an application for a rezone, and a subdivision preliminary plat in the floodplain. Subdivision: APPLICANT: William Selvage TYPE OF APPLICATION: preliminary plat, rezone, floodplain LOCATION: South side of the South Channel, on the West side of Eagle Road PROPOSED LAND USE AND ZONING: R-2, A proposed subdivision of 51.948 acres and 58 single family lots for a density of. 895 dwellings per acre. Portions of this proposal are in the flood- plain and the floodway. Bill Selvage, developer of the project, outlined the proposal to the Commission. This project includes 5.2 acres of common area. Mr. Selvage indicated they want a rural transitional design. It will include a community water system, and sewer system service provided by Eagle Sewer Dist. An environmental statement was submitted to the City. This subdivision will have a pressurized irrigation system. The developers agreed to accept a condition that the emergency access must be closed off by gates. Also, the notes on the plat will include that only 2 lots will be accessed by the easement provided on the west side of the project (lots 23 and 24), the third lot, (22) will access directly from the cuI de sac. Testimony: Wdol& \i Jim RoaaQn: in favor Harold Westover: in favor the FEMA Public hearing closed at 8:45 p.m. Moved by MERRILL and seconded by BRINTON to recommend approval subject to the following: 1. obtaining the approval of FEMA in removing the portion of the project that is in the floodplain/floodway. 2. restrict the emergency access to Eagle Rd. 3. require an access pathway to the river. 4. lot 22 shall have access only by the cuI de sac. 5. meet the pathway requirements and City of Eagle standard conditions of approval for subdivisions. ALL AYE: MOTION CARRIED. PUBLIC HEARING/BanBury Meadows - PUD/Annexation/Rezone/Preliminary Plat: Chairman BRADLEY announced that this was the time and place set for a public hearing on an application for BanBury Subdivision an application for annexation, rezone, and a subdivision preliminary plat. APPLICANT: Harvey Hoff TYPE OF APPLICATION: annexation of 10.85 acres, subdivision consisting of 344 lots for a gross density of 1.18 dwellings per a golf course with club house. LOCATION: West side of Eagle Road, 1/2 mile North of US Hwy. 20. PROPOSED LAND USE AND ZONING: Most of the 291 acres is currently zoned R5 acres, rezone of 17.45 on a total of 291 acres acre and PUD to include Dick Phillips, representative for the developer, outlined this project for the Commission. All lots are out of floodplain/floodway. This project includes an 18 hole golf course. This property is already zoned R5, but the density is only 1.18 units per acre. There is 64% open space, common areas and a golf course. All open spaces will be maintained by a homeowners association. Testimony: Opposed: George Dillard: Concerned about the impact on areas not included in the subdivision but encompassed on Eagle Rd such as his property. His property will have a club house and maintenance building at his back door, plus a driving range. There will be traffic approximately 400 ft. from his house. He suggests a study to determine the impacts to him and other neighbors. He is also concerned about the water problem, what happens to his well and irrigation? The geese and blue heron, what will happen to them? Mark Canf ield: consistent with existence. the proj ect is too dense, needs to be more other land uses, subdivisions, currently in Carlene Canfield: density needs disbursed. P. Lungren: concerned with irrigation and water access. Locust Grove access grade is too severe. This project would obstruct his view and traffic would be at his bedroom window. Glida Bothwell: concerned about density and the wildlife. With all the homes approved in Eagle the population will double. In Favor: June Walters: the name. Teresa Owens: in favor, is concerned about density and traffic, wants horse trails. Bob Nemec: high density and may be impacts, but in favor Jack Daley: in favor Stan Moss: in favor Jim Herrett: in favor Jim Stout: wants the roads to line up with Fall Creek. He will work with the developer to do that with his property, which would make that possible. When both streets line up a stop light should be installed. in favor, wants Joplin Moors to be considered for Jim Phillips: rebuttal - will berm and landscape to aid Mr. Dillard's concerns. Irrigation water or rights will not be affected. They intend to buffer the sound in the maintenance building. Will make the irrigation system or gravity water system available to Mr. Lungren at their expense. Overall density is much less than 5 units per acre as currently allowed in the zone. Petition with names as "Neighbors to the BanBury Meadows Proposal" submitted in favor of the project Public hearing closed at 10:15 p.m. Discussion took place by the Commission regarding a wood burning stove ban, the impacts on other property owners, water, irrigation and pathway issues, the street alignment and traffic signal with Fall Creek Subdivision. Moved by BRINTON and seconded by MERRILL to continue the matter until the next P&Z meeting in order to give the developer an opportunity to address some of the concerns expressed tonight. ALL AYE: MOTION CARRIED. EAGLE COMPREHENSIVE PLAN AMENDMENTS - 1995 (Continued) The Chairman reminded the audience that the public hearing portion of the comprehensive plan on the applications for Wanner and Ricks has been closed. The public hearing is continued on the amendments included in the text. Testimony: none The public hearing closed at 10:45 p.m. The City Clerk outlined the change in the housing portion of the plan, and advised the Commission that House Bill 212 (manufactured housing) was an amendment to a previous bill that failed. This bill has not been passed. It may be before the governor at this time. The City Clerk recommended waiting until the statute was in place before adding to the plan. Discussion on the comprehensive plan resulted as follows: Moved by MERRILL and second by MAYER to accept the changes to the plan with the following amendments: 1. 2. 3. a map on page 34 attorney review of the housing issue 1 and 4 omitted from page 41 Motion withdrawn. Moved by MERRILL and seconded by BRINTON to continue the Comprehensive Plan discussion until the next meeting. ALL AYE: MOTION CARRIED. Ada County Transmittal 95-18-CU: Eagle High School Greenhouse/Storage Building - CUP: Moved by BRINTON and seconded by MAILE to recommend approval as presented. ALL AYE: MOTION CARRIED. FINDINGS OF FACTS AND CONCLUSIONS OF LAW/GROSSMAN SUBDIVISION PRELIMINARY/FINAL PLAT Moved by BRINTON and seconded by MERRILL to approve the findings as presented. ALL AYE: MOTION CARRIED. HODGES REZONE - DEVELOPMENT AGREEMENT: Moved by MERRILL and seconded by BRINTON to continue the Development Agreement for the Hodges property now known as Eagle County Plaza until the April 17 meeting. ALL AYE: MOTION CARRIED. The Council report was given by Mary Berent.
