Minutes - 1995 - Planning & Zoning - 03/06/1995 - Regular EAGLE PLANNING AND ZONING MEETING MINUTES March 6, 1995 The Eagle Planning and Zoning Commission met in regular session on March 6, 1995. Chairman BRADLEY presiding. The following members were present: NANCY MERRILL, RUSSEL MAYER. BERT BRADLEY, DONALD BRINTON, Moved by MERRILL and seconded by MAYER to approve the minutes of the February 27, 1995 meeting as presented. ALL AYE: MOTION CARRIED. PUBLIC HEARING/Grossman SUbdivision/Preliminary/Final Plat Chairman BRADLEY announced that this was the time and place set for a public hearing on an application for a combination preliminary/final plat. APPLICANT: Cliff Grossman TYPE OF APPLICATION: Combined plat-preliminary and final LOCATION: E. of U-Do-It-Car Wash on State St., Eagle PROPOSED LAND USE AND ZONING: C2 - Commercial Subdivision David Bailey, representative for Pennacle Engineering, outlined the project for the Commission. Lot 1 of the subdivision is U-Do-It- Car Wash, Lot 2 will be We-Do-It-Lube Service. The third lot will be developed at a later date with access from Edgewood. The developer agrees to installing curb, gutter and sidewalk, street lights and trees with the same conditions as U-Do-It Car Wash, when development reaches this property. John Costner, also a representative for the developer, addressed the lighting on the commercial areas. The lighting will be on only during the hours of operation (8:00 a.m. to 6:00 p.m.). There will be one night light, a 70 watt light. Joy Grimstead: opposed - increase noise, devalue property, odors from car fumes, lights into neighborhood windows. Dennis Bragdon: opposed - Eagle should protect residential areas. This is more an industrial use. Mike Plunket: questions oil dispersement. Public hearing closed at 8:40 p.m. Moved by BRINTON and seconded by MAYER to approve preliminarY/final plat subject to the following conditions: the 1. Eagle Standard Subdivision Conditions of Approval 2. That bonding is required for the curb, gutter and sidewalk, street trees and lights on State St. side 3. The additional 9 ft. right-of-way as shown on the plat 4. Bonding for the curb, gutter and sidewalk on Edgewood 5. PUBLIC HEARING/1995 EAGLE COMPREHENSIVE PLAN Chairman BRADLEY announced that this was the time and place set for the continuation of a public hearing on the 1995 amendments to the Eagle Comprehensive Plan: Testimony: Phil Whitner, Ann Shelly Written Testimony: Ann Shelly The chairman asked for the plan to be sectioned off as applications, the contex of the plan as amended, and the applications from Mr. Wanner and Ricks. 3 2 AMENDMENTS TO THE CONTEXT: The Commissioners went through the plan page by page and recommended changes. A second draft will be submitted to the Commissioners by the City Clerk. APPLICATION Walt Wanner: Mr. Wanner testified that the subdivision density he has in mind will be 1.93 per acre, not R4, with concentrated density behind the school. He is asking for an amendment to the Land Use Desigated Map for Medium Density (4 or fewer dwelling lots per acre). APPLICATION - Tom Ricks: Mr. Ricks testified that due to the high school now being constructed in the area, higher density should be considered. 2000 students makes more of a urban distict. Ann Shelley: opposes a land use designation change. for rural qualities. She came here Jane Fulkerson: opposed to density change. Laura McCarthy: opposed - where is the benefit to the city? Jerry Iverson: in favor - economic development and housing base, larger lots does not derive dollars for police protection, senior centers, libraries and other services needed.. Bill Sutherland: in favor - He is a representative for assisted living seniors and wants to establish senior citizen housing on a portion of the Crandlemire property for a senior community. Marty Taylor: document now. opposed - the comprehensive plan is a workable The public hearing on the Wanner and Ricks application of amendments to the Land Use Designation Map closed at 9:55 p.m. The public hearing will remain open on the context of the plan. .-.------.- ~--------~---.._~_..-.~. ..------- --~-- -.-.---- Moved by BRINTON and seconded by MERRILL to wait until we have the results of the sewer meeting on March 8, regarding the high school area to continue discussion of the issue. The matter is continued until the next meeting. AYE: BRINTON, MERRILL, MAYER. NAY BRADLEY. FINDINGS OF FACTS AND CONCLUSIONS OF LAW/Elliott Industrial-CUP and Chaumont Annexation, Zoning and Subdivision. Moved by BRINTON and seconded by MERRILL to approve the findings with the corrections made by the City Attorney. ALL AYE: MOTION CARRIED. The Council report was given by Mary Berent.
