Minutes - 1995 - Planning & Zoning - 02/06/1995 - Regular EAGLE PLANNING AND ZONING MEETING MINUTES February 6, 1995 The Eagle Planning and Zoning Commission met in regular session on February 6, 1995. Chairman BRADLEY presiding. The following members were present: NANCY MERRILL, RUSSEL MAYER. BERT BRADLEY, DONALD BRINTON, Moved by BRINTON and seconded by MERRILL to approve the minutes of the January 23, 1995 meeting as presented. ALL AYE: MOTION CARRIED. PUBLIC HEARING/Chaumont Preliminary Plat Subdivision-Annexation, Zoning and Chairman BRADLEY announced that this was the time and place set for a public hearing on an application for a subdivision preliminary plat-annexation and zoning. APPLICANT: Hill Way, Inc. ie Trever Roberts TYPE OF APPLICATION: Annexation, zoning (R4) and preliminary plat LOCATION: South of Hill Road at Dickey Drive and East of existing Edgewood Estates. PROPOSED LAND USE AND ZONING: R4 - easements for Dry Creek Canal will be 35 ft. to S, 25 ft. to N according to the requests of Dry Creek Canal Co. There are 9 common areas within the subdivision, counting the easement and pathway on Dry Creek. David Torgeson, JUB Engineer representative, outlined the project for the Commissioners. Testimony: none Public hearing closed at 8:15 p.m. Moved by BRINTON and seconded by MAYER to continue this hearing to the next regular session in order for the developer to show 10% common area without using the canal area, and C26 in block 4 included elsewhere. ALL AYE: MOTION CARRIED. PUBLIC HEARING/EAGLE IMPACT AREA: History: The City of Eagle and Boise City are entering into an agreement where a park and school location will be pledged by Boise in a land exchange agreement with B.W., Inc. The City of Eagle and Boise want a buffer between the sewer plant facility and residential land uses. In order to reach a common goal, the 2 cities agree to join in negotiations with Ada County to alter the areas of impact in order to accomplish this purpose. Boise will use 35 acres on the W side of the property it will receive in the land exchange for a park site for recreational purposes, a possible school site, and as a buffer between the residential uses to the west and Boise treatment facility to the east. Boise will not -.--... -._-~--~-_.~._- .-- ...---.--. --- ....---. apply biosolids on the proposed park/SChool site and provide a 400 ft buffer between the Boise owned property N of the park/school site and Fall Creek Subdivision. Boise will not condemn the property presently in the Eagle Area of City Impact, adjacent to the property owned by Boise City known as the Carrico property. The request is to take approximately 223 acres of the Eagle Impact Area and add it to the Boise Impact Area. Testimony: Beth Grinstead did not discuss the impact area, but was concerned about the Agreement. The public hearing closed at 8:30 p.m. Moved by BRINTON and seconded by MERRILL to recommend approval of the removing of the impact area from Eagle and include the area as Boise Impact Area, as presented, allowing the park/school and Fall Creek Subdivision as submitted. ALL AYE: MOTION CARRIED. BRINTON asked for information on the P&Z's ability to create a Land Acquisition Map. John will present P&Z with information regarding this at the next meeting. The Council report was given by Mary Berent. Moved by BRADLEY and seconded by MERRILL to recommend to Council the retention of the super majority vote now included in code. MOTION WAS UNANIMOUS. Eagle Comprehensive Plan: The City Clerk informed the Commission of the upcoming public hearing date for the Comprehensive Plan amendments. The proposed plan will be sent as soon as possible.
