EAGLE PLANNING AND ZONING MEETING MINUTES
October 3, 1994
The Eagle Planning and Zoning Commission met in regular session on
October 3, 1994. Chairman SMITH presiding.
The following members were present: KEN SMITH, BERT BRADLEY,
DONALD BRINTON, NANCY MERRILL, RUSSEL MAYER.
Moved by BRINTON and seconded by MERRILL to approve the minutes of
the September 19, 1994 meeting as presented. ALL AYE: MOTION
CARRIED.
PUBLIC HEARING/Baker/North Channel Rezone
Chairman SMITH announced that this was the time and place set for
a public hearing on an application for the Baker/North Channel
Rezone.
APPLICANT: Dennis Baker
TYPE OF APPLICATION: Rezone 2.16 acres from M-1 to C-1,
making the applicant's entire parcel a consistent C-1 zone.
LOCATION: 725 S. Eagle Road-just north of the old packing plant
property.
PROPOSED LAND USE AND ZONING: The proposed zoning is C-1
(Neighborhood Business District), the proposed development (not
part of this application) is a commercial, office and residential
development.
Wayne Stollfus presented the rezone to the Commission. This parcel
is adjacent to the larger parcel now zoned C-1 and will only be
used in conjunction with the larger parcel as the bypass will leave
it without access.

Public hearing closed at 7:45 p.m.
Moved by BRINTON and seconded by MERRILL to recommend the rezone as
submitted as it contiguous with C-1. ALL AYE: MOTION CARRIED.
PUBLIC HEARING/Bevington - Rezone
Chairman SMITH announced that this was the time and place set for
a public hearing on an application for the rezone of the Bevington
property.
APPLICANT: H. LaRue and Bernice Bevington
ADDRESS: 812 East State Street, Eagle, ID 83616
TYPE OF APPLICATION: Rezone .84 acres from A to C2.
LOCATION: 812 East State Street, Eagle, ID 83616. 1/2 mile east of
Eagle Road on the north side of State Street.
PROPOSED LAND USE AND ZONING: The requested zoning is C2, the
existing rental home is to be converted to a barber shop, and
future commercial development is proposed along State Street.

Public hearing closed at 8:07 p.m.
Moved by BRADLEY and seconded by MAYER to approve the rezone as it
is contiguous to C2 on State St and compatible to the surrounding
area. ALL AYE: MOTION CARRIED.
FINDINGS OF FACTS AND CONCLUSIONS OF LAW/Van Engelen Estates #2-
Annexation and Zoning, and First Security Bank-CUP.
Moved by BRINTON and seconded by MERRILL to approve the findings
for Van Engelen, modified as follows: condition #6 should read
require water service from a franichsed water utility. First
Security Bank - CUP is approved as presented. ALL AYE: MOTION
CARRIED.
