Minutes - 1994 - Planning & Zoning - 04/18/1994 - Regular ~ EAGLE pLANNING AND ZONING MEETING MINUTES April 18, 1994 The Eagle Planning and Zoning Commission met in regular session on April 18, 1994. Chairman SMITH presiding. The following members were present: KEN SMITH, BERT BRADLEY, DONALD BRINTON, MARY BERENT, NANCY MERRILL. Moved by Berent and seconded by Bradley to approve the minutes of the April 4, 1994 meeting with the following corrections: Page 2: the "Band" transmittal should have read for a lot split not a private road. ALL AYE: MOTION CARRIED. PUBLIC HEARING/WAYNE SWANSON MINI STORAGE UNITS - CUP/REZONE Chairman SMITH announced that this was the time and place set for a public hearing on an application by Wayne Swanson for a rezone for a professional office and a CUP for Mini Storage Units. APPLICANT: Wayne Swanson ADDRESS: 985 W. State St., Eagle TYPE OF APPLICATION: Rezone from R5 to C1 LOCATION: same PROPOSED LAND USE AND ZONING: professional Office and mini storage units. Testimony: In favor: Steve Hiatt opposed: Bob Hortley, Kathy Hortley, Jerry potter, Joey cullen, Ed Rochnowski, Boyd Young, Helen House, Bill Cohen. Concerns of the public: Impact on property values, predominantly a residential neighborhOod, additional traffic. Public hearing closed at 7:55 p.m. Moved by Brinton and seconded by Berent to recommend denial of this application based on ECC 8-2-1, which establishes that C1 is a NeighborhOod Business District to establish convenience business uses which tend to meet the daily needs of the residents of the immediate neighborhood.---This business does not meet a daily need. Also, ECC 8-7-3-2.C ---to be harmonious and does not change the essential character of the same area-- ALL AYE: MOTION CARRIED. PUBLIC HEARING/SCOTTS GLEN SUBDIVISION - REZONE AND PRELIMINARY PLAT: Chairman SMITH announced that this was the time and place set for a public hearing on an application for Scotts Glen Subdivision a rezone from A to AR and a preliminary subdivision plat. - APPLICANT: Berry Peters TYPE OF APPLICATION: zoning AR and Subdivision preliminary Plat LOCATION: Eagle Island, approximately one mile W of Eagle Rd, on Mace Rd. PROPOSED LAND USE AND ZONING: AR zoning, 28.12 acres, 4 lots, 4 to 5 acres for a pend to be located in the center of the development. An average of 7.2 acres per lot. Lots 1 and 4 are in the floodway. The one is 4 acres-ground water only, no surface water. When sewer service comes through the area they will connect to it. Testimony: In favor: Peter wierenga, Paul Kuntz. Charlie porter, Diane Merkle, Russ Burchart. Opposed: Concerns: The floodway, floodplain, Mace Road sensitive area, and sewer. There was concern about tax dollars used and the benefits of a road leading to 4 individual lots. Public hearing closed at 9:05 p.m. Moved by Berent and seconded by Merrill to recommend approval of the development with the following conditions: 1. A specific access easement for lot #3 is required 2. ACHD requirements including post of bond 3. Standard Subdivision Conditions of the City of Eagle ALL AYE: MOTION CARRIED. WINTERY RIVER CROSSING: (continued) Mike Shrewsberry, Proj ect Engineer addressed the Commissioners. He presented a new plat outlining the changes the Commission requested. The Commissioners reviewed the development and concerns about the floodway and floodplain. Moved by Bradley and seconded by Brinton to approve the project with the following conditions: 3. Curb, gutter and sidewalks will be required on both sides of the road. Developer must install a gravel walk way along the entire side of the dry creek development and it will be maintained by the homeowners association. Lots 4 and 5 are not removed from the floodway and become part of the common area. The Standard Subdivision Conditions are met. 1. 2. 4. AYE: Brinton, Bradley. NAY: Merrill, Berent, Smith. THE MOTION WAS DEFEATED. Moved by Merrill and seconded by Berent to recommend denial of the application, this development does not meet the purpose and Scope - ~ (67-6502) provisions of the 1993 Eagle Comprehensive Plan. AYE: Merrill, Berent. NAY: Bradley, Brinton. Chairman Smith voted Aye. MOTION CARRIED TO DENY THE SUBDIVISION. Ada County Transmittal 94-26-PDR S'mny Brea/Crandlemire: Presented by Ray Howard. A 4 lot subdivision 24.39 acres. Moved by Merrill and seconded by Bradley to approve as presented. ALL AYE: MOTION CARRIED. Ada County Transmittal 93-02-PDR/Goldridge (Thornridge) Subdivision. An extension of time. Moved by Bradley and seconded by Berent to approve the transmittal as presented. ALL AYE: MOTION CARRIED. FINDINGS OF FACTS AND CONCLUSIONS OF LAW: BERKSHIRE SUBDIVISION: Moved by Brinton and seconded by Bradley to approve the findings as presented. ALL AYE: MOTION CARRIED. FINDINGS OF FACTS AND CONCLUSIONS OF LAW: FRISON: Moved by Bradley and seconded by Berent to approve the findings as presented with the suggested changes submitted by John McFadden, City Attorney. ALL AYE: MOTION CARRIED. The Council report was given by Stan Bastian. Once again the Commissioners discussed the May joint Council-P&Z meeting which will be held on May 31. Merrill contacted Ken Harwood from the City of Nampa. He invited the P&Z Commissioners and Council to Nampa, on the 31st to see the recreation center. He indicated the best time to meet would be in the morning. The Commissioners are in agreement with that. The City Clerk will contact the Council and see if they can attend.
