EAGLE PLANNING AND ZONING MEETING MINUTES
April 4, 1994
The Eagle Planning and zoning Commission met in regular session on
April 4, 1994. Chairman SMITH presiding.
The following members were present: KEN SMITH, BERT BRADLEY,
DONALD BRINTON, MARY BERENT, NANCY MERRILL.
Moved by Berent and seconded by Merrill to approve the minutes of
the March 21, 1994 meeting with the following corrections:
1. Page 2, "rod iron" should read "wrought iron"
2. Page 3, Wintry River Crossing Public Hearing: the name "Betty
Holmquist should be "Peggy Holmquist" and "Ted Holmquist" should be
"Gabe Holmquist". The word "AYE" should be removed from the
motion.
ALL AYE:
MOTION CARRIED.
'PUBLIC HEARING/FRISON-VARIANCE
Chairman SMITH announced that this was the time and place set for
a public hearing on an application for a setback Variance from 7
1/2 ft. to 3 ft.
APPLICANT: Daniel & Patricia Frison
ADDRESS: 1726 E. Stadler Ct. Eagle
TYPE OF APPLICATION: Variance - set back requirements on an out
building from 7.6 side set back requirement to 3.
LOCATION: 1726 E. Stadler Ct./Melvin's Eagle Point Subdivision
PROPOSED LAND USE AND ZONING: R1 (Residential)

Moved by Bradley and seconded by Berent to deny the Variance
Application request based on the fact there is no justified reason
for the Variance. ALL AYE: MOTION CARRIED.
PUBLIC HEARING/BERKSHIRE ACRES SUBDIVISION- Annexation, zoning (R4)
and preliminary plat:
Chairman SMITH announced that this was the time and place set for
a public hearing on an application for annexation, zoning of R4 and
a preliminary subdivision plat for Berkshire Acres Subdivision.
APPLICANT: Mike Gulff
REPRESENTATIVE: Ted Hutchinson, Tealey Land Surveying
TYPE OF APPLICATION: Annexation, Zoning (R4) and Subdivision
Preliminary Plat
LOCATION: S. side of Floating Feather Rd. approx. 2000 ft. W. of

intersection of Floating Feather and Highway 55.
PROPOSED LAND USE AND ZONING: RT to R4, contains ì. 66 acres,
contains one older single dwelling w/ detached garage), 29 lots, (28
lots for single-family dwellings and 1 open space/drainage lot,
3.65 dwelling units per acre.
Testimony: In Favor: Garth Baldwin (B2L2), Lucreta Carlock, Elmer
Carlock, Bill Pardew, Helen pardew, Kay Mauritz.
There was no opposing testimony.
Public hearing closed at 8:25 p.m.
Moved by Bradley and seconded by Berent to recommend denial of the
application as presented, annexation, zoning and preliminary plat,
based on the non conformance of the Eagle Comprehensive Plan, no
pathways, parks or open spaces which are intended by the Eagle
Comprehensive Plan. ALL AYE: MOTION CARRIED.
Ada County Transmittal 94-11-ZC/94-06-PR-Band: A rezone and
private road application in the Eagle Impact Area. Moved by Berent
and seconded by Merrill to approve the transmittal as presented.
ALL AYE: MOTION CARRIED.
FINDINGS OF FACTS AND CONCLUSIONS OF LAW/Echohawk Subdivision:
Moved by Bradley and seconded by Berent to approve the findings
with the corrections made by the City Attorney. ALL AYE: MOTION
CARRIED.

Moved by Bradley and seconded by Berent to accept the findings as
presented. ALL AYE: MOTION CARRIED.
The Council report was given by Stan Bastian.
The Commissioners discussed the May joint Council-P&Z meeting which
will be held on May 31. The agenda should include a recreation
video and slides on various types of fences that could be used in
this area. Nancy Merrill will supply the recreation video and
arrange for a VCR and Ken Smith will supply the slides on the
fences.
