Minutes - 1994 - Planning & Zoning - 02/28/1994 - Special EAGLE PLANNING AND ZONING :MEETING February 28, 1994 The Eagle Planning and Zoning Commission met in special session on February 28, 1994. Chairman SMITH presiding. The following members were present: MARY BERENT, NANCY MERRILL. Absent: KEN SMITH, DONALD BRINTON, BERT BRADLEY. Moved by BERENT and seconded by BRINTON to approve the minutes of the February 7, 1994, meeting as presented. ALL AYE: MOTION CARRIED. PUBLIC HEARING/ECHOHAWK SUBDIVISION Chairman SMITH announced that this was the time and place set for a public hearing on Echohawk Subdivision preliminary plat. Applicant: B.J. Land Co. of Mesa Ariz. Location: S side of Floating Feather Rd. approx 1800 ft W of Intersection of Floating Feather Rd. and present SH 55. Proposal: Zoned R5 - 35.16 acres, proposed 109 single family dwelling lots and 3 Common lots (2 landscaping, 1 future right of way). Density 3.10. Intersected by Farmers Union Canal. The proposed re-Iocation of SH 55 will form the E boundary. Will be developed in 3 phases. Phase 1 - 39 lots, Phase 2 - 35 lots and Phase 3 - 38. Public Testimony: In favor: Mr. and Mrs. William Pardew, Lacretia Carlock. Opposed: George Loucks, Cantor Finch (Farmers Union Ditch Co., representative) Written testimony: (B2-L2) in favor. Elmer and Lucretia Carlock, Richard Bechtolt Representatives speaking for the project were: Pat Tealey. Ted Hutchinson and Concerns of the public: fire protection and well water use, canal crossing and sewer crossing. Public hearing closed at 8:15 p.m. Moved by BRINTON and seconded by BERENT to reopen the public hearing for March 21, 1994, in order to have time to receive more information from ITD regarding the required berming between the subdivision and new SH55 and on the Floating Feather Rd frontage. PUBLIC HEARING/Tates RentS-Rezone from CBD to C3 Chairman SMITH announced that this was the time and place set for a public hearing on Tates Rents, a rezone application. Applicant: Eric and Clint Tate Location: W side of N. Eagle Rd. 1 block N of State St. (prev. Fabco building) Proposal: To rezone from CBD to C3 for the establishment of a equipment rental business. Testimony: opposition. In favor: Irene Gunderson, Roger Michener. No The public hearing closed at 8:35 p.m. MOved by BRINTON and seconded by MERRILL to recommend approval of the rezone as submitted. ALL AYE: MOTION CARRIED. Ada County Transmittal Subdivision: 94-10-PDR/94-09-ZC High Country Estates Steve Bradbury, attorney for the developer and Dave Roylance, Project Engineer, presented the development to the Commissioners. Moved by BERENT and seconded by BRINTON to recommend approval of the development with the following modifications: 1. 2. the staff conditions inclusion of 2 common landscaped lots at the E and W of the entrance of the subdivision to be owned and maintained by the homeowners association. ALL AYE: MOTION CARRIED. FINDINGS OF FACTS AND CONCLUSIONS OF LAW/Eagle Public Storage: The City Clerk reported that the developer and property owner had discussed the screening to the N of the development. There will be a masonry wall continued by a chain link fence complete with slats. The residence will be moved from the N portion of the lot to the S portion of the lot. Moved by MERRILL and seconded by BERENT to approve the findings as presented. ALL AYE: MOTION CARRIED.
