Minutes - 1994 - Planning & Zoning - 02/07/1994 - Regular - f' EAGLE PLANNING AND ZONING MEETING February 7, 1994 The Eagle Planning and Zoning Commission met in regular session on February 7, 1994. Chairman SMITH presiding. The following members were present: KEN SMITH, BERT BRADLEY, DONALD BRINTON, MARY BERENT, NANCY MERRILL. Moved by BRINTON and seconded by BERENT to approve the minutes of the January 3, 1994 meeting with the following corrections: 1. Page 1: Paragraph 8 should not include the words "All Aye -- " as there was no motion. The reference to a pressurized irrigation system, within the same paragraph, should read to clarify the fact that the developer will furnish the hook-up and pump to a pressurized irrigation system, but not the system itself. 2. Page 2: Paragraph 3 should include "seconded by BERENT". ALL AYE: MOTION CARRIED. PUBLIC HEARING/PATTERSON, ANNEXATION, ZONING (R5): Chairman SMITH announced that this was the time and place set for a public hearing on the Patterson application for annexation, zoning of R5 to establish a single family dwelling unit on a lot. Applicant: Location: Proposal: Bruce, Kim, Sharon and Stacia Patterson Hill Rd., W of Highway 55 One single family dwelling lot, zone request R5. 6.38 acres Public Testimony: None Planning and Zoning discussion included the Ada County Transmittal request for a Variance at this same location. The Commissioners were concerned about a variance request and annexation/zoning request submitted to 2 governmental entities at the same time. The application seemed unclear to the Commissioners as far as intent of the applicant. The need for an R5 for one unit on 5 acres seems excessive. There is no R5 zoning in the immediate area and no services (sewer, water, etc.) in the area. Public hearing closed at 8:15 p.m. Moved by BRINTON and seconded by BRADLEY to deny the application as presented based on the following: a. b. There are no services to support the application; Defining the actual size of the property in relation to the split the new Highway 55 will create is unclear; . c. d. The annexation is of no benefit to the City of Eagle; It is not in harmony and consistent with the existing land uses in the area. AYE: BRADLEY, BERENT, BRINTON. NAY: MERRILL. MOTION CARRIED. PUBLIC HEARING/PUBLIC STORAGE OF EAGLE -MINI STORAGE UNITS -CUP Chairman SMITH announced that this was the time and place set for a public hearing on the Conditional Use Permit application for Public Storage of Eagle, a Mini Storage project. Applicant: Shirley Zakovics and City Development Location: SH 55 between State St. and Hill Rd. Proposal: Zoning C2. Enclosed storage buildings and fenced storage, a phased project, the first consisting of 5 units, then 2 more phases and finally the outside portion of the project. The total phase out is an estimated 2 to 3 years. The Project is to be fenced off with a chain link fence. Representative: Cornell Larson, Project Architect. Public Testimony - Opposition: Ken J. Patten, Jerry Mohlenar, Bill Cohen. In Favor: Dick Phillips Concerns of the public: Property values, drainage run off problems, no traffic study, screening between residential- commercial. Public hearing closed at 9:10 p.m. MOved by BRINTON to continue the proposal in order to see if the neighbors are able to work out an compromise on the buffering of the two properties. The motion died for lack of a second. Moved by BRADLEY and seconded by MERRILL to recommend approval the application as presented by staff with the following modifications and conditions: a. Both the applicant and Ken Patton reach an agreement on the screening/berming of the property on the North side and report back to the City Clerk. The City Clerk will enter the information into the Findings of Fact and Conclusions of Law to be presented to the Commissioners at the February 28,1994 meeting. This decision is subject to a legal opinion on this m6tion. b. A chain link fence and arborvitae between the commercial and residence is required. c. That the residence/office be flipped from the front North side of the property to the front South side of the property. - "' AYE: AYE. BRADLEY, MERRILL. MOTION CARRIED. NAY: BERENT, BRINTON. ALL AYE: MOTION CARRIED. ADA COUNTY TRANSMITTAL 92-50-PDR/92-36-PR Ron E. Stone: An extension of time on a 2 lot subdivision. Moved by BERENT and seconded by BRADLEY to approve the transmittal as presented. ALL AYE: MOTION CARRIED. The Council report was given by Stan Bastian.
