Minutes - 1993 - Planning & Zoning - 12/20/1993 - Regular EAGLE PLANNING AND ZONING MEETING MINUTES December 20, 1993 The Eagle Planning and Zoning Commission met in regular session on 1993. Chairman SMITH presiding. The following members were present: PAULINE HINMAN, BERT BRADLEY, KEN SMITH, DONALD BRINTON, MARY BERENT. Moved by BRADLEY and seconded by HINMAN to approve the minutes of the December 6, 1993 meeting as presented. ALL AYE: MOTION CARRIED. PUBLIC HEARING/LaRue Acres - Rezone (R4) and Preliminary Plat: Chairman SMITH announced that this was the time and place set for a public hearing on LaRue Acres Subdivision. Applicant: Chuck Watts Location: E of Palmetto ave at Amanita St. Proposal: Rezone from A to R4, Preliminary Plat for 13.4 acres, 49 single family dwelling lots at 3.7 units per acre. Jim Reese, Project Engineer for the development presented the proposal to the Planning and Zoning Commission. Mr. Reese informed the Commission that lots 11 and 12 would be designated as park sites. The minimum lot size in the development is 7,000 sq. ft. They will leave the present buffer of trees on the south boundary of the development as is. Palmetto ends at the southern boundary of the development, it does not go through to State St. This project will be built in one phase. Public Testimony: Cooper. Opposed: Roy Duggins, Al thea Duggins, Vada Concerns of the public: Traffic congestion, construction trucks within an existing subdivision, and a need for a traffic study. Public hearing closed at ~oo p.m. Moved by BRADLEY and seconded by BERENT to approve the rezone to R4 and preliminary plat based on compliance with the 1993 Eagle Comprehensive Plan with the following conditions: 1- 2. 3. 4. Palmetto is to be built out to State Street by the developer Installation of a pressurized irrigation system if feasible Create an ACHD approved access to the east of the project Compliance with the Eagle Standard Subdivision Conditions of Approval AYE: BRADLEY, HINMAN, BERENT. NAY: BRINTON. MOTION CARRIED. 1 PUBLIC HEARING/Patterson - Annexation, zoning (R5) Chairman SMITH announced that this was the time and place set for a public hearing on Patterson annexation and zoning. Applicant: Location: proposal: Bruce and Kim Patterson, Stacia, and Sharon Hill Rd, W of Highway 55 one single family dwelling lot, zoning R5 on 6.38 acres. Wayne Curtis, attorney for the applicant presented the proposal to the Commissioners. The Commissioners indicated they did not have enough information in order to make a recommendation to the Council. Their concerns were the type of development that the applicant requested in an R5 zoning designation, the lack of information on location and size of the property was questioned. Public hearing closed at 8:55 p.m. Moved by BRINTON and seconded by HINMAN the Commission requests this be re advertised, and additional information be provided by the applicant regarding location, description and clarification regarding the property size and land use intent. The property was not posted for hearing. ALL AYE: MOTION CARRIED. JIM MURRAY-housing development in Eagle: Mr. Murray was asked by HHIMAN to give a presentation on a total outlook on housing gevelopment in Eagle. FINDINGS OF FACT AND CONCLUSIONS OF LAW: Sugarberry annexation, zoning and preliminary plat. Moved by BERENT and seconded by HINMAN to accept the findings as presented. ALL AYE: MOTION CARRIED. FINDINGS OF FACT AND CONCLUSIONS OF LAW: pottenger - CUP for a mobile home on a single family dwelling lot. Moved by HINMAN and seconded by BERENT to accept the findings as presented.
