Minutes - 1993 - Planning & Zoning - 01/06/1993 - Regular EAGLE PLANNING AND ZONING MEeTING DECEMBER 6, 1993 The Eagle Planning and Zoning Commission met in regular session on December 6, 1993. Chairman SMITH presiding. The following members were present: DONALD BRINTON, MARY BERENT. Absent: KEN SMITH, PAULINE HINMAN, BERT BRADLEY. Moved by BERENT and seconded by HINMAN to approve the minutes of the November 15, 1993 meeting as presented. ALL AYE: MOTION CARRIED. Moved by BRINTON and seconded by HINMAN to approve the minutes of the November 30, 1993 special meeting with the following corrections: 1. Meridian Middle School: Bradley voted Nay to the motion to continue the matter. 2 . The Publ ic hear ing Construction-CUP" should read "Meridian Middle School 3. The rescinding motion and motion to deny the Meridian Middle- CUP should be separate motions. BRADLEY voted Aye on the rescinding motion and Nay on the denial motion. ALL AYE: MOTION CARRIED. Moved by BRINTON and seconded by HINMAN to move item 4B to 4A and hear the Pottinger - CUP application at this time. ALL AYE: MOTION CARRIED. PUBLIC HEARING/Pottinger - CUP Application Chairman SMITH announced that this was the time and place set for a public hearing on the application for a conditional use permit for Doris Pottinger for mobile home use on a single family dwelling lot. Applicant:Ira and Doris Pottinger Proposal: CUP for a mobile home on a single family lot where a dwelling already exists, R5 zone. Location: 2128 Dunyon St., Eagle Public Testimony: none Public hearing closed at 7:55 p.m. Moved by HINMAN and seconded by BERENT to approve the application 1 -~-- ----- -~- ~---~-~~~~~ ~-~~~-~ for a CUP for a mobile home on the lot conditioned on the mobile home will remain only as long as it is needed by the family member addressed tonight. ALL AYE: MOTION CARRIED. PUBLIC HEARING/Sugarberry preliminary plat Chairman SMITH announced that this was the time and place set for a public hearing on the application for an application on annexation, zoning of R1, and preliminary subdivision plat Subdivision-annexation, zoning and Applicant: Loren Saunders Type of application: annexation, zoning (Rl), preliminary plat Location: 1/4 to 1/2 mile N of Chinden Blvd. on N. Meridian Rd. proposal: 73.4 acres. 35 lots ranging from 1.67 acres to over 2 acres. (Northern lots 2 acres or more as a transition zone between Clearvue and Sugarberry). A 3 phase project from 1994-96. The subdivision will be an urban forest-wooded look in order to accomplish this each acre will be required to provide 10,000 sq ft (1/4 acre) of wooded area. Lots 9, (3.2 acres), 24 (1 acre) and 26 (2 acres) of Block 1 have existing homes. Lots 24, 25, & 26 will access off of Meridian Rd. Chairman SMITH announced that BERT BRADLEY had arrived and will join the Commissioners. Public testimony: In Favor: Tim Minor Lindley, Joe Sheehan - traffic and water Concerns: Merle The public hearing closed at 8:35 p.m. Moved by BERENT and seconded by HINMAN to recommend approval of the annexation, zoning of R1, and preliminary plat with the following conditions: 1- 2. 3. The standard subdivision conditions of approval written permission to tile the ditch installation of a pressurized irrigation system ALL AYE: MOTION CARRIED. Moved by BRINTON and seconded by HINMAN to include in the annexation the SW corner parcel with a zoning designation of R1. ALL AYE: MOTION CARRIED. FINDINGS OF FACT AND CONCLUSIONS OF LAW/MERIDIAN MIDDLE SCHOOL-CUP Moved by BRINTON and seconded by BRADLEY to approve the findings with the following corrections: 1. 2. #3 on page 2 should be omitted, the location is incorrect #4 should explain that Becky Bowcutt was a city representative 2 in submitting the attached report ALL AYE: MOTION CARRIED. FINDINGS OF FACT AND CONCLUSIONS OF LAW/CURLEW SUBDIVISION Moved by BRINTON and seconded by BERENT to approve the findings with the following corrections 1. Page 5, #1 should read - - "which intends to gQ through this particular property 2. Page 6, first paragraph should read - -"information received from Ada County Highway District regarding the purchase of the property" ALL AYE: MOTION CARRIED. OLD BUSINESS: The Meridian School District-CUP was discussed. There were concerns regarding the exit of the buses and location of Pimlico Rd., and fire lanes. The mobile units should be addressed also. There being no further business the meeting adjourned at 9:40 p.m. 3
