EAGLE PLANNING AND ZONING MEETING
September 13, 1993
The Eagle Planning and Zoning Commission met in regular session on
September 13, 1993. Vice Chairman HINMAN presiding in Chairman
SMITH'S absence.
The following members were present: PAULINE HINMAN, BERT BRADLEY,
DONALD BRINTON, MARY BERENT. Absent: KEN SMITH
Moved by BERENT and seconded by BRINTON to approve the minutes of
the August 16, 1993 meeting with the following corrections:
1. Page 1, paragraph 10 "ALL AYE": MOTION CARRIED to be removed as
there was no motion.
2. Page 2, paragraph 10, should read "10 apt. buildings"
ALL AYE:
MOTION CARRIED.
UNFINISHED BUSINESS:
Moved by BRADLEY and seconded by BERENT to accept the Findings of
Facts and Conclusions of Law for LaRue Acres Subdivision and
Periwinkle Subdivision as presented. ALL AYE: MOTION CARRIED.
FALL CREEK SUBDIVISION annexation,

zoning and preliminary plat
The Commission discussed the wild life, access to wells, density
and impact area agreement between Boise and the Fall Creek
developers. Moved by BRINTON to deny the application as it is not
in the best interest of Eagle by loosing part of the impact area in
the process. The motion died for lack of a second.
Moved by BRADLEY and seconded by BERENT to approve the application
for annexation, zoning and a preliminary plat for Fall Creek
subdivision with the following conditions:

All Eagle Subdivision conditions are required
All lots south of the creek are eliminated
The area along the foot of the hill be maintained and
accessible for the people who have wells in that area
The impact area boundaries are not changed.
Maintain 25 ft setback both sides of the creek to remain in a
natural state
The CC&R's provide for a minimum of 4 trees per lot, a 2 to 3
caliper,
The Meridian School should agree to accept the school site,
that will be designated for a school site.

PUBLIC HEARING/ Ordinance 230-Arnending Title 8 to establish
sidewalk design review requirements on certain roadways.
Vice Chairman HINMAN announced that this was the time and place set
for a public hearing on the amendment to Title 8.
There was no public testimony and the public hearing closed.
Moved by BRADLEY and seconded by BERENT to continue the matter
until the next meeting when the City Attorney is able to have the
Ordinance in final form to the Commissioners. ALL AYE: MOTION
CARRIED.
NEW BUSINESS:
Ada County Transmittal 83-43-PDR/Buckhorn Partnership an
application for an 48 lot expansion of a Planned Residential
Development from Ada County Development Services on behalf the
Buckhorn Partnership.
The development contains 262.68 acres located at the NE corner of
N Park Lane and W Beacon Light Rd in the E 1/2, S 36, T 5N, R1W.
This subdivision is located in the Eagle Fire District and the
Farmers Union Irrigation District and is served by individual wells
and septic tanks.
Moved by BRINTON and seconded by BRADLEY to approve the transmittal
with the following conditions:

The staff recommendations
a minimum of 2 accesses to the Farmers Union Canal for pathways
be established within the subdivision
Ada County Transmittal 93-28-ZC/Guille: A 1 acre split from a 5
acre lot. Moved by BERENT and seconded by BRINTON to approve the
transmittal as presented. ALL AYE: MOTION CARRIED.
There was a discussion on the PUD Code standards 8-8-6-3. B, a
reference that the final development plan requires the Commissions
recommendation to the Council.
Kelli Blair asked Stan Bastian to report on the activities of the
City Council.
