Chairman SMITH presiding. The following members were present: PAULINE HINMAN, BERT BRADLEY, KEN SMITH, DONALD BRINTON, MARY BERENT. Moved by BERENT and seconded by BRADLEY to approve the minutes of the June 21, 1993 meeting as presented. ALL AYE: MOTION CARRIED. PUBLIC HEARING/KESTRAL COVE-Variances Chairman SMITH announced that this was the time and place set for a public hearing on an application for Variances in Kestral Cove Subdivision. Applicant: Mon-Tayne, Inc. % Bill Narver Location: S side of W State St, appro x 600 ft W of Eagle Rd. proposal: a Variance requesting side setbacks from 7 1/2 ft to 5 ft, rear setbacks from 25 ft to 15 ft. Public Testimony: Opposed: Mel Burns and Hal Moss Concerns of the public: does not conform to the comprehensive plan, will not enhance the property and effects property values. Public hearing closed at 7:45 p.m. Discussion by the Commission included the question of affordable housing in this project, the fact this application is before the Commission prior to the subdivision being approved and lack of proof of hardship. Moved by BRINTON and seconded by BERENT to deny the application for a Variance based on ECC 8-7-4-2.A Authority to grant Variances. This application does not meet the necessary hardship provisions of the code. ALL AYE: MOTION CARRIED. PUBLIC HEARING/Seventh Kindergarten - CUP Day Adventist Church-Pre-School/and Chairman SMITH announced that this was the time and place set for a public hearing on an application for a Conditional Use Permit for a pre-school and Kindergarten in the church. Applicant: Location: proposal: Pastor Keith Hansen 538 W. State St., Eagle, Idaho R5, add preschool (3 years old and up), and kindergarten classes existing school (grades more than 26 children. 2 to 3 teachers. 1-8). No Public Testimony: opposition. in favor: Westly Owen,. Mary Ann Li tz . No Public hearing closed at 8:05 p.m. Moved by BRADLEY and seconded by HINMAN to approve the application as presented tonight. ALL AYE: MOTION CARRIED. PUBLIC HEARING/Title 8: Enacting new subsection D of section 8-8-1 Chairman SMITH announced that this was the time and place set for a public hearing on an application for an amendment to Title 8. Discussion included the question of requirement of street signs installed. early starts and the Moved by BRADLEY and seconded by HINMAN to continue the matter in order to identify all aspects of D-l through 4 and establish the intent of the law, this is too vague. ALL AYE: MOTION CARRIED. The Commission wanted to know what policy Boise and Meridian have. The Commissioners also want to review Idaho State Code 50-1326. NEW BUSINESS: Amending Section 7-1A-2: The Commission continued the matter as it is in connection with the proposed amendment to 8-8-1. ADA COUNTY TRANSMITTAL 93-40-CU Hudson: Moved by BRADLEY and ',d3~conded by BERENT to deny the application there is no ~~H~ ~pr9ø9~~~tion present to speak to the transmittal and not enough ýq~Jr' information presented by Ada County to make it clear as to why this ~Ñ should be approved. ALL AYE: MOTION CARRIED. ADA COUNTY TRANSMITTAL 93-38-PDR/93-22-ZC Bighorn: The project was presented by Steve Sweet, Project Engineer. Discussion took place on the possibility of a common area (park), bike lanes, grades of the road, setbacks and environmental concerns. Moved by BERENT to deny due to lack of thorough information on covenants, water, sidewalks, etc. Motion withdrawn. Moved by BRINTON and seconded by BERENT to recommend approval to the Council with the following conditions: SUBDIVISION: 1. All streets are public and require curb, gutter and sidewalk 2. The Eagle Rd. portion of the project require curb, gutter and sidewalk the access to the subdivision contain no more than a 6% grade the project complies with the 1993 Eagle Comprehensive Plan. compliance with Ada County setback regulations 3. 4. 5. 6 an environmental study be required on th~ dump site. ZONING: Moved by BERENT and seconded by HINMAN to recommend a density of no more than 1 unit per 2 acres on this property in order to comply with the 1993 Eagle Comprehensive Plan. ALL AYE: MOTION CARRIED. The City Clerk was asked to forward copies of the staff report on this transmittal to them. They did not receive them. REVIEW OF THE IDAHO DEVELOPMENT IMPACT FEE: The Commission will study the law and discuss it at a later meeting. BRADLEY suggested that the Commission be appointed as the Committee required by law to study this issue. Kelli Blair reported on the activities of the City Council.
