The Eagle Planning and Zoning Commission met in regular session on
June 7, 1993. Chairman SMITH presiding.
The following members were present: PAULINE HINMAN, BERT BRADLEY,
KEN SMITH, DONALD BRINTON, MARY BERENT.
Moved by BRINTON and seconded by BRADLEY to approve the minutes of
the May 17, 1993 meeting as presented. ALL AYE: MOTION CARRIED.
Moved by HINMAN and seconded by BERENT to approve the minutes of
the May 24, 1993 meeting as presented. ALL AYE: MOTION CARRIED.
FINDINGS OF FACT AND CONCLUSION OF LAW: CREIGHTON HEIGHTS
Annexation, Zoning and Subdivision Preliminary Plat: Moved by
BRADLEY and seconded by HINMAN to approve the findings as
presented.

TYPE OF APPLICATION: Subdivision, R5, for 52 single family
dwelling lots. Rezone: the front portion of the property is C2,
the rezone would extend that perimeter 50 ft x 292 ft or 14,600 ft,
appro x 280 ft depth from property frontage. The C2 portion is now
200 ft depth, making the commercial portion of this subdivision a
total of 66,606 sq ft.
LOCATION:
S side of W State St., approx 600 ft W of Eagle Rd
Dave Roylance, the Project Engineer presented the project to the
Commission. He informed the Commission they intended affordable
housing but have no HUD funding. The price range for homes would
be $80,000-$100,000. The plat was modified, as the Commission
directed, to outline the bypass correctly and describe the
commercial lot. They conferred with ACHD regarding the access and
determined the access should be across from the post office.
The entire project will be fenced with a 6' wood fence, with the
exception of the commercial area. They asked for sidewalks on one
side and no park area.
Moved by BRADLEY and seconded by BERENT to approve the rezone to
C2, as requested, but condition approval of the preliminary plat on
the standard conditions of the City of Eagle, sidewalk on both
sides of the street, building a 6' fence, no park will be required.

BOSANKA VILLAGE: PUD/CUP/Rezone and Subdivision Preliminary Plat
(continued from the May 24, 1993 meeting)

TYPE OF APPLICATION: Rezone - R5 to R15
PUD/CUP Preliminary plat - a four lot
subdivision. lots: 2,3,4-residential to be
rezoned. Lot 1 is C2 and is not in the
rezone
LOCATION: 385 W State St, appro x 1200 ft W of Eagle Rd, S side of
Rd.
Mark Guho, an owner in the project outlined the project to the
Commission. Mr. Guho advised the Commission he intends to comply
with ITD and will construct curbs, gutters, and sidewalks on the
State St. portion of the project.
The Commissioners were concerned about the traffic problem and
requested Mr. Guho to furnish the City with a traffic impact study
and consent to purchase a traffic light on State St. when it is
needed. They were also concerned about the validity of this
application as a PUD and questioned whether this project complies
with code (8-6-4) in that the commercial zoning has been
established in the area prior to the application and is therefore
not a part of the PUD. Section 8-6-4.B, C & D read as follows:
B. That the uses are intended to serve principally the residents
of the PUD, And
C. That the uses are planned as an integral part of the PUD
D. That the uses be located and so designed as to provide direct
access to a collector or an arterial street without creating
congestion or traffic hazards.
The code also demands that a minimum of 50% of the residential
development occur prior to the commercial development. Mr. Guho
indicated that the project will be phased over 5 years and the
commercial will be initiated in the final phases.
Moved by HINMAN and seconded by BRADLEY to approve the Bosanka
Village request for a rezone from R5 to R15 and to approve the
preliminary plat for a PUD/CUP, subject to the City standard
subdivision conditions and with the recommendation to Council to
require a traffic study. AYE: HINMAN, BRADLEY, BRINTON. NAY:
BERENT. MOTION CARRIED.
Kelli Blair reported on the activities of the City Council.
There being no further business the meeting adjourned at 9:45 p.m.
