The Eagle Planning and Zoning Commission met in regular session on
May 24, 1993. Chairman SMITH presiding.
The following members were present: PAULINE HINMAN, BERT BRADLEY,
KEN SMITH, DONALD BRINTON, MARY BERENT.
The letter of resignation by Lloyd Gerber has been entered into
record.
PUBLIC HEARING/KESTRAL COVE SUBDIVISION AND REZONE
Chairman SMITH announced that this was the time and place set for
a public hearing on Kestral Cove Subdivision and rezone.
Applicant: Bill Narver, Mon-Tayne, Inc.
Location: S side of W State St, appro x 600 ft W of Eagle Rd
Proposal: to rezone a portion of the property located on the S
perimeter of the property between C2 and R5 to C2. The rezone
would extend that perimeter 50 ft x 292 ft or 14,600 ft, appro x 280
ft depth from property frontage. The C2 portion is now 200 ft
depth, making the commercial portion of this subdivision a total of
66,606 sq. ft.
Steve Bradbury, attorney for Mr. Narver, presented the proposal to
the Commission. Mr. Bradbury requested sidewalks on one side of
the street and variances on the lots. The entire property would be
fenced, berming where necessary, and landscaped. They will have
CC&R's and a homeowner association. They are aware they encroached
in the State of Idaho right-of-way for the alternative route to the
south. They will redesign the lots in question and the cul-de-sac
in order to comply with the right-of-way. The commercial area will
be approximately 1 1/2 acres when rezoned. This subdivision would
be designed for affordable housing. The houses would be in the
$80,000 range.

A survey was submitted for record by Richard Peterson of the Eagle
West Subdivision homeowners. The survey was not accompanied by
signatures.
Concerns of the public:
It is not appropriate in the location
selected. The quality of life will be diminished as this does not
lend itself to a country atmosphere, it is to dense a project, and
environment would be altered by the removal of trees. Any
development in this area should be contingent on the bypass being
completed to eliminate the traffic problem. This project has
drainage problems.
Public hearing closed at 8:35 p.m.
Commission discussion included the right-of-way line on the plat.
There was concern about a plat designed for the younger family that
does not include a park or sidewalks on both sides of the street
where children are going to be an intricate part of the
subdivision. The access should align with the King's Dept store
access. The plat needs to be redesigned and in final form for
consideration of the Commission.
Moved by BRADLEY and seconded by HINMAN to continue the matter
until the June 7, 1993, P&Z hearing, in order to give the project
engineer time to redesign the plat with the correct alternate route
right-of-way, confer with ACHD about the alignment to entrance, and
return it, in final form, to the Commission. ALL AYE: MOTION
CARRIED.
PUBLIC HEARING/BOSANKA VILLAGE SUBDIVISION - PRELIMINARY PLAT,
REZONE, PUD/CUP
Chairman SMITH announced that this was the time and place set for
a public hearing on Bosanka Subdivision and rezone from R5 to R15.
Applicant: Mark N. and Nick J. Guho
Location: 385 W State St., approx 1200 ft W of Eagle Rd
Proposal: 108 apartments on 7.6 acres. The C2 portion of the
property will remain C2, the remainder of the project will be
rezoned from R5 to Rl5. This is phased over 36 months. The
amenities include: gazebos, arbors, paddle tennis courts,
barbecues, a club house, laundry and play areas.
Mark Guho, developer of the project, presented the proposal to the
Commission. Mr. Guho indicated there would be 112 units. The
project design will comply with ECC for density and parking areas.
Each unit will have 1.75 parking spaces. The project will have an
ACHD designed street with curb, gutters and sidewalks. This
entrance will align with Cobblestone St. They will comply with the
setbacks of the City of Eagle and they will ask for no variances.
He volunteered to meet with the homeowners on Harlan Place to
discuss their concerns.

Concerns of the public: The quality of life will be diminished as
this does not lend itself to a country atmosphere, it is to dense
a project, and will create a congested neighborhood, family
problems in an apartment atmosphere and a need to increase law
enforcement. It will only add to the traffic impact problems. Any
development in this area should be contingent on the bypass being
completed to eliminate the traffic problem.
Commission discussion included: concern about the turn-a-round
area for emergency vehicle access, landscaping on the southern
border of the subdivision where the bypass will be, there are no
playgrounds, setbacks to the RV part of the project, a "safe" walk
for children in the area, only one access. Other concerns were the
subdivision does not meet the criteria of ECC 8-6-4 B.C.. There
are no plans in this PUD for the commercial requirements.
The public hearing closed at 9:20 p.m.
Moved by BRINTON and seconded by HINMAN to continue the matter
until the June 7,1993 P&Z meeting on the basis that the Commission
needs to review the layout of the project, and clarification needs
to be submitted to the City on Fire protection, sewer and water
requirements. We need an outline of the density per lot and
parking spaces within those lots. ALL AYE: MOTION CARRIED.
