May 17,1993
The Eagle Planning and Zoning Commission met in regular session on
May 17, 1993. Chairman SMITH presiding.
The following members were present: BERT BRADLEY, KEN SMITH,
DONALD BRINTON, MARY BERENT. Absent: LLOYD GERBER, PAULINE
HINMAN.
Moved by BRINTON and seconded by BRADLEY to approve the minutes of
the May 3, 1993 meeting as presented. ALL AYE: MOTION CARRIED.
PUBLICHEARING/CREIGHTONHEIGHTS-ANNEXATION,ZONING,SUBDIVISIONPLAT
Chairman SMITH announced that this was the time and place set for
a public hearing on Creighton Heights.

proposal: Annexation, zoning to Rl, subdivision plat for a 10
lot subdivision on 24.41 acres. The entire annexed area 68.73.
The remaining portion (44.32 acres will remain in agricultural
production) .

Approx 1/2 Mi. E. of N. Meridian Rd & 1/2 Mi. N. of
presented by: Becky Bowcutt, Project planner from Briggs
Engineering. Ms. Bowcutt informed the Commission that the lots
would be an average 2.41 acres. The street would be provided by an
extension of Clearview Dr., ending up in a cul de sac. ACHD will
not require curb, gutter and sidewalks in this development because
of the rural nature of this subdivision and Clearview Dr. does not
have curb, gutter and sidewalk. The developer will be stripping a
pathway along the sides of the road. There will be a 30 ft
dedication along the W boundary of the subdivision. They are
asking for a waiver on the requirement for street lights from the
City of Eagle. There will be landscaping to the entrance. The
land under the bench will remain agricultural as it has limited
access.

Concerns of the public. The septic system should require a study in
order to create a central system, well contamination, environmental
questions dealing with the wildlife in the area, density, and
traffic.
Public hearing closed at 8:30 p.m.
Moved by BRADLEY and seconded by BERENT to approve the annexation,
zoning of R1 and the subdivision plat with the following
conditions:
1. subject to the standard conditions of approval;
2. there be required a deposit with the City, for future use,
street light funds;
3. approve the waiver of compliance on the length of the cul-de-
sac;
4. the slope is not be disturbed in any way, there will be erosion
control.
ALL AYE:
MOTION CARRIED.
PUBLIC HEARING: LA RUE SUBDIVISION-PUD/CUP/Rezone/variance/
Subdivision Preliminary Plat
Moved by BRINTON and seconded by BRADLEY to table this issue until
such time as it can be re-noticed in compliance with proper notice
and procedures as mandated by state law. This property has not
been posted. ALL AYE: MOTION CARRIED.
UNFINISHED BUSINESS:
FINDINGS OF FACTS AND CONCLUSIONS OF LAW:
Irish Daycare/CUP: Moved by BERENT and seconded by BRADLEY to
approve the findings as presented.
Roberts Square/CUP: Moved by BRINTON and seconded by BERENT to
approve the findings as presented.
Melvins Eagle point #7/annexation, and preliminary plat: Moved by
BRADLEY and seconded by BRINTON to approve the findings as
presented.

MOTION CARRIED.
ADA COUNTY TRANSMITTAL 93-22-PDR:
Baxterville Subdivision:
Dick Fisher represented O. Dudley for a 5 acre split on the
Southern section on the property. The transmittal should read SE
not NE. Moved by BERENT and seconded by BRADLEY to approve as
presented. ALL AYE: MOTION CARRIED.
Policy on Procedures of Public Hearings: The procedures have been
reviewed by the Commissioners. The City Clerk suggested an
addition that if anyone submits a document to P&Z that document
must also be presented to the city Clerk for permanent record.
with that change there was a motion by BRINTON and seconded by
BERENT to accept this and forward to Council via Council member
Kelli Blair for their review.

Kelli Blair reported on the activities of the City Council.
