EAGLE PLANNING AND ZONING MEETING
December 7, 1992
The Eagle Planning and zoning Commission met in regular session on
December 7, 1992. Chairman GERBER presiding.
The following members were present: LLOYD GERBER, BERT BRADLEY,
KEN SMITH, DONALD BRINTON, MARY BERENT. Absent: PAULINE HINMAN.
Moved by SMITH and seconded by BRINTON to approve the minutes of
the November 2, 1992 meeting as presented. ALL AYE: MOTION
CARRIED.
PUBLIC HEARING/LOT SPLIT-ORDINANCE '213
Chairman GERBER announced that this was the time and place set for
a public hearing on an amendment to Title 9, regarding lot splits,
requiring approval from City Council, Ordinance 213.
Applicant: City of Eagle
Proposal: require an application process in order to split a lot
Public Testimony: none
Public hearing closed at 7:45 p.m.
Moved by SMITH and seconded by BRADLEY that consideration be given
on this amendment to Title 9 to omit the Council approval and the
application be approved by Barbara Montgomery as Zoning
Administrator. ALL AYE: MOTION CARRIED.
PUBLIC HEARING/LONGSON TOWNHOMES/PUD/CUP
Chairman GERBER announced that this was the time and place set for
a public hearing on Longson Townhomes.
Applicant: Larry Van Hees
Location: 1.5 miles S of Floating Feather on W side Eagle Rd
Proposal: Subdivision preliminary plat, PUD/CUP 29 lot townhomes
on 5 acres. R5
Public Testimony: Inquiries: Danny Allen and Keith Allen
Presentation by Dave Roylance. Mr. Roylance explained the project
as having central sewer and water. There is a sewer problem at
this time and water has not been approved. All 3 streets in the
subdivision are ACHD dedicated streets. There is a portion of the
property in the flood plain, but will not build in that area. The
townhomes will be sold individually and the common areas owned by
the homeowners association. They will provide the proper city
setbacks. Each unit will have a 2 car garage. The units will be
2 story. The rim lots will provide garages under the homes, the
remainder of the townhomes will provide garages beside the units.
Each unit will be 1400-1600 sq. ft.
The P&Z had concerns about a pathway on the N. side of the project
and want a right of way for a pathway.
Concerns of the public: the drainage and irrigation.
Public hearing closed at 8:15 p.m.
Moved by SMITH and seconded by BRADLEY to continue the hearing
until January 4, 1993 in order to give the P&Z Commissioners time
to study plans and be provided answers on water and sewer, access
on the eastern road, density and an architectural plan of the
entire development. ALL AYE: MOTION CARRIED.
PUBLIC HEARING/MELVINS EAGLE POINT '6
Chairman GERBER announced that this was the time and place set for
a public hearing on Melvins Eagle Point '6.
Applicant: Max Boesiger, Inc.
Location: E of N Edgewood and S of floating Feather, adjacent to
Melvins Eagle Point '3
Proposal: Subdivision preliminary plat,phase 6 of Melvins Eagle
Point, E side of Edgewood, consisting of 20 lots (19 buildable and
1 common lot)

subdivision to the Commissioners.
She outlined the
Public Testimony: none.
The hearing closed at 8:40 p.m.
Discussion of the Commissioners included proposal of a new road
design, eliminating lot 7 and designing the entrance through that
lot rather than to the N as the design indicates. The cuI de sac
would have 2 turn around points, one to the N (lot 25) and the one
indicated in the present design. The common lot would become, in
part, lot 25.
The Commissioners challenged the easement proposed by Farmers Union
District of 15 feet. They would like to see a pathway along the
canal. The Commission believes the district may not have exclusive
rights to the easement and a pathway can be established in the same
easement. The Commissioners would like a legal opinion on this
concept.
Moved by BRADLEY and seconded by BERENT to deny this project based
on the concept and length of the cuI de sac, the lack of the
completion of the Eagle Water Co. hydralic water analysis. If the
application on this project comes back to P&Z the attorney should
review the rights of way (easement of 15 ft.) in order to establish
a pathway along the canal. ALL AYE: MOTION CARRIED.
NEW BUSINESS:
Ada County Transmittal: 92-52-PDR/92-37-PR/92-20-ZC (Washum
Sub/Phil Whitner): Presentation by Phil Whitner for the project.
Moved by BRADLEY and seconded by BRINTON to recommend approval as
presented.
Presentation by Dick Critser of ITD regarding a state gravel
permit. They are asking the city for guidance on the problem of
extracting in the area. They need to remove pit run material, take
excess, remove it, aggregate, use it and come back with soil and
reclaim it as useable ground, then sell it. They want public input
and the city support in order to complete the project. They will
establish further meetings in the future.
