EAGLE PLANNING AND ZONING MEETING
October 5, 1992
The Eagle Planning and Zoning Commission met in regular session on
October 5, 1992. Chairman GERBER presiding.
The following members were present: LLOYD GERBER, LOGAN BENNETT,
PAULINE HINMAN, KEN SMITH, DONALD BRINTON. Absent: BERT BRADLEY
Moved by HINMAN and seconded by SMITH to approve the minutes of the
September 21, 1992 meeting with corrections as follows: Page 1,
last paragraph the word "mean" should be "meet", page 2, the second
public hearing the work "Ski" in the title Great Sky Estates should
be "Sky". ALL AYE: MOTION CARRIED.
UNFINISHED BUSINESS:
Findings of Fact and Conclusions of Law/ Kings Dept Store-CUP.
Moved by SMITH and seconded by HINMAN to approve the findings and
conclusions as presented. ALL AYE: MOTION CARRIED.
Findings of Fact and Conclusions of Law/ Great Sky Estates-rezone
and preliminary plat. Moved by SMITH and seconded by BENNETT to
approve the findings and conclusions with the exclusion to the
reference to Mace Rd. ALL AYE: MOTION CARRIED.
Findings of Fact and Conclusions of Law/ Eagle Wing Development-
rezone. Moved by SMITH and seconded by HINMAN to approve the
findings and conclusions as presented. ALL AYE: MOTION CARRIED.
PUBLIC HEARING/Ray Dowding-Conditional Use Permit
Chairman GERBER announced that this was the time and place set for
a public hearing on a Conditional Use Permit to allow a day care
center.
Applicant: Ray Dowding
Location: Eagle Glen Lane, Eagle
Proposal: to allow a day care center
Mr. Dowding spoke to the Commission advising them that when he
applied for the permit he had a buyer in mind. That option is no
longer valid but he would like to have the permit in order to
advertise to sell it as a location that would permit a day care
center. Mr. Dowding feels the location is appropriate for the use.

Opposed:
Tim Gass-objects to the use as it is inappropriate to ask for the
use without a client in mind. Mr. Gass also opposes the use
because of the traffic on a private road and danger to the children
because of the traffic. Additional traffic on the road would put
a burden on the road. There is a liability risk.
Public hearing closed at 7:55 p.m.
Moved by SMITH and seconded by HINMAN to deny the CUP without
prejudice due to concerns of the layout of the area for parking,
fencing, playground and access to the private road. The Commission
would be sympathetic to the plan if proper plans were submitted at
a later date. ALL AYE: MOTION CARRIED.
The Commission asked for a Council report from Barbara Montgomery,
Eagle City Clerk, and wanted her to advise the Council there is a
