Minutes - 1991 - Planning & Zoning - 10/21/1991 - Regular EAGLE PLANNING AND ZONING MEETING October 21, 1991 The Eagle Planning and Zoning Commission met in regular session on October 21, 1991. Chairman EASON presiding. The following members were present: HINMAN. Absent: MCPEAK, BENNETT. LLOYD GERBER, PAULINE Moved by GERBER and seconded by HINMAN to approve the minutes of the October 7, 1991 meeting as presented. ALL AYE: MOTION CARRIED. PUBLIC HEARING/Smith-CUP application Chairman EASON announced that this was the time and place set for a public hearing on the Minnie Smith conditional use application. Applicant: Minnie Smith, representative vaughn Smith Location: 64 N. First St., Eagle proposal: place a mobile home on a order to care for elderly parent. of the mobile home once the need is single family dwelling lot in The proposal includes removal not there. Public Testimony: letter of opposition by M.R. Mohr, and letter of support received by Irene Gunderson. Public hearing closed at 7:40 p.m. Moved by GERBER and seconded by HINMAN to recommend denial of the application based on the inappropriate place for a mobile home on a single family dwelling lot, safety and fire hazard, not a type of density that should be in that area, does not meet the Comprehensive Plan. ALL AYE: MOTION CARRIED. PUBLIC HEARING/Beaver Mobile Home Park Chairman EASON announced that this was the time and place set for a public hearing on the Rex Beaver application for a mobile home park in Randall Acres Subdivision. Applicant: Rex & Jolene Beaver Location: 7141 Hill Rd., Boise proposal: an application for a mobile home park a 6 acre lot, 8 mobile homes meeting the R5 density, 1/5 acre per trailer, used now as a single mobile home. The park will have a privacy fence around it, berms and will be pave. All mobile homes will be owned by the Beavers. There will be no mobile home older than 1978, would be an increase in traffic but will improve the appearance of the area. The units will use one (1) well. Public Testimony: letter of opposition by Garry Carroll. Public hearing closed at 8:00 p.m. Moved by GERBER and seconded by HINMAN to recommend denial of the application based on a violation of Section 8-3-5, Eagle City Code-trailer parks restricted to 5 acre minimum, the Comprehensive Plan which calls for central water for the density and the mobile home park is out of place and not consistent with intent of the subdivision. ALL AYE: MOTION CARRIED. PUBLIC HEARING/Trail" Creek/Echo Creek Preliminary plat, phase 2. Chairman EASON announced that this was the time and place set for a public hearing on the Echo Creek/Trail Creek Subdivision Preliminary plat, phase 2. Applicant: Bill Guhrke, Treasure Valley Village Ltd. Location: Northwest corner of Highway 55 and Floating Feather Rd. proposal: A preliminary plat for 113 acres, density 2.89, phase 2, zone R5. 315 lots total, 2 fire station lot, 304 residential lots, 3 park sites and common areas. A rezone of the NW corner of existing highway 55 and floating Feather Rd. from C3 to R5. Narrative of the entire proposal presented to the Commission. Public Testimony: no opposition In Favor: Phil Barber Bill Guhrke Todd Schaefer Bert Bradley Dennis Whitmore Public hearing closed at 9:10 p.m. Moved by HINMAN and seconded by GERBER to recommend approval of the application subject to working out an agreement with the sewer district and that information be presented to Council, there should be a loop to the road the N.W side of Fall Water Way, and rezone take place from C3 to R5. ALL AYE: MOTION CARRIED. NEW BUSINESS: Ada County Transmittals: Ashbury Park/90-45-PDR Moved by GERBER and seconded by HINMAN to recommend approval of the Ada County Transmittal as presented. ALL AYE: MOTION CARRIED. UNFINISHED BUSINESS: Findings of Fact and Conclusions of Law/ Marvin Subdivision. Moved by GERBER and seconded by HINMAN to approve the findings and conclusions as presented. ALL AYE: MOTION CARRIED. Findings of Fact and Conclusions of Law/ Rezone Prime Earth- Dowding. Moved by GERBER and seconded by EASON to approve the findings and conclusions as presented. ALL AYE: MOTION CARRIED. Findings of Fact and Conclusions of Law/ Melvins Eagle Point Subdivision. Moved by GERBER and seconded by HINMAN to approve the findings and conclusions as presented.
