Minutes - 1991 - Planning & Zoning - 07/15/1991 - Regular EAGLE PLANNING AND ZONING MEETING JULY 15, 1991 The Eagle Planning and Zoning Commission met in regular session on July 15, 1991. Chairman EASON presiding. The following members were present: KATHRYN MCPEAK, PAULINE HINMAN. LLOYD GERBER, LOGAN BENNETT, Moved by GERBER and seconded by MCPEA$ to approve the minutes of the June 3, 1991 meeting as presented. ALL AYE: MOTION CARRIED. UNFINISHED BUSINESS: Findings of Fact and Conclusions of Law/ DOWDING. Moved by MCPEAK and seconded by GERBER to approve the findings and conclusions as presented. ALL AYE: MOTION CARRIED. PUBLIC HEARING/PRIME EARTH, ZONING M3 Chairman EASON announced that this was the time and place set for a public hearing on Prime Earth, zoning proposal of M3. This meeting is a result of the M3 zoning being challenged. This area is part of the "Annexations-Highway 55", that were finalized June 12, 1990. The property was known as "Eagle Land Co", at the time of annexation. Proposal: By Carlyle Briggs, Representative of Prime Earth, to zone the site M3 for the purpose of a gravel pit. Mr. Briggs presented 4 drawings to the Commissioners. (in records listed as Exhibits A-D) Lynne Belnap, Attorney for Prime Earth advised the public that the land intended use was to remove the gravel and later establish a subdivision. Public Testimony: Opposed: Daryl Tague Lynne Martin Chris Koomler Edsel Martin In Favor: Lyman Belnap Carlyle Briggs Ric Bechtolt Neutral Ray Dowding Scott Gurnsey Concerns of the public: the bonding, and permits for the pit, reclamation plans, trash in the area, property values of gravel pit next to a residential area, danger for children, no fences in the area, lack of notification of the public, lack of control, noise, & dust. Public hearing closed at 8:35 p.m. Moved by GERBER and seconded by HINMAN to continue the public hearing until August 5, 1991 for additional information to be given to the City Clerk by Friday of this week in order to submit to P&Z for review in a timely manner. That information includes: the non-conforming permits from Ada County on the pit, the proof of bonding, and reclamation plan.
