Minutes - 1991 - Planning & Zoning - 01/07/1991 - Regular EAGLE PLANNING AND ZONING MEETING JANUARY 7, 1991 The Eagle Planning and Zoning Commission met in regular session on January 7, 1991. Chairman EASON presiding. The following members were present: KEN TEWKSBURY, LLOYD GERBER, KATHRYN MCPEAK. Absent: LOGAN BENNETT, PAULINE HINMAN. Moved by GERBER and seconded by TEWKSBURY to approve the minutes of the December 17, 1990 meeting as presented. ALL AYE: MOTION CARRIED. PUBLIC HEARING/Creeks End Subdivision (continued) Chairman EASON announced that this was the time and place set for a public hearing on Creeks End Subdivision. W. R. Guhrke NW corner of Highway 55 and Floating Feather Rd. 308 single family dwelling lots on 106.54 acres in a R5 zone Public Testimony: Opposed: none. Testimony by Phil Barber included a report on the following: Applicant: Location: Proposal: Philip Barber, Carlyle Briggs in favor. Highway: because of the uncertainty of the highway running through the property the subdivision needs to be separated into 2 parts. The first subdivision would be the S.W. portion of the property, that portion will not be in the path of the new Highway 55 alternative route, this would be submitted as a preliminary plat, to P&Z on Feb 4 for public hearing. Water study: Submitted a preliminary study from BSU. There will be no formal study as BSU does not have the financing to complete the study. The Dept. of Water Resources is the safeguard for this kind of project. In 1987 the department granted permit 63-10373, with the condition that there be no interference with water already in the area, and that it would be monitored for years in order to safeguard the conditions of the permit. The developers of Creeks End would invite Water Resources to impose the same conditions now. However, the most efficient route for water would be a joint venture with Floating Feather Hills development. That is being negotiated now. They do have a letter from Ray Dowdy permitting them to drill on his property for a well site. The study indicates that there are two aquifers, they will drill to see if there is a significate water change on either side of the aquifer. Zoning: The commercial zone on S.E. portion of the property may have to be changed due to the highway change. Right now it is ----------- - - ------ -u --- ------ - ------- best to leave it as is until it is known where the highway will be, and deal with it at that time. Drainage: They do have previous approval for drainage from ACHD, they expect the same conditions. The expense at this time would have been to great to obtain. However, with the change from one subdivision plat to two, they will go to ACHD and submit a drainage proposal. Name change: They will choose another name, they have not done so at this time. CuI de sacs: Some were over the 500 ft. limitation. There will be a change in the next preliminary plat to conform to Eagle's ordinance. Mr. Barber requested the public hearing be tabled until a new public hearing can be established for a new proposal. He asked that this issue not be withdrawn until the new application has been filed, but will withdraw the appeal at that time. Public hearing closed at 9:00 p.m. Moved by GERBER and seconded by TEWKSBURY to table this application until February 4. ALL AYE: MOTION CARRIED. NEW BUSINESS: Election of officers: Moved by GERBER and s~conded by MCPEAK to retain the officers we now have. ALL AYE: MOTION CARRIED. ADA COUNTY TRANSMITTAL 90-65-CU/SORGE: Moved by TEWKSBURY and seconded by GERBER to send to Council with no recommendation. ALL AYE: MOTION CARRIED. ADA COUNTY TRANSMITTAL 90-66-CU/PURDY: NOT IN OUR IMPACT AREA. ADA COUNTY TRANSMITTAL 90-68-PDR/NEWTON: Moved by TEWKSBURY and seconded GERBER to recommend approval with the condition that the road be a public road and not a private road. ALL AYE: MOTION CARRIED. Chairman EASON declared it was the time and the place for a public hearing ~garding private roo within the i~act area being permitted with the same restrictions imposed by the county. There was no public testimony, closing the public hearing at 9:15 p.m. Moved by TEWKSBURY and seconded by MCPEAK to continue the public hearing until January 28. Sewer discuSsion resulted in further information needed on a master plan within the impact area. Planning and Zoning was informed that they would be hearing a formal application for a change to the comprehensive plan --- --------------------- - -------------- submitted prior to the date required in the amendment clause of the plan.
