EAGLE PLANNING AND ZONING MEETING
December 3,1990
The Eagle Planning and Zoning Commission met in regular session
on December 3, 1990. Chairman EASON presiding.
The following members were present:
BENNETT, KATHRYN MCPEAK, PAULINE HINMAN.
KEN TEWKSBURY, LOGAN
Absent: LLOYD GERBER.
Moved by TEWKSBURY and seconded by MCPEAK to approve the minutes
of the November 19, 1990 meeting as presented. ALL AYE: MOTION
CARRIED.
PUBLIC HEARING/CREEKS END SUBDIVISION:
Chairman EASON announced that this was the time and place set for
a public hearing on Creeks End Subdivision.

NW corner of Highway 55 & Floating Feather Rd.
308 single family dwelling lot on 106.54 acres in a
R-5 zone, 8.46 acres commercial C-3. Will be served
by sewer and water through an association later
turned over to the city. Density of development
approximately 3 units per acre. Plans include
traffic circulation, and a fire station site.

CONCERNS:
The subdivision is too far out, isolated from the city, there
would be increased traffic, and water problems. There were
questions regarding water and sewer easements being secured.
Drainage to dry creek was questioned, as it was stated, ACHD does
not allow drainage in a rightaway. ITD representative informed
the Commission that there will be public hearings on the Highway
55 alternative route in January or February. One of the
alternatives may be an alignment through the subdivision. He
asked for a continuation until those public hearings could be
held. Mr. Briggs informed the Commission that there is a study
underway with the Dept. of Water Resources and BSU on the water
issue, and that the Eagle Sewer District has committed 455 units
to the project.
Public hearing closed at 8:30 p.m.
Moved by TEWKSBURY and seconded by HINMAN to continue the public
hearing until March 4, 1991, pfter the ITD public hearings, or
sooner if the Highway public hearings have been completed, with
the following requirements:
1. Highway route question answered
2. Water study completed
3. Sewer concerns answered
4. Rezone the C3 to R5
5. Drainage questions answered.
6. Subdivision renamed
ALL AYE:
MOTION CARRIED.
NEW BUSINESS:
Ada County Transmittals: 90-22 MIDDLETON:
Moved by TEWKSBURY and seconded by HINMAN to recommend approval
Ada County Transmittal-Middleton as presented as a temporary
structure. ALL AYE: MOTION CARRIED.
Ada County Code Amendment: Title 8, RADIO TOWERS
Moved by MCPEAK and seconded by BENNETT to recommend approval of
the amendment. ALL AYE: MOTION CARRIED.
UNFINISHED BUSINESS:
Findings of Fact and Conclusions of Law/ Higgins-CUP: Moved by
HINMAN and seconded by MCPEAK to approve the findings and
conclusions as presented. ALL AYE: MOTION CARRIED.
There being no further business the meeting adjourned at 9:30
p.m.
