Minutes - 1990 - Planning & Zoning - 10/15/1990 - Regular EAGLE PLANNING AND ZONING MEETING OCTOBER 15, 1990 The Eagle Planning and Zoning Commission met in regular session on October 15, 1990. Vice Chairman TEWKSBURY presiding in Chairman EASON'S absence. The following members were present: KEN TEWKSBURY, LLOYD GERBER, LOGAN BENNETT AND KATHRYN MCPEAK. Moved by GERBER and seconded by BENNETT TO approve the minutes of October 1, 1990 with the following changes: Ada County Transmittal: 90-53-PDR/McEnroe: Add 5. There will be and extension of the road when and if they continue the subdivison. ALL AYE: MOTION CARRIED. PUBLIC HEARING/HIGGINS CONDITIONAL USE PERMIT Vice Chairman TEWKSBURY announced that this was the time and place set for a public hearing on Higgins Condition Use Permit for a mobile home in a residential zone. Applicant: Location: Proposal: patricia Higgins 2382 Syringa, Corner of Parkinson and Syringa Conditional Use Permit to put a mobile home on a single family dwelling. Public Testimony: No opposition. In Favor: Mr. & Mrs. Higgins Public Hearing Closed at 7:45 p.m. Moved by Gerber and seconded by McPeak to recomend approval with the following conditions: 1. Must hookup to Central Sewer 2. CUP will be limited to the time that relatives will by living in the mobile home. ALL AYE: MOTION CARRIED. PUBLIC HEARING/ POPE AIKENS REZONE/VARIANCE: Vice Chairman TEWKSBURY announced that this was the time and place set for a Public Hearing on a rezone and variance. Applicant: Location: Proposal: Lyle Pope East of 1st st. Behind Eagle FoodTown Rezone from R-5 to R-16-multi-unit residences 3 four plex units, variance 10 ft. set back on East side instead of 25 ft. East and West Side of long lot 7.5 ft. from 20 ft. setback. Public Testimony: Opposed: Mr. and Mrs. Donald Fisher Mr. and Mrs. L.A. Parks Property Value will be reduced Dust from traffic Congestion of people and pets Two story buildings would ruin the Not adequate room for parking Complaints: view In Favor: Lyle Pope Lois Bolin Public Hearing Closed for discussion at 8:15 p.m. Moved in to North East South West and a by GERBER and seconded by BENNETT to split the application two parts and recomend approval of lot 6 with variances of 10 ft 15 ft 10 ft 20 ft rezone to R-16. Recomend approval of lots 4 & 5 for a Rezone to R-16 and no variance. With these conditions: 1. Aikens will be maintained by ACHD and considered a public road. 2. Fire Hydrants and Water lines must be accordance with Eagle fire districts recomendation. ALL AYE. MOTION CARRIED Moved by Gerber and seconded by MCPEAK to approve the Findings of Fact Conclusions of Law/Eagle United Methodist Church/CUP as presented. ALL AYE.
