EAGLE PLANNING AND ZONING MEETING
JUNE 4,1990
The Eagle Planning and Zoning Commission met in regular session
on June 4, 1990. Chairman EASON presiding.
The following members were present:
GERBER, LOGAN BENNETT.
KEN TEWKSBURY, LLOYD
Moved by TEWKSBURY and secondeq by BENNETT to approve the minutes
of the May 2, 1990 meeting as presented. ALL AYE: MOTION
CARRIED.
PUBLIC HEARING/CUP-AUTO BODY SHOP/LES CULLEN:
Chairman EASON announced that this was the time and place set for
a public hearing on a proposal to establish an auto body shop in
a CBD zone using the nonconforming clause/conditional use.
Applicant: Les Cullen/Fabco Manufacturing
Location: 161 - 163 N. Eagle Rd. (Jackson Sub)
Proposal: To establish an auto body shop in the CBD zone a
prohibited use under Section 8-2-3, by using Section 8-5-2
Nonconforming uses.

Opposition cited: Concerns regarding noise, fumes, excess
parking, appearance of property working hours and compatibility
with the neighborhood.
Public hearing closed at 8:20 p.m.
Mov~d by GERBER and seconded by TEWKSBURY to recommend to Council
denial of the application based on the incompatibility with the
neighborhood and desirability to that kind of business in the
central business district zone. Also the fact that the
restrictions placed on them by the nonconforming use section of
the code would be to restrictive to comply with in the future.
ALL AYE: MOTION CARRIED.
PUBLIC HEARING/EMPIRE ESTATES SUBDIVISION:
Chairman EASON announced that this was the time and place set for
a public hearing on a proposal to establish a subdivision
proposal for 28 single family dwelling lots.
Testimony:
Victor Johnson
Edgewood Lane, N. of State St. (behind restaurant)
To establish a 28 single family dwelling lots
on 10.84 acres, zoned R5. proposal includes using
41r~ Ry4FðR~, single family wells and central
sewer. All streets in conformance to ACHD
regulations.
Favorable testimony received from Victor Johnson and
J. Howard, Engineer for the project, no opposition.

Moved by TEWKSBURY and seconded by BENNETT to continue the public
hearing until the next scheduled P&Z meeting, June ~h in order
to give the applicant enough time to answer a question about the
water on the site. The applicant was asked to provide the
commission with quotes as to the cost for a central well rather
than single wells. The meeting is continued contingent to the
annexation ordinance passing. ALL AYE: MOTION CARRIED.
NEW BUSINESS:
Ada County Transmittals: 90-24-PDR-90-04-ZC/Ranch Estates:
Moved by TEWKSBURY and seconded by BENNETT to deny said Ada
County Transmittal as presented based on the fact that the City
of Eagle does not approve of the density factor in the impact
area. ALL AYE: MOTION CARRIED.
UNFINISHED BUSINESS:
Findings of Fact and Conclusions of Law/Carson: Moved by
TEWKSBURY and seconded by GERBER to approve the findings as
presented. ALL AYE: MOTION CARRIED.
Findings of Fact and Conclusions of Law/Jensen: Moved by GERBER
and seconded by TEWKSBURY to approve as presented. ALL AYE:
MOTION CARRIED.
There being no further business the meeting adjourned at 9:15
p.m.
