EAGLE PLANNING AND ZONING COMMISSION
MINUTES OF THE JANUARY 22,1990 MEETING
The Eagle Planning and Zoning Commission met in regular session
on January 15, 1990 at 7:30 p.m. Chairman SINCLAIR presiding.
Roll call showed the following members present:
BENNETT, GERBER, TEWKSBURY.
Moved by GERBER and seconded by EASON to approve the minutes of
the January 15, 1990 meeting. ALL AYE: MOTION CARRIED.

PUBLIC HEARING:
LOBDELL REZONE FROM A TO R5
No public testimony was given.
Applicant, JoAnne Lobdell presented a proposal to change the zone
from A to R5 for future development purposes. There are no plans
in the near future to develop. The property boarders the Eagle
Island State Park, access is Mace Road. Future development would
provide for 2 to 5 acres per lot.
Public hearing closed and discussion by commission included the
transmittal from the Sewer District requesting denial of the
rezone, the flood plain criteria, in that the property is in the
floodway, and the Mace Road conditions. EASON proposed that it
contradicted the Eagle Comprehensive Plan, page 20, "all new
subdivisions, with densities of more than 3 single family
dwelling unit per 5 acres shall be required to be connected to a
central sewer system and central water facility". SINCLAIR noted
Eagle Code Title 9, section 1-3 (E), "avoidance of the scattered
subdivision of land that would result in the lack of water or
sewer service".
Moved by TEWKSBURY and seconded by GERBER based on the inability
to obtain Eagle Sewer District service and road conditions the
recommend denial of this rezone. ALL AYE: MOTION CARRIED.
TITLE 8/SET BACK REQUIREMENTS: Discussion took place regarding
changing the set back regulations was deferred until the city
engineer can be at the meeting and the opinion of the fire
district can be obtained 'by YZAGUIRRE. Rescheduled for
discussion at the next Planning and Zoning meeting.
There was no testimony in opposition.
The meeting adjourned at 8:35 p.m.
