CALL TO ORDER: Meeting called to order at 6:09 P.M.
2. ROLL CALL: Present: WRIGHT, JOHNSON, and MCLAUGHLIN. Absent: GUERBER and
SMITH. A quorum is present.
CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will
be no separate discussion on these items unless the Chairman, a Commissioner, member of City
Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items
removed from the Consent Agenda will be placed on the Regular Agenda in a sequence
determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle
shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval
motion unless specifically stated otherwise.
A. Minutes of August 6, 2018.
B. Findings of Fact & Conclusions of Law for PP -05-18 — Woodcreek Estates Subdivision —
SMKM, LLC: SKMK, LLC, represented by Wendy Shrief with J -U -B Engineers, Inc., is
requesting preliminary plat approval for Woodcreek Estates Subdivision, a 9 -lot (6 -buildable, 3 -
common) residential subdivision. The 4.03 -acre parcel is located at the terminus of West
Enchantment Street, North Cobblestone Lane, and North Cobblestone Way at 489 North
Cobblestone Lane.
Johnson moves to approve the consent agenda. Seconded by McLaughlin. ALL AYES...
MOTION CARRIES.
Commissioner Smith joins the meeting at 6:10 P.M.
4. UNFINISHED BUSINESS: NONE
PUBLIC HEARINGS:
A. ACTION ITEM: RZ-04-18 & PP -03-18 — Bellemeade Subdivision — Madera Development,
Inc.: Madera Development, Inc., represented by Tamara Thompson with The Land Group, Inc.,
is requesting a rezone with development agreement (in lieu of a PUD), and preliminary plat
approvals for Bellemeade Subdivision, an 80 -lot (73 -residential, 7 -common) residential
subdivision. The 10.99 -acre site is located on the north side of West Flint drive at the northeast
corner of West Flint Drive and North Park Lane at 3850 West Flint Drive and 312 North Park
Lane.
Tamara Thompson, The Land Group, 462 East Shore Drive, Suite 100. The applicant's
representative provides a brief overview of the application.

City Planner, Mike Williams, provides a detailed overview of the application.

Marc Hamilton, 3660 West Flint Drive. Hamilton supports the application based upon the fact that
three-story apartments are not proposed on the site, but opposes the application due to the density
that will border his property. Hamilton inquires about pressurized irrigation and
Gina Roth, 4490 West Cardon Street. Roth expresses concerns about the application due to
overcrowding of local schools and traffic in the surrounding area, and would like to see the 5,000
square -foot minimum lot size for the MU zone upheld.
Roth responds to questions from the Commission.
Skye Hamilton, 3660 West Flint Drive. Hamilton appreciates that apartments are not proposed as
part of the application, expresses concerns about current traffic conditions in the surrounding area,
and expresses a desire to see lower density abutting her property line.
Kim Washburn, 3855 West Flint Drive. Washburn inquires about density and the relation to
property prices.
Tamara Thompson, the applicant's representative, provides rebuttal and responds to concerns raised
during the Public Hearing.
Thompson responds to questions from the Commission.
Tom Ricks, the property owner, speaking on behalf of the developer. Ricks explains the concept of
the development and the target audience, explains irrigation in the area and the history of the site.
Chairman Wright closes the Public Hearing.
General discussion amongst the Commission.
City Planner, Mike Williams, responds to questions from the Commission.
Johnson moves to recommend for approval item 5A RZ-04-18 & PP -03-18 — Bellemeade
Subdivision — Madera Development Inc., with the following changes to the site specific
conditions: of the rezone, to change item 3.4 the front setback to be 25 -feet from back of
sidewalk.
Discussion about measuring the setback from the property line or back of sidewalk.
Johnson: Okay, 31 -feet for the front setback (measured from property line), street side setback
for the garage to 31 -feet. The last line of that would be changed to: the residential dwellings
shall be 60% single -story, 40% two-story, with those two -stories being located along the
northern border of the subdivision and within the center housing area of the subdivision. For
the preliminary plat, strike condition #4. Condition #8 — I want to leave the same way.
Discussion.
Johnson: Strike #4 and #5 for the preliminary plat site specific conditions of approval.

Johnson: Add #20 to the site specific conditions to state that lot size shall be a minimum of
5,000 square -feet.

B. ACTION ITEM: RZ-09-18/CU-03-05 MOD/PPUD-02-05 MOD/PP-02-18 — Corrente Bello
Subdivision No. 3 Planned Unit Development: D & N Investments, LLC: D & N
Investments, represented by Mark Butler, is requesting a rezone from R -3-P (Residential — PUD)
to R -3 -DA -P (Residential with a development agreement — PUD), conditional use permit
modification, preliminary development plan modification, and preliminary plat approvals for
Corrente Bello Subdivision No. 3, a 15 -lot (12 -buildable, 1 -existing, 2-common)(a re-
subdivision of Lot 20, Block 2, Corrente Bello Subdivision No. 1) residential planned unit
development. The 9.58 -acre site is located on the north side of West Floating Feather Road
approximately 340 -feet west of the intersection of North Moon Bello Way and West Floating
Feather Road at 1400 West Floating Feather Road.
Mark Butler, 1675 East Bishop Way. The applicant's representative provides a brief overview of the
application.
Butler responds to questions from the Commission.
City Planner, Mike Williams, provides a detailed overview of the application.

Chairman Wright opens the Public Hearing.
John LaCamera, 1978 North Valle Bello Way. LaCamera states that he does not oppose the
application, and expresses a desire for the new development to share the same character and is
compatible with the existing subdivision.
Robert Rose, 1387 North Colline Bello Way. Rose states that he is not opposed to a subdivision
application, but is opposed to this particular application due to the proposed layout, clustered lots,
density, the possibility of future re -subdivision of the northern parcel, and drainage concerns.
Rose responds to questions from the Commission.
Jeff Benson, 1343 North Colline Bello Way. Benson opposes the application due to the proposed
layout and clustering of homes.
Sharon Benson, 1343 North Colline Bello Way. Benson opposes the application due to the proposed
layout and lot clustering, reduced property values, and the impact that the proposed subdivision will
have on her view.
Kasey Thompson, 1271 West Peak Bello Way. Thompson expresses concerns about clustered lots,
expresses a desire to have the plan revised to reflect the plan that was presented at the neighborhood
meeting, and requests that lot sizes be required to be consistent with lots throughout the existing
Corrente Bello Subdivision.
Annie Thompson, 1271 West Peak Bello Way. Thompson opposes the application due to the
proposed layout and incompatibility with the existing subdivision, lack of proposed open space, and
states that homes on the proposed lots would not meet the minimums required per subdivision
CC&Rs, and expresses concerns about the slopes on the existing property.
Thompson responds to questions from the Commission.
Cathy Gordon, 1795 North Moon Bello Way. Gordon opposes the application due to the proposed
subdivision layout, front -facing garages, lack of communication with subdivision homeowners, and
expresses a concern about a decrease in property values as a result of the proposed subdivision.
Mike Cooper, 1425 North Colline Bello. Cooper opposes the plan due to the layout, requests that the
Commission deny the application and require it to be revised, requests that water -rights concerns be
addressed, and states that he does not approve of the lot being brought into the homeowners
association.

Zac Erekson, 1360 North Colline Bello Way. Erekson opposes the application due to concerns about
increased traffic in the area where his children play. Erekson expresses displeasure with the
applicant's outreach and communication, concerns related to water rights, and requests that the
Commission deny the application.
Derritt Kerner, Rock Solid Civil, 270 North 27`h Street, Boise, Idaho. Kerner, the applicant's
engineer, provides information about wetlands, drainage, and irrigation.
City Attorney Cherese McLain informs the Commission that Kerner's testimony may be better held
until the applicant's rebuttal time.
The Commission allows Kerner to quickly complete his thought.
Ian Burnett, 1417 North Foresto Bello Way. Burnett, speaking on behalf of the Corrente Bello
Subdivision Homeowners Association, states that the HOA is in support of the application. Burnett
states that negotiations between the HOA and the developer are on-going.
Burnett responds to questions from the Commission.
Lee Young, 1046 West Baja Bello. Young, a member of the Homeowners Association Board, states
that the Board will support annexing the proposed subdivision into the Corrente Bello HOA if the
HOA's conditions are met.
Dennis McCann, 1406 North Foresto Bello Way. McCann states that he is generally in -favor of the
development, and inquires about the intent of site specific condition of approval #22.
Tom Alhquist, 1473 North Foresto Bello Way. Alhquist states that the eight homeowners adjacent to
the proposed development should have the greatest say in regard to whether this application is
approved, and expresses concerns about the architectural style of the proposed homes, water rights,
and the suggested assessment.
Kathy Bennett, 1581 North Foresto Bello Way. Bennett supports the annexation of the property,
would like to see the homes look similar to those existing in Corrente Bello Subdivision, and
discusses the cost of maintaining open spaces.
Doran Dalke, 1304 North Foresto Bello Way. Dalke, speaking as a homeowner in Corrente Bello
Subdivision and as a Board member. Dalke states that he has always known that the subject property
could be redeveloped, states that it is important that the architectural style compliment the existing
homes in the subdivision, and provides some history of the discussions about the proposed
subdivision amongst the homeowners in the Corrente Bello Subdivision.

the Public Hearing.
Dave Buich, 3100 North Glen Stuart Lane. Buich, the applicant, provides rebuttal and responds to
concerns raised during the Public Hearing.

Smith moves to recommend for approval action item RZ-09-18/CU-03-05MOD/PPUD-02-
05MOD/PP-02-18 — Corrente Bello Subdivision No. 3 Planned Unit Development — D & N
Investments, LLC with the following conditions: first of all, on the recommendation for the

rezone on condition 3.9 provide a revised concept plan showing a minimum..." I cannot recall
if that was to stay or to go, but I do remember the discussion.
Discussion.
Smith: Leave both. And on site specific condition #5, you talked about changing it from
concept to preliminary plat, right. And of course, 21 still stays in place, condition 21 about the
pressurized irrigation. Am I missing any other issues that we discussed?
Wright: Commissioner, if I may help you out a little bit, we discussed on site specific condition
#7, removing Mike's note — note L.
Smith: Oh yes, that's right, the typo.
Wright: And then I believe we also addressed additional site specific condition of approval #30
that would talk about lot owners having full responsibility of the shared private drives.
Smith: Okay.
McLaughlin: And leaving the setbacks as they are.
Smith: I have no notes on setbacks.
McLaughlin: I think Mr. Butler wanted them reduced.
Smith: ON I see. Are we talking about 28 and 29, or just 28?
McLaughlin: 28 and 29 — leaving as staff recommended.
Smith: Okay. I don't think there's anything else.

6. NEW BUSINESS: NONE
REPORTS:
A. Commission: Commissioner Smith requests that staff provide an explanation of setbacks at a
future Commission meeting, and inquires if searchable documents can be provided as part of the
packet items provided by staff.
B. City Attorney: City Attorney, Cherese McLain, explains the importance of speaking into the
microphones. McLain also discusses the standard order of inviting "pro" testimony ahead of
"con" testimony during Public Hearings.
C. Staff: City Planner, Mike Williams, informs the Commission that the next meeting will be a
short meeting. Administrative Clerk, Kristl Caron, reminds the Commission that the next
Commission meeting will be held on Tuesday, September 4`h due to the Labor Day holiday.
