Minutes
1. CALL TO ORDER: Meeting called to order at 6:02 P.M.
2. ROLL CALL: Present: WRIGHT, JOHNSON, GUERBER, and SMITH. Absent:
MCLAUGHLIN. A quorum is present.
3. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will
be no separate discussion on these items unless the Chairman, a Commissioner, member of City
Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items
removed from the Consent Agenda will be placed on the Regular Agenda in a sequence
determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle
shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval
motion unless specifically stated otherwise.
A. Minutes of June 18, 2018.
B. Findings of Fact & Conclusions of Law for A-04-18/RZ-06-18 — Annexation and Rezone
from RUT (Rural -Urban Transition — Ada County Designation) to A -R (Agricultural -
Residential) — Brian Bailey: Brian Bailey, represented by Marlo MacKay with RSI
Construction, is requesting an annexation and rezone from RUT (Rural -Urban Transition — Ada
County designation) to A -R (Agricultural -Residential). The 5 -acre site is located on the south
side of West Beacon Light Road at the southwest corner of the intersection of West Beacon
Light Road and North Anacortes Lane at 2741 North Anacortes Lane.
City Planner, Mike Williams, requests that new business items VAC -02-18 and VAC -03-18 be
moved to the consent agenda.
Guerber makes a motion to move items 6A and 6B to the consent agenda as item 3C and item
3D. Seconded by Johnson. ALL AYES... MOTION CARRIES.
Guerber moves to approve the consent agenda item 3 — items A, B, C, and D. Seconded by
Johnson. ALL AYES... MOTION CARRIES.
4. UNFINISHED BUSINESS: NONE
5. PUBLIC HEARINGS:
A. PP -05-18 — Woodcreek Estates Subdivision — SNIKM, LLC: SKMK, LLC, represented by
Wendy Shrief with J -U -B Engineers, Inc., is requesting preliminary plat approval for
Woodcreek Estates Subdivision, a 9 -lot (6 -buildable, 3 -common) residential subdivision. The
4.03 -acre parcel is located at the terminus of West Enchantment Street, North Cobblestone
Lane, and North Cobblestone Way at 489 North Cobblestone Lane.
City Planner, Mike Williams, states for the record that North Cobblestone Way will not connect to
West Enchantment Way upon development of this parcel.
Tamara Thompson, The Land Group, 462 East Shore Drive, Suite 100. The applicant's
representative provides a brief overview of the application.
Thompson responds to comments and questions from the Commission.
City Planner, Mike Williams, provides a detailed overview of the application.

Chairman Wright opens the Public Hearing.
Kyle McCormick, 813 East Jefferson Street, Boise, Idaho. McCormick is speaking on behalf of his
parents who live at 404 North Cobblestone Lane. McCormick is requesting that the homes be
restricted to single -story, requests that the developer be required to install a six-foot privacy fence
along his parents' northern property line, and expresses concerns about the impact that the
subdivision may have on the irrigation of surrounding properties.
McCormick responds to questions from the Commission.
Jerry Deckard, 322 North Cobblestone Lane. Deckard opposes the application due to the proposed
emergency access on North Cobblestone Lane. Deckard states that he does not think the fire
department access belongs on North Cobblestone Lane and explains his experience with contractors
trespassing on his property. Deckard states that the fire department needs to ask his permission
before utilizing North Cobblestone Lane as an emergency access route.
Deckard responds to questions from the Commission.
George Clifton, 402 North Ever After Way. Clifton states that Once Upon A Subdivision has only
one access point, and inquires how it was able to be approved with only one access point.
City Planner, Mike Williams, provides information about subdivision approvals and fire department
access requirements.
Adam Fattorini, 777 North Cobblestone Way. Fattorini supports the application; however, he
expresses concerns about the connection of the public pathway and his experiences with people
trespassing on private property in Clear Creek Crossing Subdivision.
Fattorini responds to questions from the Commission.
Gloria Hicks, 248 North Cobblestone Lane. Hicks reiterates Mr. Deckard's sentiments, and states
that the fire department needs to request permission before utilizing North Cobblestone Lane as an
emergency access route. Hicks provides staff with a copy of a letter signed by the residents on North
Cobblestone Lane.
Hicks responds to questions from the Commission and the City Attorney.
Tamara Thompson, the applicant's representative, provides rebuttal and responds to concerns raised
during the Public Hearing.
Keith Bucher, 11755 West Rockhampton Street, Boise, Idaho. Bucher, the property owner, states
that he intends to live in the subdivision once developed, is agreeable to installing privacy fencing as
requested, and feels that the request for a single -story restriction is unnecessary due to the depth of
the lots. Bucher provides additional information about the emergency vehicle access, open -space
requirements, and explains that the cost of constructing a pathway would create a financial hardship.
Bucher responds to questions from the Commission.
Thompson responds to questions from the Commission.
Chairman Wright closes the Public Hearing.
General discussion amongst the Commission regarding the application.
Smith moves that item 5A PP -05-18 — Woodcreek Estates Subdivision — be continued until
either a legal opinion is rendered regarding the private road access aspect or if you feel that
we can say within 30 -days or so.

Smith amends the motion to continue the application until August 6, 2018. Seconded by
Johnson. ALL AYES... MOTION CARRIES.
6. NEW BUSINESS:
A. VAC -02-18 — Request for a Vacation to the Final Plat of Visne D' Aquila Subdivision —
Jeremy Telford: Jeremy Telford is requesting a vacation of the shared ingress/egress easement
serving Lots 1 and 2, Block 1, of Vigne D' Aquila Subdivision. The 10.48 -acre site is located on
the east side of North Ballantyne Lane approximately 760 -feet north of the intersection of West
Beacon Light Road and North Ballantyne Lane at 3136 and 3218 North Ballantyne Lane.
This item was moved to the consent agenda and recommended for approval.
B. VAC -03-18 — Vacation to the Final Plat of Mace River Ranch Subdivision No. 4 — Weston
Arnell, Gardner Mace Ranch, L.C.: Weston Arnell, Gardner Mace Ranch, L.C., represented
by Kristi Watkins with J -U -B Engineers, Inc., is requesting a vacation of a pond easement
setback line shown on Lot 58, Block 1, Mace River Ranch Subdivision No. 4. The .57 -acre site
is located on the north side of South Brentbrook Lane (Private) at the intersection of South
Brentbrook Lane (Private) and South Hiddenwood Lane (Private) at 573 South Brentbrook
Lane.
This item was moved to the consent agenda and recommended for approval.
REPORTS:
A. Commission: Commissioner Smith inquires about bridges in floodways and sheet flooding.
Chairman Wright inquires about requirements for gated communities.
B. City Attorney: City Attorney, Cherese McLain, informs the Commission that there is an
upcoming hearing for the Two Rivers parking lot, and Attorney Paul Turcke will be able to
provide an update at the August 6" Commission meeting.
C. Staff: City Planner, Mike Williams, informs the Commission that there are a number of
subdivision applications currently in progress, awaiting engineer approval.
