ROLL CALL: Present: WRIGHT, KOELLISCH, GUERBER, JOHNSON, and SMITH. A quorum is present. 3. CONSENT AGENDA: ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. UNFINISHED BUSINESS: NONE Chairman Wright requests a recess at 6:04 P.M. Chairman Wright resumes the meeting at 6:06 P.M. 5. PUBLIC HEARINGS: A. A-05-17/RZ-09-17/CU-14-17/PPUD-08-17/PP-09-17 — Creighton Woods Subdivision — Creighton Woods Development, Inc.: Creighton Woods Development, Inc., represented by Tamara Thompson with The Land Group, Inc., is requesting an annexation, rezone from RUT (Residential -Urban Transition — Ada County designation), R -E (Residential -Estates), and R-1 (Residential) to R -2 -DA -P (Residential with a development agreement — PUD), conditional use permit, preliminary development plan and preliminary plat approvals for Creighton Woods Subdivision, a 64 -lot (58 residential, 6 common) residential planned unit development. The 50.92 -acre site, consisting of four (4) parcels, is located south of the South Channel of the Boise River between the terminus of West Oakhampton Drive on the east and the terminus of East Clear Creek Drive on the west. Steven Smith, 2274 West Clearvue Court. Smith states that he would prefer to see the land remain undeveloped; however, he appreciates the planning and density of the proposed subdivision and supports the application. Larry Sandusky, 7602 North Canyon Drive. Sandusky applauds the proposed plan; however, he opposes the application due to concerns related to traffic on surrounding small streets and problems with speeding traffic in the area. Sandusky responds to questions from the Commission. Brent Stanger, 510 East Clear Creek Drive. Stanger applauds the density of the development; however, he opposes the application due to traffic and safety concerns, and requests that the application be remanded to Ada County Highway District to re-evaluate the traffic and safety concerns. Commissioner Smith states for the record that he is an acquaintance of Mr. Stanger. Stanger responds to questions from the Commission. Nancy Stanger, 540 East Clear Creek Drive. Stanger states for the record that she is an acquaintance of Commissioners Smith and Guerber. Stanger opposes the application, requests that the property be used for emergency access only, and expresses concerns related to decreased property values, traffic, and safety. Stanger responds to questions from the Commission. Commissioner Guerber states for the record that he knows Mr. Stanger. L. Don Stanger, 540 East Clear Creek Drive. Stanger states that he is an acquaintance of Commissioners Smith and Guerber. Stanger opposes the application and explains his desire for the area to remain as quiet as it is currently. Gary Rock, 1932 West Colchester Drive. Rock opposes the application, states that he would like to see the roads outside of the proposed development widened, and states his concerns about flooding in the area. Candace Gates, 1398 West Overlake Court. Gates opposes the application and expresses concerns about increased traffic and safety. Richard McPherson, 1843 West Sugar Crest Street. McPherson opposes the application and expresses concerns about increased traffic and wetlands in the proposed development. Tom Moore, 152 East Clear Creek Drive, Meridian, Idaho. Moore opposes the application due to concerns about the public access pathway, traffic in the area, and the possibility that people will use the residential streets as an alternate route to avoid Chinden Blvd. Dennis Creek, 770 East Clear Creek Drive. Creek opposes the application and expresses concerns about traffic and the Army Corps of Engineers' report. Tom Moore explains his personal experience working with the Army Corps of Engineers. The applicant provides rebuttal, addresses the concerns from public testimony, and responds to questions from the Commission. Chairman Wright closes the Public Hearing. Page 2 of 3 K:\P&Z\M I NUTES\2018\PZ-03.05-18min.doc Johnson makes a recommendation to approve item 5A A-05-17/RZ-09-17/CU-14-17/PPUD-08- 17/PP-09-17 — Creighton Woods Subdivision — Creighton Woods Development with the site specific conditions of approval with the staff recommended changes to items 3.8 and 3.9 for the annexation and rezone, as well as adding to 3.12 the wording regarding the easement number, site specific conditions of approval for the conditional use permit, the preliminary development plan, and the preliminary plat, with the staff recommended changes to item #4 and required setbacks, and item #9. City Planner, Mike Williams, makes a point of clarification. Williams explains that item #3.9 pertains to a natural pathway, so it will remain unchanged; Williams explains that with site specific condition #4, the preference is the applicant's requested setback with exception of the street side setback being at 25 -feet. Johnson agrees with Williams' points of clarification. Seconded by Wright. ALL AYES... MOTION CARRIES. 6. NEW BUSINESS: NONE REPORTS: A. Commission: Commissioner Guerber informs staff and the Commission that he will be absent for the March 19, April 2, and April 16 Commission meetings. Commissioner Johnson informs the Commission that she will be absent for the May 7 Commission meeting. Johnson inquires whether the Commission will see a draft of the oil and gas ordinance. B. City Attorney: City Attorney, Cherese McLain, informs the Commission that the oil and gas ordinance will come before the Commission as a public hearing, and that the goal is to have the draft version ready for dissemination next week. C. Staff: City Planner, Mike Williams, informs the Commission that there will be two public hearings on March 19". 8. ADJOURNMENT: Smith moves to adjourn. Seconded by Johnson. ALL AYES...
