Minutes
1. CALL TO ORDER: Meeting called to order at 6:00 P.M.
2. ROLL CALL: Present: WRIGHT, GUERBER, JOHNSON, KOELLISCH, and SMITH. A quorum
is present.
3. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will
be no separate discussion on these items unless the Chairman, a Commissioner, member of City
Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items
removed from the Consent Agenda will be placed on the Regular Agenda in a sequence
determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle
shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval
motion unless specifically stated otherwise.

B. Findings of Fact & Conclusions of Law for A-02-17/RZ-05-17/CU-12-17/PPUD-06-17/PP-
06-17 — Brookway Subdivision — Trilogy Idaho: Trilogy Idaho, represented by Kent Brown, is
requesting an annexation, rezone from RUT (Residential -Urban Transition — Ada County
designation) to R -2 -DA -P (Residential with a development agreement — PUD), conditional use
permit, preliminary development plan, and preliminary plat approvals for Brookway
Subdivision, a 122 -lot (105 -buildable, 17 -common) residential planned unit development. The
61.34 -acre site is generally located on the west side of North Lanewood Road, approximately
1/2—mile north of the intersection of North Lanewood Road and West Floating Feather Road.
C. Findings of Fact & Conclusions of Law for PP/FP-03-17 — Piccadilly Village Subdivision
No. 2 — Old Town I. LLC: Old Town I, LLC, represented by Mark L. Butler, is requesting
combined preliminary/final plat approval for Piccadilly Village Subdivision No. 2, a 3 -lot
commercial subdivision (re -subdivision Lot 14, Block 1, Piccadilly Village Subdivision). The
1.75 -acre site is located at the southeast corner of North Echohawk Lane and East Hill Road at
220 South Echohawk Lane.
Guerber makes a motion that the consent agenda be approved. Seconded by Johnson. ALL
AYES... MOTION CARRIES.
4. UNFINISHED BUSINESS: NONE
PUBLIC HEARINGS:
A. RZ-06-17 & PP -07-17 — Senora Creek Subdivision No. 4 — Michael Stephenson: Michael
Stephenson, represented by Matt Schultz, is requesting a rezone with a development agreement
from R -E (Residential -Estates) to R -3 -DA (Residential with a development agreement) and
preliminary plat approval for Senora Creek Subdivision No. 4, a 9 -lot (6 residential, 3 common)
residential subdivision. The 2.64 -acre site is located on the west side of North Park Lane,
approximately 1,025 -feet south of the intersection of North Park Lane and West Floating
Feather Road at 889 North Park Lane.
Matt Schultz, 8421 South Ten Mile Road, Meridian, Idaho. The applicant's representative provides
a brief overview of the application.
Schultz responds to questions from the Commission.

City Planner, Brian Parker, provides a detailed overview of the application.
Parker responds to questions from the Commission.
Chairman Wright opens the Public Hearing.
Robert Stave, 4231 West Briar Rock Court. Stave opposes the application due to concerns about
three houses being proposed directly behind his property, his loss of privacy, and the impact to his
view of the foothills. Stave states that he did not receive notice of a neighborhood meeting.
Douglas Hart, 4288 West Briar Rock Court. Hart states that he did not receive notice of a
neighborhood meeting. Hart opposes the application because he feels that the lots should be large
lots and has concerns about over -development.
Hart responds to questions from the Commission.
Darrell Cluka, 4270 West Prickly Pear Drive. Cluka would like to see the property remain
Residential -Estates.
Michelle Macaw, 4242 West Prickly Pear Drive. Macaw opposes the application due to concerns
about privacy/safety and would prefer that the property remain a ranch.
Macaw responds to questions from the Commission.
Tom Bergstrom, 997 North Park Lane. Bergstrom raises and butchers animals on the property to the
north and opposes the application because of potential conflict between neighbors and the
animals/activities on his property.
Wyatt Johnson, 1191 East Iron Eagle Drive. Johnson recommends that the Commission not approve
this application due to compatibility concerns between surrounding lots.
Schultz provides rebuttal and responds to the concerns of the public.
Chairman Wright closes the Public Hearing.
Parker and Schultz respond to a question from the Commission.
Chairman Wright invites the members of the public to respond to Schultz's testimony.
No members of the public wish to testify.
General discussion amongst the Commission regarding the application.
Guerber makes a motion to table this item until the Council meeting of April 91' at which time
we will then have more information in which to make a decision. Seconded by Smith.
City Attorney, Cherese McLain, informs Commissioner Guerber that the Planning & Zoning
Commission meetings in April are either April 2 or April 16.
Guerber makes a motion to table the application until Monday, April 16". Seconded by Smith
for discussion purposes.
General discussion amongst the Commission.

B. A-03-17 & RZ-07-17 — Annexation and Rezone from RUT (Rural -Urban Transition — Ada
County Designation) to R -E -DA (Residential -Estates with a Development Agreement) —
Ryan Wilhite: Ryan Wilhite, represented by Marks Land Surveying, Inc., is requesting
approval of an annexation with rezone with a development agreement from RUT (Rural -Urban
Transition — Ada County Designation) to R -E -DA (Residential -Estates with a development
agreement). The 5 -acre site is located on the south side of West Beacon Light Road
approximately 600 -feet east of North Ballantyne Lane at 1825 West Beacon Light Road.

Wilhite responds to questions from the Commission.
City Planner, Brian Parker, provides a detailed overview of the application.
Chairman Wright opens the Public Hearing.
Thomas Brengle, 2475 North Sun Valley Place. Brengle is representing Friends of Beacon Light
Road but speaking on behalf of himself. Brengle supports the application due to the low-density and
the fact that Ada County Highway District (ACRD) is not requiring any improvements or
modifications to Beacon Light Road.
Dan Engeberg, 1723 West Beacon Light Road. Engeberg states that the Wilhites are good neighbors
and that he supports the application.
Gayle McKee, 1887 West Beacon Light Road. McKee is concerned about a new house being
located close to hers, and requests that a berm be installed or the new house be required to be
located further from her house to protect her privacy.
Wilhite provides rebuttal and responds to concerns from the public.
Chairman Wright closes the Public Hearing.
General discussion amongst the Commission.
Koellisch makes a motion to recommend for approval A-03-17. Seconded by Smith. ALL
AYES... MOTION CARRIES.
Koellisch makes a motion to recommended for approval RZ-07-17. Seconded by Smith. ALL
AYES... MOTION CARRIES.
Chairman Wright states for the record that Mr. Wilhite is his wife's boss, and states that the
relationship did not influence his vote.
6. NEW BUSINESS: NONE
7. REPORTS:
A. Commission: Commissioner Koellisch asks the City Attorney for an update regarding an oil &
gas (fracking) ordinance.
B. City Attorney: None.
C. Staff: None.

Guerber moves to adjourn. Seconded by Wright. ALL AYES... MOTION CARRIES.
