Special Meeting Minutes
1. CALL TO ORDER: Meeting called to order at 6:07 P.M.
?. ROLL CALL: Present: WRIGHT, GUERBER, and JOHNSON. Absent: SMITH and
KOELLISCH. A quorum is present.
CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of June 19, 2017.
B. Findin s of Fact & Conclusions of Law for PP/FP-02-17 & CU -02-17 — Kestrel
Commons Subdivision — David CalIister: David Callister, represented by Travis Perry, is
requesting combined preliminary/final plat and conditional use permit approval for Kestrel
Commons Subdivision, a 2 -lot (l, 4 -unit multi -family dwelling, I commercial building)
mixed-use development. The 0.38 -acre site is located on the east side of South Kestrel Place
approximately 250 -feet south of West State Street at 174 South Kestrel Place.
C. Findings of Fact & Conclusions of Law for CU -04-17 — 138 kV Transmission Line —
Idaho Power: Idaho Power, represented by Jeff Maffuccio, is requesting conditional use
permit approval to construct a 138 kV transmission line along the south side of West Beacon
Light Road (extending from the substation site located on the southeast corner of West
Beacon Light Road and North Linder Road) to North Palmer Lane and then extending south
on the east side of North Palmer Lane to SH 44. The application also includes permitting for
a future 138 kV transmission line route along the south side of West Beacon Light Road
extending from North Palmer Lane west to SH -16.
D. Findings of Fact & Conclusions of Law for CPA-01-17/A-01-17/RZ-03-17/CU-01-
17/PPUD-01-17/PP-01-17 — Bald Eagle Pointe Planned Unit Development — Martin,
LLC: Martin, LLC, represented by Shawn Nickel with SLN PIanning, is requesting a
comprehensive plan map amendment to change the future land use map designation from
Residential One to Residential Two, a comprehensive plan text amendment to modify
Section 6.8.4 -- River Plain PIanning Area, an annexation, rezone from RUT (Rural -Urban
Transition — Ada County designation) to R -3 -DA -P (Residential with a development
agreement — PUD), conditional use permit, preliminary development plan, and preliminary
plat approvals for Bald Eagle Pointe Subdivision, a 71 -lot (63 -buildable, 8 -common)
residential planned unit development. The 41.15 -acre site is located on the south side of
West State Street (SH -44) at the southeast corner of West State Street (SH -44) and West
Moon Valley Road.
Guerber moves to approve the consent agenda as written. Seconded by Wright. Johnson
abstains from voting. ALL AYES... MOTION CARRIES.

A. ZOA-01-17 -- Zoning Ordinance Amendment - City of Eagle: An ordinance of the City of
Eagle, Ada County Idaho, amending Title 2 "Boards and Commissions", Chapter 2 "Design
Review Board", Sections 1, 2, 4; and amending Title 8 "Zoning", Chapter 2 "Zoning
Districts and Map", Article A "Design Review Overlay District"; providing a severability
clause; and providing an effective date.
The proposed ordinance amendment establishes recommendation duties and authorities of
the Design Review Board and Zoning Administrator, and provides for the final decision on
design review applications to be made by the City Council.
Zoning Administrator, William E. Vaughan, gives a detailed overview of the application.
Administrator Vaughan requests changes to the draft ordinance and answers questions from the
commission.
Chairman Wright opens the Public Hearing.
Councilman Bastian, Eagle City resident, provides a history of the Design Review Board, states
that he feels elected officials should make the final decision, and would like the process to go
back to where the City Council makes the final decisions.
Staff requests the Commission approve the ordinance with changes requested.
Chairman Wright closes the Public Hearing.
General discussion amongst the Commission.
Guerber makes a motion that we approve ZOA-01-17 — Zoning Ordinance Amendment for
the City of Eagle with the amendments outlined by Mr. Vaughan.
Section 2-2-2: TERMS OF OFFICE, VACANCIES:

After "The term of the appointment" add "for at large members" and after "shall be for
three (3) years" change the comma to a period, strike through "with exception of the City
Council representative who shall serve a term of up to one year as defined by the City
Council." and add "The term of appointment for the City Council representative shall be
for one 1 year.
Section 2-2-4: Duties, jurisdiction, and authority:

After "Lack of a quorum of board members shall require review of pending business by
the Board during the next," strike through "regular" and finish the sentence with
"scheduled board meeting."

B. CU-06-17/PPUD-03-17/PP-03-17 — Sno ualmie Falls No. 10 Planned Unit Development
— Brahma, LLC: Brahma, LLC, represented by Justin Martin, is requesting conditional use
permit, preliminary development plan, and preliminary plat approval, for Snoqualmie Falls
Subdivision No. 10, a 167 -lot (140 -buildable, 26 -common, and l -sewer pump station lot)
residential planned unit development. The 74.83 -acre site is located on the east side of North
Palmer Lane approximately 1,875 -feet south of the intersection of North Palmer Lane and
West Floating Feather Road.
Justin Martin with Brahma, LLC, 6401 Floating Feather Road, Eagle. Martin gives a brief
overview of the application. Martin requests site specific conditions be changed to allow
flexibility to have the tot lot at the soccer park instead of in this phase.
City Planner, Mike Williams, gives a detailed overview of the application. Planner Williams
requests the following changes to site specific condition #10: add "and preliminary development
plan" after preliminary plat in the first sentence. Strike through five-foot (5') and add "ten -foot
(10')" within the requested plat note.
Chairman Wright opens the Public Hearing.
Stoney Foster, 746 North Longhorn Avenue, Eagle, Idaho 83616. Foster is glad that Long Horn
Avenue is not going to be required to connect through to Snoqualmie Falls Subdivision No. 10.
Foster is concerned about privacy for their livestock and concerned with neighborhood animals
getting into their property. The developer has offered to put up a solid fence to assist with the
privacy between the two developments.
Jim Shippers, 150 North Long Horn Street. Shippers is concerned with the amount of water
usage of the development.
Applicant provides rebuttal and address the concerns from public testimony.
Chairman Wright closes the Public Hearing.
General discussion amongst the Commission.
Guerber makes a motion that we approve CU-06-17/PPUD-03-17/PP-03-17 — Snoqualmie
Falls No. 10 Planned Unit Development with the following changes to the site specific
conditions of approval recommended by the staff.
In Item 4 in the last sentence refers to specific buffer areas that language be included that
says properties of the Lincoln Park Subdivision on the southern boundary adjacent to the
development shall include the addition of a 6 -foot fence, privacy fence.
In regard to Item 9, in lieu of the revised preliminary plat and development plan showing a
common lot containing a tot lot, the developer will add an additional tot lot in the central
park area Lot 20, Block 6 Phase 4.

Item 10 the wording would be provide a revised preliminary plat and preliminary
development plan showing Lots 46 and 50, Block 6, Lots 3, 38, and 42, Block 12, Lot 19,
Block 13, Lots 18 and 23, Block 14, Lots 6, 9, 17, and 22, Block 16, Lots 6, 9, 17, and 22,
BIock 17, and Lot 1, Block 18... And including the ten -foot (101) wide common lot located
between the street and the buildable lots rather than the five-foot.
Discussion. Seconded by Johnson. ALL AYES ... MOTION CARRIES.
6. NEW BUSINESS:
A. VAC -03-17 — Vacation to the Final Plat of Carlene Estates Subdivision — Robin Rissell:
Robin Rissell, represented by John Bottles, is requesting a vacation of the 35 -foot wide
landscape and irrigation easement located adjacent to North Locust Grove Road within Lot
4, Block 6, Carlene Estates Subdivision. The 1.22 -acre site is located on the west side of
North Locust Grove Road approximately 550 -feet north of the intersection of West Stafford
Street and North Locust Grove Road at 2748 South Pasa Tiempo Way.
The applicant is not present.
City Planner, Mike Williams, gives a detailed overview of the application.
Johnson makes a motion to recommend we approve VAC -03-17 — Vacation to the Final
Plat of Carlene Estates Subdivision — Robin Rissell. Seconded by Guerher. ALL
AYES ... MOTION CARRIES.
7. REPORTS:
A. Commission: Commissioner Guerber states the Eagle is Home Committee will meet on July
19th
B. City Attorney: City Attorney, Cherese McLain, updates the commission on the Idaho
Materials and Construction litigation and potential litigation regarding the Two Rivers
parking area.
C. Staff: City Planner, Mike Williams, updates the Commission that there will be five public
hearings on the 25" for City Council.
8. ADJOURNMENT:
Wright moves to adjourn. Seconded by Guerber. ALL AYES... MOTION CARRIES.
Hearing no further business, the Commission meeting adjourned at 7:34 P.M.
