ROLL CALL: Present: WRIGHT, KOELLISCH, and SMITH. Absent: GUERBER and VILLEGAS. A quorum is present. 3. CONSENT AGENDA: ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of June 5, 2017. B. Findings of Fact & Conclusions of Law for RZ-04-17 — Rezone from MU Mixed Use to MU - DA Mixed Use with a Development Agreement in lieu of a PUD for Mustang Crossing Mixed Use Commercial Development — Jacksons Food Stores/Scott Stom: Jacksons Food Stores/Scott Stom, represented by Todd Lakey with Borton-Lakey Law and Policy, is requesting a rezone from MU (Mixed Use) to MU -DA (Mixed Use with a development agreement [in lieu of PUD]) for Mustang Crossing mixed use commercial development, which includes a convenience store with fuel service. The 11.22 -acre site is located on the northeast corner of Park Lane and State Highway 44, on Lots 1, 4, and 9 of the Amended Plat of Flint Estates, at 3950 West State Street. C. Findings of Fact & Conclusions of Law for CU-03-17/PPUD-02-17/PP-02-17 -- Feldspar Subdivision — Eagle Single Family, LLC: Eagle Single Family, LLC, represented by John Rennison, P.E., with Rennison Engineering, is requesting conditional use permit, preliminary development plan, and preliminary plat approvals for Feldspar Subdivision, a 21 -lot (13 -buildable, 8 -common) residential planned unit development. The 3.44 -acre site is located on the east side of North Taylor Street approximately 950 -feet north of the intersection of West State Street and North Taylor Street at 368 North Taylor Street. Koellisch makes a motion to recommend for approval the consent agenda as written. Seconded by Smith. ALL AYES... MOTION CARRIES. 4. UNFINISHED BUSINESS: A. VAC -03-17 — Vacation to the Final Plat of Carlene Estates Subdivision — Robin Rissell: Robin Rissell, represented by John Bottles, is requesting a vacation of the 35 -foot wide landscape and irrigation easement located adjacent to North Locust Grove Road within Lot 4, Block 6, Carlene Estates Subdivision. The 1.22 -acre site is located on the west side of North Locust Grove Road approximately 550 -feet north of the intersection of West Stafford Street and North Locust Grove Road at 2748 South Pasa Tiempo Way. This item was continued frown the Atne 5, 2017, Planning & Zoning Commission meeting. City Planner, Mike Williams, requests that the Commission remand the application to staff. PP/FP-02-17 & CU -02-17 — Kestrel Commons Subdivision — David Callister: David CalIister, represented by Travis Perry, is requesting combined preliminary/final plat and conditional use permit approval for Kestrel Commons Subdivision, a 2 -lot (1, 4 -unit multi -family dwelling, 1 commercial building) mixed-use development. The 0.38 -acre site is located on the east side of South Kestrel Place approximately 250 -feet south of West State Street at 174 South Kestrel Place. This item was continued from the Atne 5, 2017, Planning & Zoning Commission meeting. Travis Perry, 1300 East State Street, #103. The applicant's representative explains that he does not have a formal presentation and requests that staff present so that he can respond to staff's presentation if needed. Perry explains that the applicant's only concerns are related to the connectivity on the eastern boundary and the proposal to move the connectivity to the southern portion of the development. City Planner, Brian Parker, provides a detailed overview of the application. The applicant's representative responds to staff's presentation. Chairman Wright opens the Public Hearing. Smith makes a motion to recommend for approval item 5A PP/FP-02-17 and CU -02-17 Kestrel Commons Subdivision — recommend for approval with the following addition: to add specific condition #15 to indicate that the request for pressurized irrigation system waiver has been granted. Seconded by Koellisch. Discussion. Smith amends the motion to strike condition #13 and to add the new #15 regarding the pressure irrigation system waiver. Discussion. Smith confirms his amended motion. Seconded by Koellisch. ALL AYES... MOTION CARRIES. B. CU -04-17 — 138 kV Transmission Line -- Idaho Power: Idaho Power, represented by Jeff Maffuccio, is requesting conditional use permit approval to construct a 138 kV transmission line along the south side of West Beacon Light Road (extending from the substation site located on the southeast corner of West Beacon Light Road and North Linder Road) to North Palmer Lane and then extending south on the east side of North Palmer Lane to SH 44. The application also includes permitting for a future 138 kV transmission line route along the south side of West Beacon Light Road extending from North Palmer Lane west to SH -16. Jeff Maffuccio, Idaho Power, 1221 West Idaho Street, Boise, Idaho 83702. The applicant provides a brief overview of the application. The applicant responds to questions from the Commission. Tim Phillips, Project Manager for Idaho Power, 602 North Senora Way. Phillips responds to questions from the Commission. City Planner, Brian Parker, provides a detailed overview of the application. Staff responds to questions from the Commission. Chairman Wright opens the Public Hearing. Tom Brengle, 2475 North Sun Valley Place. Brengle expresses concerns that there is no input from Ada County Highway District (ACHD) in the packet, and expresses concerns regarding how this project will interact with future roadwork plans on Beacon Light Road. Theresa Johnson, 3417 North Croft Way. Johnson expresses concerns about the appearance of the power poles and wires, explains that underground transmission lines would be preferred, and expresses concerns regarding how the power poles will interact with future ACHD plans. Darlene Travis, 320 North Palmer Lane. Travis explains that she believes that transmission lines were run underground on Floating Feather Road and would like the same to be done with this project. Travis states that she is voicing concerns on behalf of her father, questions why Linder Road is not being considered as a location for this project, expresses concerns about the diameter of the poles being installed, and traffic along Palmer Lane. Steve Bruneel, 2810 North Lanewood Road. Bruneel inquires about the proposed location of the poles along Beacon Light Road. The applicant provides rebuttal and addresses the concerns from public testimony, and responds to questions from the Commission. Smith makes a motion to recommend for approval item 5B CU -04-17 — 138 -kV Transmission Line — Idaho Power — with the exception that Specific Condition #4 be modified to include language to state that the steel poles shall not exceed 82 -feet in overall height and the wooden poles do not exceed 70 -feet in overall height. Seconded by Koellisch. Discussion. ALL AYES... MOTION CARRIES. B. CPA-01-17/A-01-17/RZ-03-17/CU-01-17/PPUD-01-17/PP-01-17 — Bald Eagle Pointe Planned Unit Development — Martin. LLC: Martin, LLC, represented by Shawn Nickel with SLN Planning, is requesting a comprehensive plan map amendment to change the future land use map designation from Residential One to Residential Two, a comprehensive plan text amendment to modify Section 6.8.4 — River Plain Planning Area, an annexation, rezone from RUT (Rural -Urban Transition — Ada County designation) to R -3 -DA -P (Residential with a development agreement — PUD), conditional use permit, preliminary development plan, and preliminary plat approvals for Bald Eagle Pointe Subdivision, a 71 -lot (63 -buildable, 8 -common) residential planned unit development. The 41.15 -acre site is located on the south side of West State Street (SH -44) at the southeast corner of West State Street (SH -44) and West Moon Valley Road. Shawn Nickel, 1589 North Estancia Place. The applicant's representative provides a brief overview of the application. City Planner, Nichoel Baird Spencer, provides a detailed overview of the Comprehensive Plan Amendment application. City Planner, Mike Williams, provides a detailed overview of the application. Chairman Wright opens the Public Hearing. Richard Cuneo, 364 South Moon Beam Way. Cuneo does not oppose the application, but expresses concerns about current traffic conditions in the area and the lack of guarantee that the development will have two access points. Shawn Nord, 5337 West Sate Street. Nord does not oppose the application, but expresses concerns about traffic and explains that the road to the east of the development that was discussed during the presentation would be located on his private property, and explains that he has not been contacted by ACHD about a future road. Theresa Johnson, 3417 North Croft Way. Johnson does not oppose the application, but expresses concerns about the safety of the initial single ingress/egress of the proposed subdivision. The applicant provides additional information regarding the application, including details about a Fire Department access road to be located on the property, provides information about the layout of the site, and expresses concerns about staff recommendation #3.4(c) and setbacks. Smith makes a motion to recommend for approval the staff recommendation of Comprehensive Plan Amendment as described in this application. Seconded by KoeIlisch. ALL AYES... MOTION CARRIES. Smith makes a motion to recommend for approval the annexation and rezone application by Bald Eagle Pointe Island Planned Unit Development — Martin LLC, all conditions stand as is. Discussion. Smith amends the motion to include staff recommended conditions of approval as discussed. Seconded by KoeIlisch. City Planner, Mike Williams, requests clarification that the motion includes the staff recommended conditions of development to be placed in the development agreement, which is RZ-03-17, and then the site specific conditions of approval and standard conditions of approval of the CU, PPUD, and PP. Staff: City Planner, Nichoel Baird Spencer, explains that the Comprehensive Plan is nearly ready for review and discusses the option of scheduling special meeting(s) to review the plan prior to Public Hearing.
